(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

Alternate I (Feb 2000). As prescribed in 12.301(b)(4)(i), delete paragraph (d) from the basic clause, redesignate paragraph (e) as paragraph (d), and revise the reference to “paragraphs (a), (b), (c), or (d) of this clause” in the redesignated paragraph (d) to read “paragraphs (a), (b), and (c) of this clause”.
Alternate II (Apr 2015). As prescribed in 12.301(b)(4)(ii), substitute the following paragraphs (d)(1) and (e)(1) for paragraphs (d)(1) and (e)(1) of the basic clause as follows:
(d)
(1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8G of the Inspector General Act of 1978 (5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to—
(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and
(ii) Interview any officer or employee regarding such transactions.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), and (c), of this clause, the Contractor is not required to flow down any FAR clause in a subcontract for commercial items, other than—
(i) Paragraph (d) of this clause. This paragraph flows down to all subcontracts, except the authority of the Inspector General under paragraph (d)(1)(ii) does not flow down; and
(ii) Those clauses listed in this paragraph (e)(1). Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

Answer – There are two (2) grades of fuel for the same tank due to the climate. The customer will order which ever fuel is needed based on the ambient temperatures.

CLIN’s 0035 & 0036 are asking for FS2 Fuel Oil Burner which I assume is High Sulfur #2 Heating Fuel. We asked in our original questionnaire to clarify what product this location is asking for due to the fact that Kodiak does not have High Sulfur #2 anywhere on the Island. Please note in the schedule of supplies they are asking for the same product for the same locations at different times of the year. The only product available is High Sulfur #1, ULSD 1 and ULSD 2.
Answer – The fuel required in line items 0035 and 0036 have been changed to ULSD DS1. Reference Attachment 1, Schedule of Supplies (pages 12 and 13).
5. Question – Do bidder discount amounts for small disadvantaged businesses like women owned or Veteran-Owned small businesses, etc.?
Answer – HubZone is the only program that has a price evaluation preference. All other programs do not have a price evaluation preference.
There are no applied discounts unless the vendor offers a discount when submitting an offer. If the vendor provides a discount, the final cost (after subtracting the discount) will be the submitted unit price.
Contract/Awards will not reflect this discount.
6. Question – Reference Attachment I, Schedule of Supplies, Item 0008 (page 4). Is the Blair Lakes location out across the Tanana River? Is that an Ice road trail only?
Answer – Yes the Blair Lakes location is across the Tanana River. The Tanana River, when frozen becomes the “ice bridge”.
7. Question – Is there a specific quantity that the customer will be asking for each time?
Answer – Reference FAR 52.216-19 – Order Limitations (Oct 1995) and FAR 52.216-21 – Requirements (Oct 1995). No, there is no specific quantity that the customer will be asking for each time. This is a requirements type contract. Unless there is a specified “minimum” delivery quantity stated within the line item description, then there is no minimum or maximum required for delivery. The quantity ordered on a requirements type contract is solely based on the customers’ need at that specific time and may vary from order-to-order.
8. Question – Reference Attachment I, Schedule of Supplies, Item 0144 (page 51) Point Barrow. How is the fuel delivered to the tanks?
Answer – The tanks are accessible by roads. The tanks are not located at the airport, but actually at the radar site. The site/tanks are approximately six (6) miles from the airport. A Tank Truck/Tank Wagon w/pump is required for delivery.
9. Question – Reference Attachment III, Price Data Sheet. The Price Data Sheet says to include FET in the offer price. Has this been required in the past solicitations?
Answer – The FET taxes were excluded from our previous solicitation/Price Data Sheet. During our previous solicitation, DLA Energy was using the legacy contracting system. Effective May 2013, DLA Energy converted to a new system, Enterprise Business System (EBS) for contracting. In EBS, FET and all applicable taxes and fees is required to be included in the price. Therefore, our Price Data Sheet now includes FET. When vendors submit invoices via Wide Area Workflow (WAWF), the FET is required to be included in the invoiced amount and is no longer broken out and listed as a separate cost.
10. Question – Reference Attachment II, Government Preferred Indexes. Please clarify that Line Items 0022 and 0023 are asking for High Sulfur #2 since these are tied to the Preferred Government Indexes in Attachment II.
Answer – The requirement for Line Items 0022 and 0023 remain FS2 as requested by the customer. The escalators that can be used in Alaska are limited. Unfortunately, there is no high sulfur option available;
therefore, the Government Preferred Index remains unchanged as “OPIS Anchorage ULSD” for Line Items 0022 and 0023.
