Questions/clarifications SP4500-14-R-0002:

Question 1) Can you please provide a PL detail report for Knox Campbell – 14R2?

Answer 1) Due to systems upgrades a PL report is not available. Attached is the BA report which is our best data at this time.

Question 2) Please confirm that the SCOPE of this Solicitation ONLY involves handling, transportation, and disposal of specified materials that include hazardous materials; and that there are NO environmental remediation activities addressed under this Solicitation.

Answer 2) None are scheduled at this time.

Question 3) Please also confirm that the only construction-related activities are on-site tank cleanings.

Answer 3) Correct.

Question 4) Bid sheet 6300-6351cc—do these line items include costs for personnel and equipment only? No T&D of wastes included in these line items?

Answer 4) CLINs 6350AA-6351CC shall include all required personnel, and mobilization of equipment. The appropriate disposal CLIN shall be ordered to pay for disposal/transportation.

Question 5) 6400—costs for personnel to travel to facility and obtain and ship samples?

Answer 5) The fully loaded unit price is to include personnel to travel to the facility to obtain and ship samples, as well as the analysis. Please refer to the PWS for requirements on analytical data.

Question 6) 6401-6424 costs for analysis only?

Answer 6) The fully loaded unit price is to include personnel to travel to the facility to obtain and ship samples, as well as the analysis. Please refer to the PWS for requirements on analytical data.

Question 7) Page 55—what types of locks are acceptable for the roll off storage container?

Answer 7) Locks with key are preferable over combination locks.

Question 8) Page 62-After award, can a transporter be approved for inclusion on the approved transporter list? How long does the approval process take?

Answer 8) Yes, a transporter be approved for inclusion on the approved transporter list. Approval may happen within 1-2 business days.

Question 9) Will there be any upgrades to the Qualified Facilities and Transporter lists before the March 3 bid date?

Answer 9) The QFL/QTL are updated as facilities and/or transporters are removed, and new facilities and/or transporters are approved. The updated QFL/QTL is typically published weekly on the DLA Disposition Services website.

Question 10) In Section 1.2.4 It explains that the Government shall furnish no equipment to the Contractor for their use except for loading equipment and scales. In Section 1.2.6 Loading it instructs us that we will be responsible for all equipment necessary for loading. Please clarify.

Answer 10) It is ultimately the responsibility of the contractor to provide everything necessary for loading. However, the sites identified in 1.2.6 indicated that they are to assist with tailgate loading of the items identified in the table in 1.2.6.

Question 11) Please clarify whether or not a Qualified Transporter must be on the Disposition Services Qualified Transporter List to pick up and deliver Non-RCRA, Non State and State Regulated items like sealed lab packs, compressed gas cylinders, Recycle/Recovery etc. to Qualified Disposal Facilities.

Answer 11) Yes, all transporters and facilities used on this contract must be on the QFL/QTL.

Question 12) Can a Qualified Facility use their own equipment and also function as a Qualified Transporter?

Answer 12) Yes, so long as the contractor provides us with the required paperwork to have them placed on the QTL.

Question 13) Page 2, pick up locations; there are 4 DLA Disposition sites listed with contacts. There appears to be 4 DLA service sites; Columbus, Wright-Patterson, Ft. Campbell and Knox. Is it presumed that all Task Orders (TO’s) will originate from these 4 locations with specific COTR’s issuing the orders?

Answer 13) Yes, each of the sites identified above have CORs that service that respective area. However, so long as the TO minimum is met, a TO may be issued that may require service from multiple sites.

Question 14) Are (TO’s) issued based on an “as needed” basis OR pre-determined service interval schedule, based on specific service needs, ie…30, 60, 90 day needs?

Answer 14) So long as the TO minimum is met, TOs may be ordered at any time. If the TO minimum is not met, an expedited service CLIN may need to be ordered.

Question 15) Is there a current order pattern on how often these sites need service that we can get? I would hope there is some LTL scheduling going on!

Answer 15) The ordering patterns vary and the task orders are based on the minimums, urgency, and the demand.

Question 16) Sec. 1.1.1: Permit/Special Requirements Besides permits and requirements to perform service within the 4 states, are there specific permits/requirements for certain sites? If so, is there a list specifying which ones, and what is required?

Answer 16) Expect that each site will have their own badging and permit requirements.

Question 17) Sec. 1.1.7 Rapid Gate Security How many DoD facilities require (NCAC) badges to gain access, and which ones are they?

Answer 17) Currently, Navy and Marine Corps stations require NCAC badges. Please refer to the list of pick up locations to identify any installations applicable to this solicitation.

Question 18) 1.2.4; Gov. Equipment What constitutes the use of a Govt. owned loading equipment, namely a tow motor, what is the exception? Which sites would the contractor be expected to use a Gov. owned tow motor to load?

