C. B19.27 ECONOMIC PRICE ADJUSTMENT – ESTABLISHED CATALOG PRICE
(ALASKA/HAWAII) (DLA ENERGY JAN 2012) - - Initial offer price and base reference price date for this solicitation is 1 June 2015. The final proposal revision reference price effective date will be the same as the reference price established for initial offers.
The Government preferred Base Reference indexes for the items listed in ATTACHMENT I – SCHEDULE OF SUPPLIES can be found on clause B19.27.
Offerors will complete ATTACHMENT III – PRICE DATA Sheet when submitting all pricing.
Reference Section M3.01 – EVALUATION OF OFFERS WHERE UNCOMMON ESCALATORS ARE USED (DLA ENERGY JAN 1988). Offerors using any Pricing Index other than what is stated in B19.27, will be required to complete and submit on time.

D. Tax And Fee Information: Applicability of various Federal, State, and Local taxes is governed by the following clauses contained in SECTION I CONTRACT CLAUSES:

NOTE: All pricing must include all applicable taxes and fees. Offerors are responsible for ensuring all applicable taxes and fees are included in or excluded from their offer price, as appropriate. The offeror is responsible for confirming the applicability of taxes and tax rates with the state or local tax authority in question.
E. Pursuant to L2.11-4 EMAIL PROPOSALS, offers submitted via e-mail must constitute an offeror’s hard copy. F. QUESTION AND ANSWER PERIOD. To encourage maximum participation on ALL line items (Attachment I) a question and answer period has been established. Starting from the issue date of this solicitation to 18 June 2015. All potential incumbents may ask any and as many questions as they may need to fully participate and respond to all the listed line items (Attachment I). No further questions will be received after the above stated date and time. All questions to be sent to Zulma.Irizarry@dla.mil and DLAEnergyPEC@dla.mil. Answers will be consolidated and answered via an official amendment to the solicitation, if applicable, by 25 June 2015. Extensions of the closing date to an open solicitation are at the sole discretion of the Contracting Officer and will be issued via an amendment, if applicable.
Potential incumbents are reminded that they shall sign the amendment (block 15A-C) OR acknowledge the solicitation/amendment(s) in their prospective submitted proposals.

Section B‐ Supplies or services and prices/costs
B1.01 SUPPLIES TO BE FURNISHED (DOMESTIC PC&S) (DLA ENERGY JAN 2012)
(a) The supplies to be furnished during the period specified in the REQUIREMENTS clause, the delivery points, methods of delivery, and estimated quantities are shown below. The quantities shown are best estimates of required quantities only. Unless otherwise specified, the total quantity ordered and required to be delivered may be greater than or less than such quantities. The Government agrees to order from the Contractor and the Contractor shall, if ordered, deliver during the contract period all items awarded under this contract. The prices paid shall be the unit prices specified in subsequent price change modifications issued in accordance with the ECONOMIC PRICE ADJUSTMENT clause.
(b) All items of this contract call for delivery f.o.b. destination unless the item otherwise specifies. The destination for each item is the point of delivery shown in the particular item.
(c) Written telecommunication (facsimile) is authorized for transmittance of a properly completed order. In an emergency, oral orders may be issued but must be confirmed in writing by an order within 24 hours.
(d) If any gasoline items are included in this document, they may require oxygenated fuel as a result of changes in environmental laws. See the SPECIFICATIONS (CONT'D) (COG 3.9) contract provision for a listing of counties, cities, and townships that require oxygenated gasoline during the period listed.
(e) Offers shall not be submitted for quantities less than the estimated quantities specified below for each line item.Any offers received for less than the full quantity for each line item will be rejected by the Government.

B19.27 ECONOMIC PRICE ADJUSTMENT – ESTABLISHED CATALOG PRICE (ALASKA/HAWAII)

(a) WARRANTIES. The Contractor warrants that--
(1) The unit prices set forth in this contract do not include allowances for any portion of the contingency covered by this contract provision; and
(2) The prices to be invoiced hereunder for listed items shall be computed in accordance with the conditions of this contract provision.
(b) DEFINITIONS. As used throughout this contract provision, the term--
(1) Award price means the unit price offered for the item of supply identified by the item number.
(2) Established catalog price (also commonly known as posted price) is the price with which the award price is to fluctuate. The established catalog price is a price for a commercial item sold in substantial quantities to the general public and is the net price after applying any standard trade discounts offered by the Contractor. Accordingly, changes in the discount shall be treated as a change in the established catalog price, provided such discount is offered in substantial quantities to the general public.

