I. Amendment 0001 is to answer the following questions:

1) With the current ban of incineration for PFAS related wastes, why are there Line Items on the solicitation for incineration of AFFF related wastes? (NR90-NR94.)

Answer: This contract is expected to last approximately five years. The guidance provided thus far indicates that the ban may be lifted during the life of the contract. The AFFF incineration CLINs are being offered so that if the ban is lifted the contract will be able to accommodate our customer’s needs.

2) The estimated quantity for NR05B5 seems excessive. With all the other CLINs available (totes, specific PFAS, etc.) is this estimate justified?

Answer: The estimate for CLIN NR05B5 comes from usage data gathered from the current contract over the course of about 30 months, and also using a 12-month snapshot of the contract (provided PR information). This is an IDIQ contract and the actual quantities of CLINs that will be ordered under this contact cannot be fully predicted. DLA-DS acknowledges that the follow-on contract allows the generators to take advantage of using other options such as tote suffixes and specific CLINs for AFFF wastes, however, these options have been available for sometime. Usage of these options on the follow-on contract may or may not have a significant impact on the use of the NR05B5.

3) Would it be possible to add a LP CLIN for wastes that do not have RCRA codes, but still have Proper Shipping Names and must be treated prior to landfill? It would be helpful for LP04 to be reserved for non-hazardous lab packs/loose packs without a PSN.

Answer: Base CLIN LP04 is currently used under 43 active U.S. contracts. All have essentially the same CLIN description shown in the table below. DLA is not aware of treatment/disposal complications when Generators turn-in wastes under the CLIN description as currently written. The CLIN description does not imply the waste is “landfill ready”, as it applies to both solids and liquids. The latter requires solidification or removal of free liquids prior to land disposal, if this is the disposal method chosen by the Contractor. As written, CLIN LP04 has worked successfully since its inception nearly 10 years ago. Offerors should understand that disposal CLINs offered under our HW disposal contracts are not based on DOT regulations. They’re predominantly based on RCRA regulated characteristics, specific and non-specific sources, constituents, physical state, and EPA Waste Codes, all of which are driving factors for the treatment and disposal of RCRA and Non-RCRA wastes. Changing the CLIN description at this point to exclude wastes carrying a DOT Proper Shipping Name (PSN) would be detrimental to hundreds of DOD Generators, as it would change a longstanding, fully engrained nationwide practice. In conclusion, at this time, CLIN LP04 will continue to be offered for use with lab packs and loose packs containing non-RCRA, state and non-state regulated wastes carrying no required EPA waste code(s), regardless of warranting or not warranting a DOT PSN.

4) Clause 3.35 references a specific service for Oceana for a 10 day expedite of removal of AFFF liquids, but there is not an applicable service CLIN for the contractor to perform this service. Will 1098SV be ordered when this occurs?

SP4500-22-R-0009

Answer: No, CLIN 1098SV will not be offered in conjunction with bulk removals from Oceana. The standard removal time for bulk waste is five business days. Section 3.35 requires removal in ten business days. The contractor is actually being given extra time to perform bulk removals from this location.

II. All other solicitation requirements remain unchanged.