Answer 18) Only government employees may use government-owned equipment. The sites/installations identified in 1.2.6 may use their own loading equipment to tailgate load, if they are available to do so. Government assistance is not promised at these locations. If a lift truck is required, the contractor should expect to use contractor-owned and contractor-operated equipment to perform on this contract.

Question 19) Sec. 1.3.1 Return of Shipping Doc.

What constitutes an “Audit Trail” that must be provided for all waste until final disposition is accomplished? For final offsite disposal from an approved TSDF, does each CLIN require its own “Audit Trail”?

Answer 19) Typically, the return of all manifests, including the disposal manifest(s), and submission of DLA form 2505 to DLA Disposition Services shall complete the audit trail.

Each line item on the manifest, and subsequently, each line item on each TO, shall have its own identifiable audit trail.

Question 20) Sec. 2.1.1 TSCA/RCRA/Non-RCRA items Will the awarded contractor have access to all waste stream profiles, analysis, and generator knowledge determinations by CLIN?

Answer 20) All generators must keep an up-to-date profile for each waste stream, and that information will be available to the contractor.

Question 21) Sec. 2.1.1 TSCA/RCRA/Non-RCRA items COD’s are only required when requested, it appears that you do not need to provide one for each and every stream!! CLIN 6503

Answer 21) Wastes requiring Certificates of Disposal/Destruction (CD) with every order will typically be identified in the bid schedule (examples: PCBs above TSCA regulatory limits, and items requiring demilitarization and subsequent proof thereof). However, the generator may order CLIN 6503 in conjunction with any disposal CLIN, not already requiring a CD, based upon his need.

Question 22) Sec. 3.2: Tank cleaning Is it understood under CLINs 6350AA-6351CC that this TO is for cleaning only, and that the Gov. is responsible for pumping the liquids out prior to cleaning?

Answer 22) The government would be responsible for pumping liquids from the tanks in the event that the contents were not sent for disposal. The applicable bulk liquid disposal CLIN(s) include the act of pumping. It is common practice for the generator to order bulk liquid disposal and the tank cleaning service on the same order.

Question 23) Sec. 3.2: Tank cleaning Would pumping the tank out be a separate CLIN, or should it happen at the same time as the cleaning TO? It is mentioned that any solids, sludges are also not part of these CLINs and that the Gov. will provide containers for this. Therefore, the solids contained during the cleaning process will remain on the Gov site for a future TO?

Answer 23) Please refer to the answer for #22 above. Solids and sludges will be disposed of using the appropriate disposal CLIN on the applicable TO.

Question 24) Sec. 3.4: Prepare Waste Profiles At the time of award, will the contractor be expected to profile each and every waste stream, or will we be provided current profiles, analysis, and necessary generators knowledge?

Answer 24) 3.4 outlines the contractor’s requirement when CLIN 6400AA is ordered by the generator. The COR will work with the contractor to ensure profiles are available.

Question 25) Sec. 3.4: Prepare Waste Profiles Will profile orders be for new waste streams, or updating analysis, or both?

Answer 25) Generators may order CLIN 6400AA, as referenced in 3.4, for the convenience of the generator. This may not be ordered for the convenience of the contractor. 6400AA may be ordered for either new waste streams, or updating old waste streams, or both.

Question 26) Sec. 3.4: Prepare Waste Profiles Will the awarded contractor have access to all profiles, all streams, for review?

Answer 26) Yes, prior to performance of each TO, the contractor will have access to the relevant profile(s). This is typically provided by the COR.

Question 27) Sec. 5.3; Additional TSDF’s and Transporters An approved TSDF on the QFL that waste is manifested to, and also utilizes downstream facilities for recycling and / or final disposition; are they required to ensure the downstream facilities are approved on the QFL?

Answer 27) Yes.

Question 28) CLINS: 6350AA through 6351CC Tank Cleaning services What are the wastes or products stored in these tanks?

Answer 28) Contents vary, but are often petroleum based.

Question 29) CLINS: 6350AA through 6351CC Tank Cleaning services Are they considered hazardous or non-hazardous wastes typically?

Answer 29) Contents could be either hazardous or non-hazardous.

Question 30) Are we to assume that transportation costs are to be factored into the appropriate CLINs for both containerized waste and bulk pickups? If so, it is necessary to know how TO’s are delivered as to pre-determined schedules or “as needed” basis.

Answer 30) Fully loaded transportation costs are included with the unit pricing. Task orders are executed on a as needed basis and have a minimum dollar threshold on the routine actions.

** Updated Reverse Auction clause dated Oct 2013.

52.215-9023 Reverse Auction.

As prescribed in 15.408-90(d)(1), use the following provision.