(3) Date of delivery means--
(i) FOR TANKER OR BARGE DELIVERIES.
(A) F.O.B. ORIGIN. The date and time vessel commences loading.
(B) F.O.B. DESTINATION. The date and time vessel commences discharging.
(ii) FOR ALL OTHER TYPES OF DELIVERIES. The date product is received on a truck-by-truck basis.
(c) ADJUSTMENTS.
(1) NOTIFICATION. The Contractor shall notify the Contracting Officer of any change in the established catalog price within 15 days from the effective date of such change.
(2) EVIDENCE OF CHANGE IN CONTRACTOR’S ESTABLISHED CATALOG (POSTED)
PRICE. The price change notification shall include written documentation sufficient to justify such change. If the change in the Contractor’s established catalog price results from a change in a supplier’s price, the Contractor shall include a copy of the supplier’s notice or invoice which clearly shows the supplier’s name, the increase/decrease in price or invoice price, the applicable product, and the effective date of the change. In the event the Contracting Officer determines the justification insufficient to warrant such a change, the Contractor will be notified within three working days of DLA Energy’s receipt of the price change notification. The Contractor shall continue performance under this contract until the situation is resolved in accordance with paragraph (d), Disputes of the CONTRACT TERMS AND CONDITIONS – COMMERCIAL ITEMS clause of this contract.
(3) CALCULATIONS. The prices payable under this contract shall be the award price increased or decreased by the amount that the established catalog price increased or decreased through the date of delivery. The amount of increase or decrease in the award price shall be used on the same number of cents, or fraction thereof, that the established catalog price increases or decreases per like unit of measure.
(4) NOTIFICATIONS. Any resultant price changes shall be provided via notification through contract modifications and/or postings to the DLA Energy web page at http://www.desc.dla.mil under the heading Vendor Resources and then Product Price Adjustments in accordance with the following:
(i) The effective date of the price change notification will be the date of the latest posting issued on or prior to the date of delivery.
(ii) DECREASES. If the Contractor fails to notify the Contracting Officer of any decrease in the established catalog price within the allotted 15-day period, such decrease shall apply to deliveries made on or after the effective date of such decrease. However, if any overpayment is made to the Contractor as a result of the Contractor’s failure to give timely notice to the Contracting Officer of any decrease in the established catalog price, the Contractor shall be charged interest on such overpayment from the date of the overpayment to the date of reimbursement by the Contractor for the overpayment in accordance with paragraph (d), Disputes, of the CONTRACT TERMS AND CONDITIONS – COMMERCIAL ITEMS clause of this contract.
(iii) INCREASES. Any increase in unit price as a result of an increase in the established catalog price shall apply to all deliveries made on or after the effective date of the price change issued by the Contracting Officer.
However, no notification incorporating an increase in a contract unit price shall be executed pursuant to this contract provision until the increase has been verified by the Contracting Officer.
(4) FAILURE TO DELIVER. Notwithstanding any other conditions of this contract provision, no upward adjustment shall apply to product scheduled under the contract to be delivered before the effective date of the adjustment, unless the Contractor’s failure to deliver according to the delivery schedule results from causes beyond the Contractor’s control and without its fault or negligence,within the meaning of paragraphs (f), Excusable Delays, and (m), Termination for Cause, of the CONTRACT TERMS AND CONDITIONS – COMMERCIAL ITEMS clause of this contract, or is the result of an allocation made in accordance with the terms of the ALLOCATION clause of this contract, in which case the contract shall be amended to make an equitable extension of the delivery schedule.
(5) UPWARD CEILING ON ECONOMIC PRICE ADJUSTMENT. The Contractor agrees that the total increase in any contract unit price shall not exceed _575_ percent of the award price, except as provided hereafter:
(i) If at any time the Contractor has reason to believe that within the near future a price adjustment under the conditions of this contract provision will be required that will exceed the current contract ceiling price for any item, the Contractor shall promptly notify the Contracting Officer in writing of the expected increase. The notification shall include a revised ceiling the Contractor believes is sufficient to permit completion of remaining contract performance, along with an appropriate explanation and documentation as required by the Contracting Officer.
(ii) If an actual increase in the established catalog price would raise a contract unit price for an item above the current ceiling, the Contractor shall have no obligation under this contract to fill pending or future orders for such item, as of the effective date of the increase, unless the Contracting Officer issues a contract modification to raise the ceiling. If the contract ceiling will not be raised, the Contracting Officer shall so promptly notify the Contractor in writing.

