AMENDMENT NO. 0001
No. CONTRACTOR QUESTION GOVERNMENT ANSWER
1 1.2.8.1 - states that Debris clins are for material that weighs less than 600 lbs per CYD. In section 1.2.12 it states that material weight less than 300 lbs per cyd will be suffixed with a DB. Can you please clarify
1.2.8.1 will be amended to 300 lbs per CYD. CLIN 9907DB is Non-RCRA bulk and will be removed from the title of 1.2.12 as it does not apply to the Light Bulk Shipments.
2 9404IL - in section 1.2.12.1 states that this clin will only be ordered when the material is packaged in bulk containers. Can you verify what type of bulk container this material will be packaged in?
Bulk containers may consist of 11G tri-walls and or IBC super-sacks. Historically we've primarily seen this waste packaged in tri-walls.
3 (a) How is material managed under CLIN 9407 typically packaged?
(b) Is the material packaged into a "composite bag" type of container?
(c) If so how large are these containers?
(a) Across the contract, we've historically seen about a 50/50 mix of IBC super-sacks and 11G tri-walls turned in under CLIN 9407.
(b) For RCRA bulk packaging we have seen it mostly packaged in 11G tri-walls. However, IBC super-sacks are also used.
(c) Intermediate Bulk Containers (typically consists of 11G tri-walls and super-sacks).
Note: Generators may use any form bulk packaging appropriate for the matierals, so long as the packaging is compliant with 49 CFR.
4 I have the same question for CLINS 9407DB, 9907, 9907AS. and 9907DB. CLIN 9407DB typically packaged in super-sacks, but may also be packaged in tri-walls. CLIN 9907 is typically packaged in 11G tri-walls, however this may also be packaged in super-sacks.
9907AS is packaged in appropriate plastic bags and then typically placed into 11G tri-walls.
9907DB is typically packaged in 11G tri-walls, however the generators may also use super-sacks.
5 It is our understanding that the blast grit stream (9907 BG) was removed from the current contract. Is it the navy's intent to begin shipping this material under the new award?
Yes.

QUESTIONS AND ANSWERS
SP4530-17-R-0002, HAWAII HW CONTRACT
6 (a) Regarding CLIN 9907BG are there any special loading requirements that a contractor needs to know about?
(b) Are the 2 ton bags located on a loading dock?
(c) What type of access will the contractor, forklift, and tractor/trailer have to the material?
(d) Do to the time crunch for this solicitation and thus the inability to hold a job walk can you explain the type of equipment that the current vendor is using to perform this work?
(e) Are they using a flat bed and 4,000 lb forklift?
(a) MHE appropriate for loading may include a Gradall with extendable boom: A Forklift with attachments/slings may also be appropriate to move the material which will primarily be packaged in IBC super-sacks and or drums under CLIN 9904BG. Requirements should be determined by offerors and will be dependent upon the contractor's transportation conveyance to the disposal facility.
b) No loading docks are available. Material must be loaded from the ground using contractor's MHE equipment. Determining loading equipment necessary is dependent upon the offeror's transportation equipment and disposal method.
(c) Full access to the material is provided in multiple staging areas w/in Controlled Industrial Area (CIA).
(d) Previous removals were made using a Gradall w/ extendable boom and end dump trailer pulled by a tractor rig.
(e) Not historically. A 4,000 lb forklift was used to assist with staging of the sacks, but not for loading.
7 1.2.2 SEGREGATION OF HAZARDOUS WASTE
This section reads “All items collected on this contractmust be…..
physically separate from any containers not associated with this contract until the initial TSDF is reached” Typically, many items collected under the scope of work will be containerized and shipped in intermodal containers with containers of waste not associated with this contract to fill the container and reduce shipping costs. Is this practice acceptable?
Yes, loading of intermodal shipping containers destined to the Continental U.S. with non-government waste is acceptable. All wastes must be delivered to an approved TSDF on the qualified facilities listing.
8 1.2.5 TREATMENT OF HAZARDOUS WASTE ON GOVERNMENT
FACILITIES
Paragraph 2 restricts the contractor from draining PCB items on government property. Shipping tariffs restrict the shipment of PCB transformers that are full of oil because of the risk they pose during transportation. Additionally, depending on the size of the electrical equipment, a facility may need a permit to drain and flush the oil.
For larger transformers, they are drained by the generator prior to shipment. For smaller transformers that can fit into a 55/85 gallon drums, these items may or may not be drained.

9 1.2.7 WEIGHING OF ITEMS
(a) Can the vehicle weight noted on the Department of Motor Vehicle Registration be used to establish the empty (tare) weight of a vehicle?
(b) Can the vehicle be loaded, weighed at a certified scale, and then weighed again at a certified scale after the waste has been removed to determine the actual (net) weight?
(a) No.
(b) Yes; however weight tickets must be provided to the COR and generator w/in 1 business day of removal.
10 It is our understanding that PHNSY is currently managing CLINs 9904BG and 9907BG outside of this contract. Are the estimated quantities for these CLINs in Attachment I accurate?
Yes. Quantities projected are based on past generations along with future estimated projections.
11 EVALUATION OF PAST PERFORMANCE INFORMATION (PPI)
The Government will be looking for record of performance “same or similar” in nature to the current requirement. There is no other contract in the State of Hawaii which is “same or similar” in size and scope.
Therefore, local companies who have not performed this contract in the past would not be able to produce relevant PPI. Additionally, the Government would rate PPI higher for companies who have performed other DLA Hazardous Waste contracts outside of Hawaii even though they may never have done any work in Hawaii. Companies who have not done work in Hawaii are generally not familiar with logistical and economic changes unique to shipping hazardous waste over the Pacific Ocean. It may serve the Government review process better if this standard evaluation process was modified to be inclusive of local businesses. For example, allow for the prospective Contractor to submit an executive summary that can be used in addition to the PPI form. Can Contractors submit executive summary or other information that can be used inaddition to the PPI form?
Yes, offerors can include an executive summary or other information that can be used inaddition to the PPI form.
Maritime shipping experience in general is important for this evaluation, but not necessary to be specific to the State of Hawaii.
Note that " ADDENDUM TO SP4530-17-R-0002, PROPOSAL SUBMISSION FORMAT AND CONTENT, (b)(2)(ii) includes "An offeror’s performance on contracts with similar scope, complexity, magnitude and included maritime shipping will be considered especially valuable."

12 Attachment 16, Acceptable Performance Levels Non – compliance of Section 1.3.1 for 35 and 45 day return manifests has a disincentive fee of 10% each.
(a) Is that 10% each compounded?
(b) For example, if a manifest is not returned in 45 days is there a disincentive fee of 10% for exceeding the 35 day period and another disincentive fee of 10% for exceeding the 45 day period?
(c) Does this disincentive fee apply for waste generated from CESQGs who are not subject to this rule?
This disincentive fee seems excessive. Regulators at EPA Region IX and State of Hawaii, Solid and Hazardous Waste Branch both understand the logistical challenges shipping waste from Hawaii and typically only require a copy of the final manifest be sent to them with a notation of when the manifest was received.
(d) Can this Acceptable Performance Level disincentive fee be removed to keep so the contractor can use barge services to keep CLIN cost down?
(a) Yes
(b) Yes
(c) Yes
(d) No
13 Reverse Auction? with discussions? or without discussions? Reverse Auction: will not be utilized for this solicitation.
Discussions: The Gov't has the option to award with or without discussions. Therefore, offerors should submit their best pricing in their initial proposal.
FAR clause 52.212-1 -- Instructions to Offerors -- Commercial Items, is included by reference.
FAR 52.212-1(g) states: "Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors.
Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received."
