Solicitation: SP0600-17-R-0414
1. Notice: The Defense Logistics Agency (DLA) Energy, on behalf of Osan Air Base (AB), South Korea plans to award an energy savings performance contract (ESPC) Task Order (TO) using the Department of Energy (DOE) Super ESPC indefinite-delivery, indefinite-quantity (IDIQ) contracts.
DLA Energy invites the current 16 DOE Super ESPC IDIQ contract holders to submit a written response to this Notice of Opportunity (NOO) for DLA Energy’s consideration. Only those 16 DOE Super ESPC IDIQ contract holders are eligible for award.
2. Authority: DLA Energy’s authority is in accordance with 42 U.S.C. § 8287, the Federal Acquisition
Regulation (FAR) 23.205, Energy Savings Performance Contracts, Energy Policy Act of 1992 (EPAct), and DOE Final Rule, 10 CFR 436 Subpart B – Methods and Procedures for Energy Savings Performance Contracting and Energy Policy Act of 1992 (EPA, April 10, 1995).
3. Project Approach:
Osan AB desires to achieve the mandated energy goals in line with Executive Order (EO) 13693 with concentrated reduction in energy intensity and water consumption. Included in the project scope are 106 buildings encompassing 4,294,272 square feet. Attachment 1 provides a listing of available buildings to be included in the resultant project along with available data and energy consumption. The Government may consider further buildings at Osan AB during the project development phase, and include such buildings in any resultant project, upon the receipt of a good business case analysis that illustrates a benefit to the Government. The selected Energy Service Company (ESCO) shall be responsible for determining the actual utility consumption during the Preliminary Assessment (PA) and Investment Grade Audit (IGA) phases.
Osan AB is interested in a comprehensive audit and analysis to identify and examine opportunities to achieve maximum energy/water savings and renewable energy, generation, and resiliency, and facility and infrastructure improvements within the constraints of the ESPC vehicle and the DOE Super ESPC IDIQ contracts. Should the financial economics produce a viable project, Osan AB seeks to achieve facility energy intensity reductions for energy efficiency, improve water use efficiency, and to increase the amount of facility energy and thermal energy from renewable electric energy and alternative energy in line with EO 13693, 42 U.S.C. § 8287, and the DOE Super ESPC IDIQ contracts.
In achieving its energy and water conservation goals, Osan AB is interested in any ECM defined in Attachment J-3 of the DOE Super ESPC IDIQ with the exception of two technical categories:
TC.15 - Energy Cost Reduction through Rate Adjustments and TC.20 - Future ECMs. Under 10 CFR § 436.31, an energy conservation measure (ECM) must improve energy efficiency, and therefore, any water conservation measures proposed must improve energy efficiency.
Specifically, Osan AB, along with any other ESCO identified opportunities, is interested in exploring and evaluating the following ECMs: Boiler and Chiller Improvements; Energy Management Control System (EMCS); Heating, Ventilation, and Air Conditioning (HVAC) Improvements; Lighting Improvements; and, Electric Motors and Drives.
The selected ESCO shall be responsible for all operation, maintenance, and repair and replacement of all installed ECMs for the life of the contract pursuant to the DOE Super ESPC IDIQ and any resultant TO, as required by 42 U.S.C. § 8287. Be advised that the resultant project shall be accomplished in compliance with Air Force Engineering Technical Letter (ETL) 13-13: Energy Savings Performance Contracts, dated 15 Aug 2013 and Air Force Engineering Technical Letter (ETL) 11-1: Civil Engineering Industrial Control System Information Assurance Compliance, dated 30 March 2011, to ensure compliance with security and maintainability standards. Pursuant to the DOE Super ESPC IDIQ contracts, Section C.12, ENERGY EFFICIENCY AND RENEWABLE ENERGY AND WATER PROJECT FINANICAL AND TAX INCENTIVES, credits, rebates, and incentives from the Government, utility companies, and private companies should be pursued to the maximum extent practicable.
