Large Business quoters will provide substantiating documentation to demonstrate the above requirements. The Small Business Subcontracting Plan will become part of the resultant contract.
Volume II. Technical Capability and Past Performance:
Technical Capability
Vendors must provide documentation demonstrating compliance with cybersecurity requirements defined in the Performance Work Statement.
Documentation including but not limited to certificates demonstrating compliance with the required DoD 8140 Work Role 451 must be provided for all individuals designated by the Quoter (Technicians / Administrators) performing any service under the resulting award.
Submission of a quote that does not contain all items requested in the Performance Work Statement regarding cybersecurity may result in elimination from consideration for award. Instructions contained herein are to serve as a guide in preparation of quotes; however, they are not intended to be all inclusive. The instructions generally describe the type and extent of information, which should be provided in the quote. The quoter is expected to completely examine and analyze all aspects of the technical/business, past performance, and price areas to be addressed, and to include information in the quote, which will enable the evaluators to determine the quoter’s understanding of the requirements.
Past Performance
The Quoter shall describe their background, knowledge and experience related to performing maintenance support services (i.e., preventive & remedial maintenance) on the Lenel Electronic Security System, Pelco Closed Circuit Television System and network switches. Of particular emphasis is performance that was executed in accordance with the same or similar scope and magnitude that is described in the PWS. Past performance information is used in determining the level of confidence the Government has for successful performance based upon the Quoter’s actions under previously awarded, relevant contracts.
The Government shall only consider relevant past performance data. To be considered relevant, the Quoter must demonstrate past execution of similar contracts in terms of scope, complexity, technology, magnitude of effort, and schedule. The Quoter must demonstrate through past performance an ability to perform the work described in the solicitation. This is done by demonstrating that they have successfully executed contracts of similar scope and magnitude within the past five (5) years. (The Government recommends submission of at least three contracts but will evaluate any and all submitted). Quoters shall provide a detailed explanation of the relevance of the contracts or efforts to the requirements as defined in the PWS. If subcontractor experience is provided as part of the most relevant contracts provided, it will be given weight relative to the percentage of effort being provided by that particular subcontractor in the offer submitted. The references will be evaluated in the aggregate in order to allow Quoters who may not have the entire scope, magnitude, and complexity of the requirement under one individual contract to still be considered relevant if experience with the full scope, magnitude, and complexity of the requirement can be demonstrated within the allotted number of references as described above.
If a Quoter or its subcontractor determines they have no past performance data, they shall provide the following statement in lieu of the information requested below: “(Insert Quoter or subcontractor’s name) has determined that they possess no past performance information in accordance with the solicitation.”
To be compliant with this factor Quoters shall provide the following information for both the Quoter and proposed subcontractors.
(1) An index of previous contract data for the Quoter. The index shall contain three or more PRIME contracts and SUBCONTRACTS that the Quoter is currently performing or has completed during the last five (5) years. The index shall include:
- Contractor Name
- Name of the customer/agency
- Contract/Purchase Order Number
- Customer points of contact (minimum of two, provide name, telephone number, fax number, and e-mail addresses)
- Length of contract
- Period of performance (dates)
- Initial Contract Price
- Final Contract Price or price as of the last modification
- Description of product/service provided (include sufficient detail to demonstrate the scope and complexity of the product/service provided)
- Discussion of the similarities and differences of experience (include sufficient detail to demonstrate similarities/dissimilarities to the requirements of this solicitation)
- Facilities in which the product/service was performed
- Quality of Past Performance; to include a discussion of actual performance under each contract listed, including problems encountered; how they were resolved; the timeliness of deliverables required; how costs were controlled; business relationships; management of personnel, and any other areas deemed necessary to provide insight into actual performance issues.
(2) A narrative synopsis that shall describe the specific nature of the work, similarities with the proposed work and the relevant experience gained. The narrative portion shall also indicate any occurrence of cost growth and/or schedule delays encountered. The appearance of cost growths and/or schedule delays on past contracts must be explained.
(3) An index of Previous Contract Data for all subcontractors containing the information listed in paragraph (1) above as it relates to PRIME and SUBCONTRACTS that the subcontractor is currently performing or has completed during the last five (5) years.