REVERSE AUCTION (OCT 2013)

The Contracting Officer may utilize on-line reverse auctioning as a means of conducting price discussions under this solicitation. If the Contracting Officer does not conduct a reverse auction, award may be made on the basis of initial offers or following discussions not using reverse auctioning as a pricing technique. If the Contracting Officer decides to use on-line reverse auctioning to conduct price negotiations, the Contracting Officer will notify Offerors of this decision and the following provisions will apply:

(a) The award decision will be made in accordance with the evaluation factors as set forth in the solicitation. The reverse on-line auction will be used as a pricing technique during discussions to establish the final offered prices from each Offeror. These prices will be used in conjunction with the evaluation factors stated elsewhere in the solicitation in order to make the award decision in accordance with the basis for award stated in the solicitation.

(b) Following the decision to conduct discussions using reverse auctioning as a pricing technique, the Contracting Officer or his/her representative will provide Offerors determined to be in the competitive range with information concerning the auction process.

(c) Prior to conducting the reverse auction, the Contracting Officer may hold discussions with the Offerors concerning matters appropriate for discussion, such as issues involving technical proposals or unbalanced pricing.

(d) Unless auction instructions indicate that only Offeror’s rankings will be displayed, the lowest Offeror’s price(s) for each round of the reverse auction will be disclosed to other Offerors and anyone else having authorized access to the auction. This disclosure is anonymous, meaning that each Offeror’s identity will be concealed from other Offerors (although it will be known to the Government; only a generic identifier will be used for each Offeror’s proposed pricing, such as “Offeror A” or “lowest-priced Offeror”). By submitting a proposal in response to the solicitation, Offerors agree to participate in the reverse auction and that their prices may be disclosed, including to other Offerors, during the reverse auction.

(e) An Offeror’s final auction price at the close of the reverse auction will be considered its final price proposal revision. No price revisions will be accepted after the close of the reverse auction, unless the Contracting Officer decides that further discussions are needed and final price proposal revisions are again requested in accordance with Federal Acquisition Regulation (FAR) 15.307, or the Contracting Officer determines that it would be in the best interest of the Government to re-open the auction.

(f) The following requirements apply when the Government uses a commercial web-based product to conduct the reverse auction:

(1) Each Offeror identified by the Contracting Officer as a participant in the reverse auction will be contacted by Defense Logistic Agency’s commercial reverse auction service provider to advise the Offeror of the event and to provide an explanation of the process.

(2) In order for an Offeror to participate in the reverse auction, such Offeror must agree with terms and conditions of the entire solicitation, including this provision, and agree to the commercial reverse auction service provider’s terms and conditions for using its service. Information concerning the reverse auction process and the commercial service provider’s terms and conditions is embedded within the email notification sent by the on-line reverse auction pricing tool system administrator.

(3) Offerors shall secure the passwords and other confidential materials provided by the commercial reverse auction service provider or the Government and ensure they are used only for purposes of participation in the reverse auction. Offerors shall keep their own and other Offeror’s pricing in confidence until after contract award.

(4) The reverse auction system currently in use designates offers as "Lead," meaning the current low price in that auction, or "Not Lead," meaning not the current low price in that auction. In the event of a tie offer, the reverse auction provider's system designates the first offer of that price as "Lead" and the second or subsequent offer of that price as "Not Lead." Offerors shall not submit a tie offer, since this is inconsistent with the purpose of the reverse auction. If a tie offer is submitted and no evaluation factors other than price were identified in the solicitation, the "Not Lead” Offeror that submitted the tie offer must offer a changed price; otherwise its offer will be ineligible for award if their final price in the auction is the tie offer price. If evaluation factors in addition to price were listed in the solicitation, tie offers that are "Not Lead" will be considered and evaluated in accordance with those evaluation factors.

(5) Any Offerors unable to enter pricing through the commercial reverse auction service provider’s system during a reverse auction must notify the Contracting Officer or designated representative immediately. The Contracting Officer may, at his/her sole discretion, extend or re-open the reverse auction if the reason for the Offeror’s inability to enter pricing is determined to be without fault on the part of the Offeror and outside the Offeror’s control.

(6) The reverse auction will be conducted using the commercial reverse auction service provider’s website as embedded in the email notification. Offerors shall be responsible for providing their own computer and internet connection.

(7) Training:

(i) The commercial reverse auction service provider and/or a Government representative will provide familiarization training to Offerors’ employees; this training may be provided through written material, the commercial reverse auction service provider’s website, and/or other means.

(ii) An employee of an Offeror who successfully completes the training shall be designated as a “Trained Offeror.” Only Trained Offerors may participate in a reverse auction. The Contracting Officer reserves the right to request that Offerors provide an alternate Offeror employee to become a Trained Offeror. The Contracting Officer also reserves the right to take away the Trained Offeror’s designation from any Trained Offeror who fails to abide by the solicitation’s or commercial reverse auction service provider’s terms and conditions.

(End of provision)
