A. The purpose of this modification is to answer prospective offerors’ questions, to revise the bid schedule, and to extend the solicitation’s closing date and time.
B. Offerors’ questions with the Government’s answers follow:
1. QUESTION: We understand that sufficient container supply is part of the Contractor’s responsibility.
Prices for containers shall be included in the waste disposal and transport CLINS N0400 - N3510? Is this correct?
RESPONSE: Yes, it is correct that the prices for containers shall be included in the offered prices for waste disposal and transport CLINs N04000 through N35100.
2. QUESTION: CLINS N6700 - N6820 are only needed if the generator needs extra drums for his own demands?
RESPONSE: Yes, CLINs N67000 through N68360 for purchase of containers will only be ordered if the generator needs extra containers for his own needs.
3. QUESTION: It seems that the base Lakenheath has the possibility to give oil to other contractors, depending on the pricing situation of the oil market. Can you confirm and how many CLINS have an alternate contract in place?
RESPONSE: There will be only one DLA Disposition Services contract for hazardous waste turned in to the UK bases, which will be as a result of this solicitation. The generators may elect to recycle or dispose of materials (e.g., oil and batteries) through programs outside of DLA Disposition Services.
4. QUESTION: Lead acid battery < 1000 kg seem to be low too. The Bid Schedule gives an estimate of 550,000 kg in 18 months. The order analysis gives a total quantity of 160 t in 1 year. Can you confirm? Will there be an update of the CLIN Schedule?
RESPONSE: The estimated quantity of CLIN 04700 for lead acid batteries is changed from 55,854 KG to 145,150 KG (which is equivalent to 160 tons) for each contract period based on recent increases in disposal.
Attachment 1, Bid Schedule, is revised to reflect the new estimated quantities for CLIN 04700.
5. QUESTION: We note that Lakenheath and Mildenhall already have one member of staff at each site provided by Veolia to manage the day to day running of the waste storage areas. Please can you advise if these members of staff would have to be TUPE’d over as part of the contract and if so, please provide details on the following:
• Current pay scale
• Entitlement to commission, bonuses, allowances, overtime pay
• Sick leave entitlement and associated pay
• Holiday leave entitlement and associated pay
RESPONSE: It is the responsibility of the Offeror to comply with all applicable laws of the United Kingdom.
It is up to the Offeror, and not the U.S. Government, to determine whether the Transfer of Undertakings (Protection of Employment) Regulations 2006 (known as TUPE) applies to the workers currently at Lakenheath and Mildenhall. If the Offeror determines it is applicable, then the Offeror would have to coordinate with the employees or current contractor to obtain such details on pay and other entitlements.
6. QUESTION: What are the insurance requirements which would need to be put in place by the nominated contractor?
RESPONSE: Please refer to FAR Clause 52.228-03, WORKERS’ COMPENSATION INSURANCE (DEFENSE BASE ACT), regarding insurance requirements for workers’ compensation. All applicable host nation laws requiring

insurance of any kind shall be complied with.
7. QUESTION: Are there any expectations for money to be refunded which is recouped from the recycling of materials by the contractor?
RESPONSE: There are no direct refunds or offsets that will be refunded to the US Government, but the Offeror’s unit prices should reflect their expectations regarding any revenue stream that may be able to be obtained from the recycling of materials by the successful Offeror.
C. The revised version of Attachment 1, Bid Schedule, is attached. Offerors are required to submit a completed copy of the revised version of Attachment 1 with their offer.
D. The solicitation’s closing date and time is hereby extended until 10:00 AM local (Germany) time on 21 October 2016. All offers must be submitted no later than 10:00 AM local (Germany) time on 21 October 2016.
Offerors are also reminded to submit a signed copy of each solicitation amendment with their offer.