In any resultant IGA, the selected ESCO will be required to include and illustrate the clear lines of demarcation between its project and the existing energy conservation projects at Osan AB. The resultant project’s Measurement and Verification (M&V) Plan shall clearly illustrate the savings to assure the Government review team that any energy savings achieved are the result of the ESCO’s installed ECM(s) under the resultant project, and are not the result of an existing or separate energy project or some other circumstance unrelated to the resultant project. ESCOs are further advised that title to all equipment installed by the ESCO for the resultant project shall be vested in the Government after acceptance by the Government, and shall not relieve the ESCO’s responsibility for ECM performance.
As a military installation in South Korea, this procurement shall be subject to and the selected ESCO shall comply with all applicable U.S. and Republic of Korea laws, standards, regulations, and agreements including, but not be limited to, all U.S. Forces Korea (USFK) regulations (http://8tharmy.korea.army.mil/g1_AG/Programs_Policy/Publication_Records_Reg_USFK.htm); the Agreement Under Article VI of the Mutual Defense Treaty Between the United States of America and the Republic of Korea, Regarding Facilities and Areas and the Status of the United States Armed Forces in the Republic of Korea, signed at Seoul July 9, 1966 (the “Agreement”); the Agreed Minutes to the Agreement (July 9, 1966); the Understandings on Implementation of the Agreement and Related Agreed Minutes (February 1, 1991); the Exchange of Letters of February 1, 1991, to terminate the Agreed Understandings to the Agreement and Exchange of Letters of July 9, 1966; the Agreement Between the United States of America and the Republic of Korea Amending the Agreement, as amended (January 18, 2001); the Amendments to the Agreed Minutes of July 9, 1966 to the Agreement, as amended (January 18, 2001); the Understandings to the Agreement and Related Agreed Minutes, as amended (January 18, 2001); the Agreed Views Pertaining to Facilities and Areas and the Status of United States Armed Forces in Korea (January 18, 2001); the Memorandum of Understanding Preferential Hiring of Korean Employees and Employment of Family Members (January 18, 2001); and the Memorandum of Special Understandings on Environmental Protection (January 18, 2001), including any and all amendments thereto, as well as all other treaties, memoranda, understandings, agreements, and documents relating to the Agreement or between the U.S. and the Republic of Korea. The selected ESCO shall provide its own Korean speaking staff as the Government will not provide any translation or interpretation services. Responses to this NOO must be received no later than 24 February 2017, 3:00 p.m. Ft. Belvoir Time. All interested ESCOs should submit the following, and organize their responses in the following format, in order to be considered:
Factor 1 – ESCO Approach: (15 single sided pages maximum)
The ESCO response to this factor should include sufficient information to identify and describe the general approach and possible ECMs that it would propose for this project to reduce utility-purchased energy and water consumption and to identify and capture Operation and Maintenance (O&M) and related savings. The response to this factor must address renewable energy, generation, resiliency, facility and infrastructure improvements, and any associated O&M and related savings, within the context of 42 U.S.C. § 8287 and the DOE Super ESPC IDIQ. The ESCO shall draw upon and reference the information provided in Attachment 1 for this development. A site visit shall not be conducted.
The Government is not seeking a response similar to a PA. The Government is only looking for a reasonable illustrated approach for how the ESCO would pursue energy and water conservation efforts meeting Osan AB’s needs. The response shall present the following:
a) APPROACH. The ESCO shall identify possible ECMs that it would propose to evaluate for this project to reduce utility-purchased energy and water consumption while also identifying and capturing Operation and Maintenace (O&M) and related savings. The response to this factor must address renewable energy, generation, resiliency, facility and infrastructure improvements, and any associated O&M and related savings, within the context of 42 U.S.C. § 8287, and the DOE Super ESPC IDIQ contracts. The ESCO shall address the rationale for the ECMs selected and the determining factors for the ECM selections. The response should provide clear and convincing evidence why and how the selected ECMs will meet the needs of Osan AB, as described herein and shall draw upon and reference the information provided in Attachment 1.
