Addenda FAR 52.212-2 -- Evaluation -- Commercial Items (Oct 2014)
The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following shall be used to evaluate offers: Quotes received will be evaluated in accordance with FAR 13.106-2. The Government intends to award one (1) Firm-Fixed Price (FFP) contract resulting from this notice on an all or none basis to the responsible Offeror who offers the lowest total evaluated price for the supplies. In addition, data available in the statistical reporting module of the
Supplier Performance Risk System (SPRS) regarding the supplier’s past performance history for the
Federal supply class (FSC) of the supplies being purchased will be considered. In the case of a supplier without a record of relevant past performance history in SPRS for the FSC or PSC of the supplies being purchased, the supplier will not be evaluated favorably or unfavorably for its past performance history. In the context of acceptability/unacceptability, “unknown” shall be considered acceptable.
The Government evaluates past performance information as a predictor of future contract performance.
The Government will determine whether the Offeror’s past performance is acceptable or unacceptable based on the demonstrated record of recent and relevant performance.
It is the responsibility of the Offeror to provide complete past performance information and thorough explanations as required by Quote Submission Instructions. The Government may use any of the following information as it evaluates an Offeror’s past performance:
Past performance information obtained from any sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), the Contractor Performance Assessment Reporting System
(CPARS), and any other information available to determine the quality and relevance of the Offeror’s past performance.
The Government reserves the right to consider any past performance after the solicitation closing date and prior to award.
The Government shall only consider recent and relevant past performance data. To be considered relevant, the Offeror must demonstrate past execution of similar contracts in terms of scope, complexity, technology, magnitude of effort, and schedule. For the purpose of this solicitation recent is defined as mailto:carl.devitz@dla.mil http://www.beta.sam.gov/ mailto:carl.devitz@dla.mil work performed in the last five (5) years. Relevant is defined as work involving the same or similar services.
The Government will review past performance information collected on all recent and relevant contracts within the last five (5) years to determine the quality of the Offeror’s performance. The Government will focus its review to the areas of 1) Quality of product or service, 2) Cost control, 3) Schedule/timeliness, 4)
Business relations, 5) Management of personnel, and 6) Utilization of Small Business. The Government may consider the, relevancy, source, context of the past performance information it evaluates, general trends in performance, and demonstrated corrective actions. An adverse finding in any element, a lack of relevant data in regards to a performance issue and its resolution, or a significant achievement can become an important consideration in the evaluation process. Should the Government discover adverse past performance information to which the Offeror had not had a prior opportunity to respond, the
Contracting Officer will conduct communications if deemed appropriate.
In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR
15.305 (a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered
“acceptable.”
The Government will rate Offeror’s Past Performance as follows:
Acceptable: Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.
Unacceptable: Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful
Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
