The following questions and answers are hereby included into SP330026Q0010:
1. Does the government desire offerors to be an authorized service provider of the OEM and to provide proof of such authorization at the time of proposal submission?
No. All requirements can be found in FAR 52.212-1 Instructions to Offerors of the solicitation and the attachment titled Amendment 0001. The CSS and Amendment 0001 detail the requirements of the technical quote, past performance, and price. In regards to the technical quote, the quoter must provide valid a CMAA-78 Certification that establishes proof of their ability to perform Shuttlelift Gantry Crane Maintenance services and a certificate of insurance for rental purposes.
2. Does the government desire offerors to manage and implement an Oil Analysis Program?
No.
3. Does the government desire offerors to provide an Oil Analysis Program Certification at the time of proposal submission?
No.
4. Does the government desire offerors to possess OSHA 10 and OSHA 30 Certifications and to provide such certifications at the time of proposal submission?
No. All certifications and requirements are included in FAR 52.212-1 Instructions to Offerors of the solicitation and the attachment titled Amendment 0001. The PWS also contains some language regarding OSHA, but not the requirement to possess OSHA 10 and OSHA 30 certifications.
5. Does the government desire offerors to possess OSHA Manlift and Forklift certifications and to provide such certifications at the time of proposal submission?
No. However, per the PWS, the Contractor shall require their personnel to wear personal protection equipment (PPE) (i.e., safety shoes or safety boots, hearing protection, eye protection, gloves, safety harnesses) when required during the performance of this contract in accordance with Occupational Safety and Health Administration (OSHA) standards.
In accordance with OSHA standards, two contractor personnel shall be present when maintenance services require work to be performed above ground level or on energized equipment.
6. Does the government desire offerors to possess current NAVFAC P-307 Certifications for Category 1 Cranes and to provide such certifications at the time of proposal submission?
No. All certifications and requirements are included in FAR 52.212-1 Instructions to Offerors of the solicitation and the attachment titled Amendment 0001.
7. Does the government desire offerors to possess ASE Master Medium/Heavy Truck Technician certifications and to provide certifications at the time of proposal submission?
No. All certifications and requirements are included in FAR 52.212-1 Instructions to Offerors of the solicitation and the attachment titled Amendment 0001.
8. Does the government desire offerors to possess ASE Refrigerant Recovery and Recycling Certifications and to provide certifications at the time of proposal submission?
No. All certifications and requirements are included in FAR 52.212-1 Instructions to Offerors of the solicitation and the attachment titled Amendment 0001.
9. Does the government desire offerors to employ NCCCO Operators and to provide certifications at the time of proposal submission?
No. All certifications and requirements are included in FAR 52.212-1 Instructions to Offerors of the solicitation and the attachment titled Amendment 0001.
10. Does the government desire offerors to employ NDT Level II Inspectors and to provide certifications at the time of proposal submission?
No. All certifications and requirements are included in FAR 52.212-1 Instructions to Offerors of the solicitation and the attachment titled Amendment 0001.
11. CLINS ending in 01 for Preventative Maintenance show a quantity of "6" per year. Please confirm the quantity of 6, which suggests 6 Preventative Maintenance visits per year, is correct.
Correct, preventative maintenance will be conducted on a bimonthly basis.
12. Because the solicitation includes DFARS 252.204-7012 and the PWS is marked CUI, DFARS 252.204-7019 is required by DFARS rule language. 7019 must appear in the solicitation so the Government can confirm that each offeror has a current NIST SP 800-171 assessment score in SPRS prior to award, as mandated by DFARS Subpart 204.73.
13. DFARS 252.204-7020 is required whenever 252.204-7012 is included. Please add DFARS 252.204-7020.
Response to questions 12 and 13: The CUI markings will be removed from the PWS. DFARS 252.204-7019 and DFARS 252.204-7020 will not be included in the solicitation per DLAD PGI 4.7303-2.
DLAD PGI 4.7303-2 Verification and Documentation of Contractor NIST Assessment Score.
(c) In accordance with DFARS 204.7303(b), the contracting officer shall verify that a contractor has a current (i.e., not more than 3 years old, unless a lesser time is specified in the solicitation) NIST SP 800171 assessment score posted in the Supplier Performance Risk System (SPRS) prior to awarding a contract, task order, or delivery order, and when exercising an option, or extending the period of performance on a contract, task order, or delivery order.
(1) Exceptions to the requirements in DFARS 204.7303(b) include the following:
(i) Commercial Off The Shelf (COTS) items only;
(ii) The total acquisition value is at or below the current micro-purchase threshold; or
(iii) The solicitation does not contain Covered Defense Information (CDI) or Controlled Unclassified Information (CUI). CDI/CUI is identified in DLA solicitations from the inclusion of Standard Text Objects (STOs) RD002 Covered Defense Information Applies, or RD002 and RQ032 Export Control of Technical Data in the technical data package. STO RD003 "Covered Defense Information May Apply" is included when the contract, task order, or delivery order does not contain CDI/CUI at the time of award; yet may has the potential to generate such information during contract performance.
14. Because the PWS is designated CUI and DFARS 252.204-7012 is included, DFARS 252.204-7021 is required to establish the contract’s CMMC Level 2 obligation. Including 7021 ensures that all offerors are held to the same minimum cybersecurity standard required by DoD for the protection of CUI.
The CUI markings will be removed from the PWS. DFARS 252.204-7021 will not be added to the solicitation per DFARS 204.7504(a)(1), as the program office or requiring activity determined that the contractor is not required to have a specific CMMC level.
15. Please confirm that FAR Clause 52.219-14, Limitations on Subcontracting, requires at least 50% of all services to be performed by a small business, as defined by the SBA for NAICS 811310.
Yes, this is correct.
16. Please confirm that past performance provided should be that of the offeror and not from a potential subcontractor.
That is not correct. The solicitation permits the submission of past performance from a proposed subcontractor. The solicitation explicitly contemplates the inclusion of subcontractors in the past performance evaluation, as stated in paragraph (iii): 'If an Offeror or its subcontractor determines they have no past performance data...' The Government's primary objective is to gain confidence that the proposed team, as a whole, can successfully perform the work described in the Performance Work Statement (PWS). The evaluation will consider the experience of the entity that will actually be performing the critical aspects of the requirement.
Therefore, if an Offeror's proposal relies on the experience of a major subcontractor to meet the requirements— specifically for the corrective maintenance and diagnosis of rubber-tired gantry cranes—the proposal should:
-Clearly identify the subcontractor and their specific role in performing the work.
-Submit the past performance references (using Attachment 4) for that subcontractor.
-Ensure the subcontractor's past performance is recent and relevant to the work they are proposed to accomplish, as required by the solicitation.
17. Will there be any Metals NDT/inspection or Special Inspections needed on this project?
No.
18. We would like to confirm whether this solicitation includes any DFARS cybersecurity requirements and, if so, whether CMMC Level 1 or CMMC Level 2 compliance is required for this procurement.
No.
Additionally, the following updates are made to SP330026Q0010:
- TE 1.1 Contractor Personnel Security is added as "Attachment 10 - TE 1.1 Contractor Personnel Security".
- TE 1.2 CAC Procedures is added as "Attachment 11 - TE 1.2 CAC Procedures".