In addition, the ESCO shall submit a draft Task Order Schedule 4 (TO-4) First Year Estimated Cost Savings by ECM and Technology Category illustrating the ESCO’s selected ECMs, less their associated implementation costs. ESCOs shall use information provided in Attachment 1 and any applicable industry standards for the draft TO-4. ESCO’s assumptions shall be highlighted in its response.
b) BEST INDUSTRY PRACTICES. The ESCO shall present the ESCO’s best industry practices it would employ for the investigation and development of Osan AB and its recommended ECMs culminating in the scope of work for this project. The ESCO shall draw upon and reference the information provided in Attachment 1 for this development.
c) RESOURCES. The ESCO shall include a discussion of resources it intends to utilize as well as any subcontracting or teaming arrangements to be established should it be selected. The ESCO shall demonstrate a supply chain and logistical support for delivery of personnel and materials to South Korea while meeting all necessary requirements. The ESCO shall demonstrate any local and regional resources within South Korea or adjacent countries for support during all phases of the contract, including the ability to engage local contractors and suppliers when practicable.
This is critical during the Performance Period phase of the contract to provide support to Osan AB for ongoing maintenance needs or to remedy shortfalls in energy performance.
d) COMPLIANCE. The ESCO shall affirm its intent to comply with all applicable U.S. and South Korean laws, standards, regulations, and agreements.
e) OVERSEAS EXPERIENCE. It is not a requirement that the ESCO have past history in the execution of its selected ECMs. The DOE Super ESPC IDIQ has already determined each ESCO responsible for the sound implementation capability of each of the 20 technical categories.
However, due to the location of this project, the ESCO must illustrate past experience of performing a project in an overseas location. ESCOs shall submit two (2) projects illustrating its experience performing an ESPC in an overseas environment. “Overseas” is defined as a location that is outside the continental United States. For each project, provide a brief narrative explaining the scope of the project, contract number, location of each project, Contracting Officer’s or Point of Contact’s name, telephone, and e-mail address.
Factor 2 – Past Performance: (1 page)
The ESCO’s response to this factor should include three (3) references illustrating the ESCO’s past performance as the prime contractor on an ESPC project. ESCO shall provide the agency/owner point of contact (name, title, phone number, and email address), location of each project, contract number, date of task order or contract award, and actual or project construction completion date. The Government will use its discretion to determine the sources of past information used in the Past Performance evaluation. The information may be obtained from the Government’s knowledge of contractor performance, other government agencies or commercial entities, or past performance databases.
Factor 3 - Price Factor: (Five single sided pages maximum)
ESCOs shall discuss and define any cost benefit or other financial advantage their company can bring to the Government that would reduce the total contract value for a subsequent project. The discussion of each benefit or advantage must identify, at a minimum, a percentage discount to the total contract value. Be advised that the ESCO will not be held to this exact percentage if selected, however, will be held to the fulfillment of the concept. It is expected and accepted that during the development of the project scope and finalization of all attributes of the project during the IGA that further definitization will occur.
The Government is not looking for a cost breakdown of the project visualized in response to Factor 1. The Government seeks to understand the ESCO’s practices and ardent pursuant of any financial benefits that will assist in bringing the total contract value of the final project down while at the same time not eroding or compromising the success of the project.
5. Evaluation Methodology
a. Basis for Selection:
Task Order down selection procedures as stated in the DOE Super ESPC IDIQ, paragraph H.3.1, will be used to make an integrated assessment for a best value decision for ESPC services at a firm fixed price.
Proposal will be evaluated using the following three factors:
1) ESCO Approach;
2) Past Performance; and
3) Price Factor.
Factor 1, ESCO Approach, is more important than Factor 2, Past Performance. When combined, Factor 1 and Factor 2 are more important than Factor 3, Price Factor.
The resultant TO may be awarded to the responsible ESCO that provides the best fit in achieving energy conservation and renewable efforts for Osan AB. Best fit means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in satisfying the requirement and represents the best value to the Government considering the ESCO’s approach, past performance, and price.
b. Number of Contracts to be Awarded:
The Government intends to award one resultant TO for this requirement. However, the Government reserves the right not to award a TO at all.