(d) EXAMINATION OF RECORDS. The Contractor agrees that the Contracting Officer or designated representatives shall have the right to examine the Contractor's books, records, documents, and other data the Contracting Officer deems necessary to verify Contractor adherence to the conditions of this contract provision.
(e) FINAL INVOICE. The Contractor shall include a statement on the final invoice that the amounts invoiced hereunder have applied all decreases required by this contract provision.
(f) TABLE. The Base Reference Price (BRP) date is 1 June 2015 and the publications to be used are as follows:

Product to be supplied shall fully meet the requirements of the applicable specification(s) as indicated in the
Supply Schedule, except as modified elsewhere in this contract. Unless otherwise indicated by the Contractor, prior to award and in accordance with the EVALUATION OF OFFERS contract provision, the product offered will be assumed to fully meet the applicable specification(s).

(a) ADDITIVES.
(1) Additives shall not be premixed with other additives before injection into the fuel.

(2) FUEL SYSTEM ICING INHIBITOR (FSII). When required by contract line item-
(i) FSII shall be added to the fuel and shall be Diethylene Glycol Monomethyl Ether (DIEGME) conforming to ASTM D4171, Standard Specification for FSIIs, Type III or MIL-DTL-85470B, dated June 15, 1999, Inhibitor, Icing, Fuel System, High Flash, NATO Code Number S-1745.
(ii) FSII shall be added to the fuel so that the resulting concentration in the final blend is between 0.07% and 0.10% by volume.
(iii) When using the 20-ounce aerosol can to introduce FSII during over the wing refueling, determine the fuel quantity and calculate the amount of required additive. This additive shall be added gradually during filling to permit proper blending in the fuel. One can of aerosol additive will inhibit 180 gallons of fuel to 0.087 percent by volume. The use of aerosol FSII is not permitted for U.S. Navy aircraft refueling.
(3) CORROSION INHIBITOR/LUBRICITY IMPROVER (CI/LI). When required by contract line item-
(i) The additive must conform to MIL-PRF-25017H with Amendment 1, dated August 4, 2011 Inhibitor, Corrosion/Lubricity Improver, Fuel Soluble (NATO S-1747), found in ASSIST and shall be listed in the electronic Qualified Products List (QPL)-25017, located in the Qualified Products Database (QPD) found at http://assistdocs.com.
(ii) The concentration of CI/LI added to the fuel must be between the minimum effective concentration and the maximum allowable concentration as listed for the CI/LI in QPL-25017.
(4) STATIC DISSIPATER ADDITIVE (SDA). When required by contract line item-
(i) SDA shall be added to the fuel and the conductivity limits of 50 to 600 picosiemens per meter (pS/m) at ambient temperature or 29.4oC (85oF), whichever is lower, unless otherwise directed by the procuring activity.
(5) METAL DEACTIVATOR (MDA). MDA shall not be used unless the supplier has obtained PRIOR written consent from the procuring activity.
(6) Product shall be homogeneously mixed. Until all aviation turbine fuel tanks are coated, it is acceptable to perform stratification tests in lieu of circulating tanks to achieve homogeneity.

In the event that a Federal, State, or local environmental requirement is more stringent than a specification contained in this contract, the Contractor shall deliver product that complies with the more stringent requirement. Supplies delivered under this contract shall conform to all Federal, State, and local environmental requirements applicable to the geographic location of the receiving activity on the date of delivery.
(a) PRODUCT PERFORMANCE REQUIREMENTS. Product shall conform to the latest revision of ASTM D5798.
(b) BLENDING. Product shall be blended prior to delivery. Manifold blending at time of delivery and blending in the receipt tank is not permitted. The resultant blended product must meet all performance requirements specified in the contract.
C16.15 GASOLINE, AVIATION (GRADES 80/100LL) (DLA ENERGY OCT 2014)
Aviation Gasoline shall conform to the latest revision of ASTM D910 or Defense Standard 91-90.
C16.27 FUEL, BIODIESEL (B20) (DLA ENERGY OCT 2014)
In the event that a Federal, State, or local environmental requirement is more stringent than a specification contained in this contract, the Contractor shall deliver product that complies with the more stringent requirement. Supplies delivered under this contract shall conform to all Federal, State, and local environmental requirements applicable to the geographic location of the receiving activity on the date of delivery. Offered product shall conform to the following requirements that define a fuel suitable for use in automotive diesel engines:
(a) PRODUCT COMPOSITIONAL AND PERFORMANCE REQUIREMENTS. The finished fuel shall conform to ASTM D7467, with a biodiesel blend percentage of 20 +/- 1 percent, with the exception that the biodiesel component, per ASTM D6751, shall be derived solely from either virgin or used vegetable oils. Biodiesel derived from animal fats or tallows shall not be used. Product classification is shown below:

