1. General: While performing work at Defense Distribution Depot San Joaquin the contractor shall comply with all Federal, State and Local environmental protection laws and regulations, the controls of this document, and all specific requirements stated elsewhere in contract specifications. Local entities which may have jurisdiction over contractor activities include: San Joaquin County, Central Valley Regional Water Quality

Control Board (RWQCB) and San Joaquin Valley Unified Air Pollution Control District (SJVUAPCD).

2. Environmental Permits: All permits must be obtained from the appropriate agency and paid for by the contractor. Some examples include, but are not limited to:

a. Installation and/or removal of underground storage tanks prior to the start of work.

b. Well drilling prior to the start of work.

c. Air emissions such as Volatile Organic Compounds (VOCs) and National Emission Standards for

Hazardous Air Pollutants (NESHAPS) prior to the start of work

d. Demolition (Asbestos or Non-asbestos) 10 days prior to the start of work.

e. Renovations (Asbestos only) 10 days prior to the start of work.

f. General construction storm water permit prior to the start of work (coordinated through the DLA San

Joaquin Environmental Office).

g. Authority to Construct/Permit to Operate air pollution source from SJVUAPCD

3. Sanitary/Storm Drainage Restrictions: Absolutely no materials are to be disposed of via the sanitary sewage or storm drain systems. Non-hazardous floor cleaning water may be disposed into the sanitary sewer system and is prohibited from being dumped into the storm drain system. A rule of thumb is “If you won’t drink it, it doesn’t belong in the storm system.

4. Backflow Prevention: Backflow is required prior to any connection to the water system. Authorization is obtained through the DDJC Fire Department. Contractors must provide their own backflow prevention device.

5. Discovery of Asbestos Containing Materials (ACM): If the contractor discovers ACM in a Depot facility during the performance of the contract, work in the area of the ACM shall be immediately cease and the

COR shall be notified.

6. Hazardous Waste Generation and Disposal: All handling and disposal of hazardous waste (as defined by Title 22, Chapter 11, California Code of Regulations) is a material and significant requirement of this contract. Hazardous waste generated in performance of a contract shall be the property of the contractor and shall be removed as part of the contract effort. All costs associated with its accumulation, storage, transportation, treatment and disposal are the responsibility of the contractor. The contractor shall properly accumulate, package, label, store, transport and dispose of all hazardous waste in accordance with all applicable

Federal, State and Local regulations and the terms of the contract. The contractor is responsible of ensuring all subcontractors who provide transportation, treatment, storage or disposal services possess the ability to satisfactorily perform in accordance with applicable Federal, State and Local regulations. On-site disposal of hazardous waste, including empty containers that previously contained hazardous materials, is strictly prohibited. Hazardous waste must be disposed of in a DRMS qualified facility. Qualified facilities may be found at:

In addition, the contractor shall:

a. Notify the COR of the type, quantity and location of the hazardous waste to be accumulated.

b. Provide advance copies of the completed hazardous waste profile (supported by analysis), land disposal restriction/certification form, and the uniform hazardous waste manifest to the COR for review by the

Environmental Protection Office at least 24 hours prior to shipment of a hazardous waste off-site.

c. Arrange with the COR for the Environmental Office to perform a transportation inspection and certify/sign the uniform hazardous waste manifest at the time of shipment.

d. Agree that any contract shall not be considered complete until all hazardous waste has been disposed of in accordance with Federal, State and Local laws and regulations and the terms the contract.

7. Dust Control/PM10: Airborne particulates, including dust particles, from construction activities and processing and preparation of materials shall be controlled at all times, including weekends, holidays, and hours when work is not in progress. The contractor shall maintain all excavations, stockpiles, haul roads, permanent and temporary access roads, plant sites, disposal sites, borrow areas, and all other work areas free from airborne dust which would cause a hazard or nuisance. Water may be withdrawn from existing tank truck pipe risers.

Water may not be withdrawn from fire hydrants without a prior written permit from the DDJC Fire Department.

8. Spill Notification: Any spills or releases of hazardous material or waste resulting from the contractors performance shall be reported immediately to Central Dispatch by calling *911 (on facility phones) for both

Sharpe and Tracy sites. For reporting spills using an outside phone line (cell phones etc) the emergency number is (209) 839-4302. The contractor is responsible for all cleanup costs. The Contracting Officer may require the contractor to arrange for cleanup action by qualified contractor personnel of subcontractors. Cleanup must be to the satisfaction of the DDJC Environmental Protection Office and meet Federal, State and Local requirements.

9. Project Storage of Hazardous Materials: The contractor shall notify the COR prior to the on-site storage of any hazardous material (as defined by Title 49, Section 171.8 of the Code of Federal Regulations).

Notification shall include the quantity, location and a copy of the Material Safety Data Sheet (MSDS).

10. Refuse Disposal: The use of government dumpsters for disposal of contractor generated non-hazardous waste and refuse (i.e. wood, plastic, etc.) is prohibited. The contractor shall provide containers for disposal of non-hazardous waste and refuse generated as a result of the performance of work.

11. Archaeological Findings During Construction: There are no known archaeological remains noted at the Sharpe and Tracy Sites at this time. Should any skeletons, artifacts or other archaeological remains be uncovered, the contractor shall immediately stop work and contact the Contracting Officer’s Representative

(COR) for further instructions.

12. Discovery of Unidentified Materials or Objects: The Sharpe and Tracy Sites have been active military support bases since World War II. Thus, the potential exists for the discovery of hazardous materials, such as explosives, chemical (gas) weapons and toxic contaminants, during excavation and demolition operations. The following procedure is applicable:

a. Any suspect material found during construction activities shall be assumed hazardous. Excavated soils with unusual appearance or odor shall be considered suspect.

b. Site workers shall immediately secure in a safe condition any equipment being operated and leave the area of the material or object. Do not approach, examine or move the material or object.

c. The discovery shall be reported immediately to the Depot Fire Department by calling *911 for both the

Sharpe and Tracy sites. Outside phone line emergency number is (209) 839-4302.

13. Environmental Management System (EMS): Contractors are to adhere to the EMS policy.

Responsible for owning their actions and performing them in an environmentally acceptable manner. Preventing pollution and complying with all applicable environmental policies, and legal regulations at Defense

Distribution Depot San Joaquin. See attached copy.
