The purposes of this amendment is to make the following changes to the solicitation and answer the following questions:

1.The following revision has been made and incorporated into the solicitation for Africa:

52.212-02 EVALUATION - COMMERCIAL ITEMS (OCT 2014) FAR has been amended to read as follows:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Technical For award purposes, the following factors shall be used to evaluate offers with an acceptable technical proposal:

Past Performance Price Past Performance is significantly more important than price.

Technical and past performance, when combined, are Not Applicable – see above. [Contracting Officer state the relative importance of all other evaluation factors, when combined, when compared to price.] (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

2.The following language is added and incorporated into the solicitation under

ADDENDUM TO 52.212-2, EVALUATION - COMMERCIAL ITEMS

I. Award

There is one price schedule with two (30-month) Ordering Periods (OP) in the solicitation. Both ordering periods must be completed and submitted as a single priced proposal, along with the associated technical proposal and past performance information, to be considered a responsive proposal.

It is anticipated that a single proposal will be determined to offer the best value to the Government, resulting in a single contract to be awarded for the full period of performance described in this solicitation

IV Evaluation of Past Performance

(1) The Government will conduct a Performance Confidence Assessment for each offeror based upon submitted current, relevant PPI [consisting of Past Performance (PP) references] as it relates to the expectation of the offeror being able to successfully perform the requirement. There are two aspects to this evaluation. (1) the determination of relevance to this solicitation in scope, magnitude and complexity and (2) how well the offeror performed on their contracts. Past performance will be rated on an adjectival scale. Thus, an offeror with a higher confidence assessment rating for past performance will have a higher expectation of meeting the solicitation requirements than a firm with a lower confidence assessment rating. The Government’s subjective evaluation of the overall quality of an offeror’s submitted PPI will be a factor in determining the relative merits of the offeror’s proposal and in selecting for award the offeror whose proposal is considered the best value to the Government based upon the importance of the evaluation factors identified elsewhere in this solicitation.

(2) In investigating an offeror’s past performance, the Government may consider information in the offeror’s proposal and information obtained from other sources, including past and present customers and their employees, other government agencies, including state and local agencies, consumer protection organizations and better business bureaus; former subcontractors; and others who may have useful information.

(3) Evaluation of past performance will be a subjective assessment based on a consideration of all relevant facts and circumstances. It will not be based on absolute standards of acceptable performance. This is a matter of judgement.

Offerors will be given an opportunity to address especially unfavorable reports of past performance, and the offeror’s response, or lack thereof, will be taken into consideration.

(4) An offeror that has no identifiable record of performance of a same or similar nature to the current requirement may be considered by the Government to have no relevant past performance. In the case of an offeror without an identifiable record of past performance or for whom information on past performance is unavailable (this includes PPI identified by an offeror in their past performance proposal for which a corresponding PPI questionnaire was not received by the Government), the offeror may not be assessed either favorably or unfavorably on Performance Confidence, as the degree of confidence to the Government cannot be adequately determined and is therefore unknown.

The following questions were received in response to this solicitation:

Page 42 bottom indicate in the technical requirements to demonstrate commercial registration in Cameroon, Djibouti, and Niger.

RESPONSE

The language below has been amended to remove the requirement for Uganda and Egypt.

Evaluation of Technical (1)The Technical proposal will be evaluated with a rating of either Acceptable or Unacceptable. (1) All disposal facilities and transporters included in the Technical proposal will be evaluated for eligibility to be placed on the DLA QFL or QTL respectively. (2) All CLINs within the bid schedule must have a proposed disposal facility. (3) The offeror must have or demonstrate Commercial Registration or the ability to obtain via partner with Commercial Registration(s) in each countries technical operations are proposed: Cameroon, Djibouti and Niger.

(2)A rating of “Acceptable” will be given if:

i.all disposal or recycling facilities in the technical proposal are approved for placement on the QFL, and all

transporters are approved for placement on the QTL ii.All schedule CLINs have an approved disposal facility identified.

Iii The offeror has provided complete and acceptable Commercial Registration(s) documentation for the following countries: Cameroon Djibouti and Niger.

2.QUESTION

Page 44 Bottom (Volume III) require to demonstrate commercial registration to Uganda and Egypt (on top of Cameroon, Djibouti, and Niger.

RESPONSE

The language below has been amended to remove the requirement for Uganda and Egypt.

VOLUME III (Technical Proposal)

(i) Copies of the documents demonstrating Commercial Registration for the following locations: Cameroon, Djibouti and Niger.

3.QUESTION

Is a site visit in Djibouti before OCT 12 possible?

RESPONSE

A site visit is not possible at this time. However, photos have been attached to this amendment (Attachment 20 -- not to be incorporated in the resulting contract) to provide a visual representation of the Djibouti facility.

4.QUESTION

The solicitation for Africa Hazardous Waste Disposal says that, initially, only sites in Niger, Cameroon and Djibouti will be serviced under the contract, but that additional countries may be added later.

However, the proposal instructions say that registration documentation is required for these three countries plus Uganda and Egypt. Is this correct, or an error?

RESPONSE

The requirement for registration documentation for Uganda and Egypt has been removed from the solicitation.