Documentation of BQ-9000 certification shall be submitted at time of offer.
(b) BLENDING. Product shall be blended prior to delivery. Manifold blending at time of delivery and blending in the receipt tank is not permitted. The resultant blended product must meet all performance requirements specified in the contract.
(c) LOW TEMPERATURE OPERABILITY. For fuel supplied during the months of October through March, the low temperature performance of B20 biodiesel shall be defined by the following property:
CLOUD POINT. Unless a more restrictive cloud point limit is specified in the contract schedule, the cloud point shall be equal to or lower than the tenth percentile minimum ambient temperature specified in Appendix X3 of ASTM D 7467.
(d) ENVIRONMENTAL PROTECTION AGENCY (EPA) REGISTRATION. B100 product must be EPA registered in accordance with 40 CFR Part 79, Registration of Fuels and Fuel Additives. The Contractor shall provide a copy of the EPA registration letter to the Contracting Officer at the time of offer.
C16.69‐2 AUTOMOTIVE GASOLINE FUEL SPECIFICATIONS (PC&S) (DLA ENERGY AUG 2014)
Supplies delivered under this contract shall conform to all Federal, State, and local environmental requirements applicable to the geographic location of the receiving activity on the date of delivery. This includes delivery of fuel and documentation in a manner consistent with existing or future Title V (Clean Air Act) Permits. In the event that a Federal, State, or local environmental requirement is more stringent than a similar requirement in a fuel specification contained in this contract, the Contractor shall deliver product that complies with the more stringent requirement. Product that fails to meet the more stringent environmental requirement will be considered to be a nonconforming supply. All supplies furnished under this contract shall fully meet the requirements of the applicable specification(s) as cited below. In the event that compliance with the more stringent requirement causes the contractor to incur additional costs, the contractor may request an equitable adjustment.
i. GASOLINE AUTOMOTIVE. Gasoline shall conform to each countries specification as listed below:
(1) Specifications for countries not listed in the chart above may be used if they meet or exceed the specification requirements of ASTM D4814. In-country specifications not meeting D4814, but meet local requirements may also be submitted for approval.
(2) REID VAPOR PRESSURE (RVP). The contractor is expected to know and comply with the in-country RVP requirements of the area being supplied.
ii. GASOLINE, AUTOMOTIVE, UNLEADED, MIDGRADE(ALL OTHER REGIONS). Product shall conform to
ASTM D 4814, as modified below.
(1) OCTANE REQUIREMENTS.
(i) Unleaded automotive gasoline shall meet the Anti-Knock Index (AKI) requirements shown in the table below:

(2) OXYGENATE REQUIREMENTS.
(i) In order to achieve minimum/maximum oxygen content limits specified per Federal, State, and local environmental requirements, supplies shall only include oxygenates that are permitted by environmental regulations applicable to the time and place of delivery.
(ii) Blending of oxygenates into gasoline to meet oxygenated fuel requirements shall be accomplished by mechanical mixing or agitation in a tank, or by in-line blending, prior to loading the product into transport equipment, and the resultant product must meet contract requirements.
NOTE: Gasoline Reid Vapor Pressure (RVP) specification requirements are seasonal and vary geographically. Therefore, Contractors are expected to know the local, State, or Federal RVP requirements of areas being supplied and comply with those requirements.

Product(s) to be supplied shall fully meet the requirements of the applicable specification(s) as cited below. In the event that compliance with the more stringent fuel specification causes the contractor to incur additional costs, the contractor may request an equitable adjustment.
(a) DIESEL FUEL. Product shall conform to commercial specification ASTM D 975. In accordance with this specification, product shall be visually free of undissolved water, sediment, and suspended matter. Product classification is shown below.