(4) Completion of the Past Performance Questionnaire attached to this solicitation. Quoters and all subcontractors shall send this questionnaire to previous customers of prime and subcontracts. All questionnaires shall be submitted to the Government by the quote due date and time identified in the solicitation. All previous contracts the Quoter utilizes for Questionnaire information must be contained in the Previous Contract Data index for the Quoter/subcontractor. The Quoter/subcontractor shall complete the Previous Contract Data index prior to submitting the questionnaire to the customer. The Quoter/subcontractor shall ask the customer to complete the questionnaire and return it directly to the Contract Specialist identified in the solicitation. Government evaluation members may contact the named individuals to clarify, obtain additional information, or conduct a telephone survey of past performance. As such, the Quoter/subcontractor shall provide a list of all Questionnaires submitted that provides the following information:
- Name of the customer/agency
- Date submitted to customer/agency
- Contract/Purchase Order Number
- Customer points of contact (minimum of two, provide name, telephone number, fax number, and e-mail addresses)
- Whether the Quoter/subcontractor was a Prime or Subcontractor
(5) Quoters and their subcontractors may describe any quality awards or certifications that indicate technical excellence in the service requested. Indicate what segment of the company (division or entire company) received the award or certification and the date. If the award or certification is over three years old, present evidence the qualifications still apply.
The Government may utilize the Federal Past Performance Information Retrieval System (PPIRS), the Contractor Performance Assessment Reporting System (CPARS), responses received from the Performance Risk Assessment Questionnaire, data submitted by the Quoter, and any other information available to determine the quality and relevance of the Quoter’s past performance.
Volume III. Subcontracting / Small Business Approach
Volume III of the quote will be utilized to evaluate the Small Business Participation.
Though the Small Business Participation Commitment Document (SBPCD) below is NOT the same as the Small Business Subcontracting Plan, the quoter’s SBPCD should complement the quoter’s Small Business Subcontracting Plan, if the quoter is required to submit a plan. For example, planned small business subcontracting dollars of the Small Business Subcontracting Plan should be the same as the extent of utilization quantitatively in the SBPCD. However, the subcontracting percentages will be different since the SBPCD quote will be based on the proposed total contract value and the Small Business Subcontracting Plan is based on planned subcontracted dollars. The type of effort to be subcontracted as stated in the Small Business Subcontracting Plan will be the same as that stated in the type described in the SBPCD. It is important that the provisions of the Small Business Subcontracting Plan that coincide with the contents of the SBPCD are consistent.
The SBPCD will require periodic progress reporting to facilitate Government monitoring in the event of an award in accordance with CDRL A001, Small Business Participation Biannual Progress Report. The Small Business Participation Commitment Document will become part of the resulting contract and will be utilized in the calculation of liquidated damages in accordance with FAR 52.219-16 – Liquidated Damages – Subcontracting Plan and/or in determining consideration in accordance with the solicitation.
SMALL BUSINESS PARTICIPATION COMMITMENT DOCUMENT (SBPCD)
All quoters (both other than small businesses and small businesses) will provide the following SBPCD requirements. This required information will be used to evaluate the extent of the quoter’s proposed participation/commitment to use U.S. small businesses in the performance of this acquisition (as small business prime Quoter’s or small business subcontractors) relative to the evaluation criteria contained in the solicitation, Small Business Participation Commitment Document (SBPCD).
1. Prime Quoter’s Size: Identify the applicable size and applicable socioeconomic categories for the PRIME offeror only when submitting your proposed SBPCD. Include this information within the initial section of the proposed SBPCD and check all applicable boxes:
Prime Quoter’s Size { } Other than Small Business or { } Small Business also categorized as a { } Small Disadvantaged Business (SDB) { } Woman-Owned Small Business (WOSB) { } Historically Underutilized Business Zone (HUBZone) Small Business { } Service Disabled Veteran Owned Small Business (SDVOSB)
2. The small business concerns (SBC), as defined in FAR Part 19, used in the quoter’s proposed approach to satisfying the requirements of this solicitation for the entire performance period must be identified.
The quoter must provide the following information about each entity: company name, Cage Code, business category(ies), description of products or services and NAICS code to be provided by each SBC. The nature of the commitment with the SBC should be identified. Use the table/format below in proposing this required information to provide the required information.
| Company Name |
| Cage Code (to the extent they are known) |
| Small Business Category(ies) |
(SB, WOSB,SDB, Hubzone, VOSB, SDVOSB)
| Product(s)/Service(s) to be Provided, including type & variety of work |
| *NAICS Code |
| Nature of Commitment |
*NOTE: The NAICS code/size standard for this requirement is stated elsewhere in the solicitation and should be considered in making any business size determinations for any company that will contribute to contract performance.
*NOTE: The work to be performed directly by a small business prime quoter will be evaluated as Small Business Participation. Small business prime quoters must include their company information in the above table.
3. In addition to completing the table above, the quoter must provide supporting documentation of the nature of the commitment. Examples of verification include a letter of commitment, joint venture documentation, mentor protégé agreements, or a subcontracting agreement.
FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) Quotes will be evaluated in accordance with FAR 13.106-2. The Government intends to award one purchase order on an all-or-none basis to the responsible quoter who: 1) quote complies with the terms and conditions of this solicitation, complies with laws and regulations ; and 2) offers the total overall lowest price for all contract line items.
Quoter’s must be determined to be responsible according to the standards of FAR Part 9 to be eligible for award. As part of this evaluation the Government reserves the right to review any sources or people the Government determines reliable including those sources which relate to past performance.
Although the Government intends to award a purchase order as a result of this solicitation, the Government reserves the right to reject any and all quotes received and not award any item or items from this solicitation.
Technical Requirements
To be technically acceptable, the quote must: Technical capability shall be established by submittal of information that clearly demonstrates that the quoter possesses the necessary qualifications to perform the work required by the solicitation and PWS.
The quote will be evaluated to determine if the quoter’s proposed contractor personnel certifications demonstrate that they are currently certified by Lenel at a Lenel Certified Professional (LCP) level or higher.
The quote will be evaluated to determine if the quoter’s proposed contractor personnel documentation demonstrate that they are currently certified in accordance with the Performance Work Statement and referenced requirements.
Past Performance Requirements
The Government will evaluate the quoter’s Past Performance to determine acceptability of the quote in response to this solicitation. Past Performance will be evaluated on an acceptable/unacceptable basis and shall not be rated. The quoter will be evaluated on their past performance records and any other relevant information obtained from Government databases (CPARS and SPRS) and Attachment 08 Past Performance Questionnaire.
Each quote will be evaluated to the extent to which the Quoter has demonstrated an ability and willingness to perform:
A quality product or service (i.e., the conformance to contract requirements, specifications, and standards of good workmanship);
Timeliness of the contract with regard to completion of contract, task orders, milestones, delivery schedules and administrative requirements (e.g., effort that contributes to or affects the schedule variance);
Acceptable cost control with regard to the Quoter’s effectiveness in forecasting, managing, and controlling contract cost;
Good business relationships with regard to the timeliness, completeness and quality of problem identification and resolution, Quoter’s history of reasonable and cooperative behavior, customer satisfaction, timely award and management of subcontracts, and whether the contractor met their small/small disadvantaged and women owned business participation goals; and 5) Management of personnel with regard to demonstration of a commitment to the management of personnel with regard to the Quoter’s performance in selecting, retaining, supporting, and replacing when necessary, personnel.
To be considered relevant, the Quoter must demonstrate past execution of similar contracts in terms of complexity, technology, magnitude of effort, schedule, and scope. Additionally, the performance must have occurred during the last five (5) years. Quoters shall be evaluated on an Acceptable/Unacceptable basis. In the case of a Quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Quoter may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv), Past Performance Evaluation). Therefore, the Quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
Subcontracting / Small Business Approach
All quoters (both other than small businesses and small businesses) will be evaluated on the extent of proposed participation/commitment to use U.S. small businesses in the performance of this acquisition (as small business prime quoters or small business subcontractors) relative to the objectives and requirements established herein.
The Government will evaluate the following to determine if the quoter met or exceeded the requirements.
| 1. | The extent to which firms as defined in FAR Part 19, are specifically identified in quotes. |
| 2. | The extent to which quoters demonstrate substantive commitment to small business firms, such as, letters of commitment, Joint Ventures, mentor/protégé agreements, or other demonstrations of commitment. |
| 3. | Identification of the type and variety of the work small firms are to perform. |
| 4. | The realism of the proposed utilization of small business (methods quoter intends to use to meet proposed goals). |
The representations and certifications in the System for Award Management (SAM) may be used to determine whether a potential subcontractor is small or large or has other socioeconomic designations. The SBA Dynamic Small Business Search also may be utilized for the purpose of determining a potential subcontractor’s size standard. If there is no SAM and/or SBA Dynamic Small Business Search record for a proposed subcontractor, that company may be evaluated as a large business concern. The NAICS code/size standard for this requirement is stated elsewhere in the solicitation and should be considered in making any business size determinations for all subcontractors.
Price
The proposed total price (the sum of the total amount for all CLINS) between quotes that are determined to be technically acceptable will be the determining factor in the selection of a quote for award. Price analysis shall not be conducted on quotes or quoters determined to be unacceptable for award. Government will perform a price analysis to determine the reasonableness of proposed price in accordance with FAR 15.404-1(b). The Government will utilize a comparison of proposed prices received in response to the solicitation.
Award will be based on the overall lowest priced quote that meets or exceeds the acceptability standards for the non-cost factors. The Government may determine that an quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision)