(i) ADDITIVES.
(A) A fuel stabilizer additive conforming to MIL-S-53021, latest revision, may be blended into the fuel to improve the suitability of fuel for long term storage. Permissible additive concentrations are specified in the latest revision of QPL-53021.
(B) A corrosion inhibitor/lubricity improver additive may be blended into the fuel to inhibit corrosion and improve fuel lubricity. Permissible additive concentration limits are specified in the latest revision of QPL 25017.
(C) A fuel system icing inhibitor may be blended into the fuel to purge small quantities of water from the fuel and prevent the formulation of ice crystals. The additive concentration shall not exceed 0.15 volume percent when tested in accordance with ASTM D 5006.
(i) BLENDING. Blending one grade of diesel fuel with another grade, or other compatible components, to produce a different grade or a variation within a grade is permitted. However, such blending shall be accomplished by mechanical mixing or agitation in a tank, or in-line blending, prior to loading the product into transport equipment, and the resultant product must meet all the requirements of the desired fuel.
(ii) LOW TEMPERATURE OPERABILITY. The low temperature performance of diesel fuel shall be defined by the following property:

(iii) CLOUD POINT. Unless a more restrictive cloud point limit is specified in the contract schedule, the cloud point shall be equal to or lower than the tenth percentile minimum ambient temperature specified in Appendix X5 of ASTM D 975. For activities where fuel support is limited to April-September, for example "JUN/JUL", "MAY 15 - JUN 15", "DURING SUMMER MONTHS", etc, and fuel will be used year-round in support of continuing operations, the cloud point shall be equal to or lower than the tenth percentile minimum temperature specified in Appendix X5 of ASTM D 975 for the month of January.
(iv) DYE. As a means of identification, the Internal Revenue Service (IRS) requires that a red dye, identified as Solvent Red 164 (alky derivatives of azo benzene azo naphthol), must be added to all nontaxable diesel and all nontaxable kerosene used for purposes other than military jet fuel. The definitions of diesel and kerosene are provided in 26 CFR Section 48.4081-1. The minimum concentration is provided in 40 CFR Part 80.

In the event that a Federal, State, or local environmental requirement is more stringent than a fuel specification contained in this contract, the Contractor shall deliver product that complies with the more stringent fuel specification. Product that fails to meet the more stringent fuel specification will be considered to be a nonconforming supply. Product(s) to be supplied shall fully meet the requirements of the applicable specification(s) as cited below. In the event that compliance with the more stringent fuel specification causes the contractor to incur additional costs, the contractor may request an equitable adjustment.
NOTE: Gasohol Reid Vapor Pressure (RVP) specification requirements are seasonal and vary geographically throughout the United States. Therefore, Contractors are expected to know the local, State, or Federal RVP requirements of areas being supplied and comply with those requirements.
in-line blending, prior to loading the product into transport equipment, and the resultant product must meet contract requirements.
(a) GASOHOL, AUTOMOTIVE, UNLEADED, GRADES REGULAR, MIDGRADE, AND PREMIUM.
Products shall conform to Commercial Item described (CID) A-A-52530 dated October 10, 1995, as modified below. In accordance with Executive Order 12261 of January 5, 1981, "Gasohol in Federal Motor Vehicles," Gasohol may be considered an acceptable substitute for Unleaded Gasoline. The Unleaded Gasoline items that permit the substitution of Gasohol are identified in the Schedule. Contractors are required to state, for each line item in their offer, whether Gasohol will be provided. Contractors will not be permitted to substitute Unleaded Gasoline under line items awarded as gasohol. Also, Contractors are not permitted to substitute gasohol for gasoline under line items awarded as gasoline, except when Government regulations mandate use of fuel containing an oxygenate for control of carbon monoxide pollution.
(1) OCTANE REQUIREMENTS.
(i) Unleaded automotive gasohol shall meet the AKI requirements shown in the table below.
(ii) Reductions for altitude and seasonal variations are allowed for all AKI values in accordance with figures X1.2 and X1.3 of ASTM D 4814.
(iii) For regular unleaded gasohol, in addition to an AKI of 87 minimum, the MON must not be less than 82.
(2) OXYGENATE REQUIREMENTS.
(i) Ethanol concentration shall be between 9 and 11 volume percent.
(ii) Blending of ethanol into gasoline to make gasohol shall be accomplished by mechanical mixing or agitation in a tank, or by in-line blending, prior to loading the product into transport equipment, and the resultant product must meet contract requirements.
