14. DESCRIPTION OF AMENDMENT/MODIFICATION (Organized by UCF section headings, including solicitation/contract subject matter where feasible.)
1. DLA Energy requests that all offerors acknowledge receipt of this amendment by completing block 8 above, and signing and dating blocks 15A, 15B, and 15C below, and returning this document to DLA Energy/BXB email to Wing.wong@dla.mil.
2. SECTION-B-e, Section-C-1-c, and Section-E-2-d of the PWS are revised. All the changes can be found on page 2 through 4.
3. FAR 52.222-2 is hereby added to the solicitation.
4. Vendors can submit the question on or before March 6, 2012 at 3:00pm (Ft. Belvoir time).
Except as provided herein, all terms and conditions of the document referenced in Items 9A or 10A, as heretofore changed, remain unchanged and in full force and effect.

1. Replace the following sections (PWS) paragraphs with the following new paragraphs:
i. Delete following Section from PWS:
SECTION-B. SERVICES TO BE PROVIDED
e. The commercial laboratory must be located within 900 miles of the sample locations listed in the following CONUS locations being solicited in this PWS. However, if all offers generated from the solicitation are not within a 900 mile distance, all remaining offers will be evaluated equally for distance. The exception to this rule is on CLIN 0048 (Charleston, SC). For this location (CLIN 0048) we are requiring a turn-around time of 8 hours for Jet A Full Specification testing of samples.
Replace following Section to PWS:
SECTION-B. SERVICES TO BE PROVIDED Revised:
e. The commercial laboratory must be located within 900 miles of the sample locations listed in the following CONUS locations being solicited in this PWS. However, if all offers generated from the solicitation are not within a 900 mile distance, all remaining offers will be evaluated equally for distance. The exception to this rule is on CLIN 0047 (Charleston, SC). For this location (CLIN 0047) we are requiring a turn-around time of 8 hours for Jet A Full Specification testing of samples.
The 8 hour turn-around time for CLIN 0047 is defined as the time for transportation and analysis of a Jet A sample until the results have been sent and accepted by the QAR responsible for this location activity. The other turn-around times for other samples is defined in Section C.1.c.
ii. Delete following Section from PWS:
SECTION-C. LABORATORY TESTING AT MULTIPLE CONUS LOCATION
1. DESCRIPTION OF SERVICES
c. Testing of U.S. Government-owned fuel products are required 24 hours per day, 7 days per week (including holidays). Under normal circumstances, samples will be received during contractor’s normal working hours as set forth in the contract. Samples shall be processed, tested, and results provided to the DLA Energy Office/QAR (having cognizance over the location from which the samples originate) within the prescribed turn-around times as indicated. Turn-around time is measured from the time the samples are received at the laboratory to the time test results are received by the QAR. Should testing be required at other than normal working hours, and/or neither the CO nor the QAR are available, the Contractor may perform tests as requested in order to make an adequate analysis of the samples of fuel furnished for testing. No additional tests that are beyond the Contractor’s capability to perform shall be required. The following are general turn-around times for groups of test/ methods:
TESTS REQUIRED and TURN AROUND TIMES B Series Testing (Attachment A) 24 hours Individual Testing (as requested) 8 hours

SECTION-C. LABORATORY TESTING AT MULTIPLE CONUS LOCATION
1. DESCRIPTION OF SERVICES
c. Testing of U.S. Government-owned fuel products are required 24 hours per day, 7 days per week (including holidays). Under normal circumstances, samples will be received during contractor’s normal working hours as set forth in the contract. Samples shall be processed, tested, and results provided to the DLA Energy Office/QAR (having cognizance over the location from which the samples originate) within the prescribed turn-around times as indicated. Turn-around time is measured from the time the samples are received at the laboratory to the time test results are received by the QAR. The contractor shall provide bids for transportation of samples to either provide a lab employee courier service or shipping by commercial carrier. In both cases of transport bid, the transport will take no longer than 48 hours for the sample(s) to arrive at the contract lab location. It should be noted that not all DLA Energy QARs are trained and certified to package, and manifest hazardous material shipments. The contractor should consult with the transport/shipping qualifications of the QAR prior to shipping by commercial carrier.
Should testing be required at other than normal working hours, and/or neither the CO nor the QAR are available, the Contractor may perform tests as requested in order to make an adequate analysis of the samples of fuel furnished for testing. No additional tests that are beyond the Contractor’s capability to perform shall be required. The following are general turn-around times for groups of test/ methods:

d. Overtime is defined as the time outside the Contractor’s normal working hours when the sample has been placed in the normal queue. Expedite is defined as placing the sample at the front of the queue and performing the test immediately.
Replace following Section to PWS:

2. Additional Services and Testing Outside Normal Working Hours
d. Overtime: Overtime is defined as compensation for continuous unscheduled work that falls outside the normal hours of operation, to perform tests or other laboratory procedures that are continuous in nature and cannot reasonably be interrupted or completed otherwise. (In accordance with FAR 22.103-2 Contractors shall perform all contracts, so far as practicable, without using overtime.)
1. Approval of the use of overtime may be granted by an agency approving official after determining in writing that overtime is necessary. Requests must be submitted to contracting personnel during normal working hours or to a US Government Quality Assurance Representative (QAR) responsible for that specific location after normal busines hours . The agency approving offical will determine what constitutes an emergency situation for which lab testing cannot wait until the next normal hours of operation.
2. Any request for overtime shall include the following:
a. Identify the reason for the need for overtime and the amount of time needed to complete the work
b. Identify the effect that denial of the request will have on the contract performance
c. Provide reasons why the required work cannot be completed by using multiple shifts or by employing additional personnel.
3. After the work is performed, the Contractor will invoice for the lab testing in accordance with contract provisions and shall also include the following overtime information:
a. Contract Number, CLIN Number, CLIN Location;
b. Purpose of the overtime and date approval received;
c. Dates and Times when overtime was performed;
d. Total number of hours performed;
e. Lab Sample Number and Product Type associated with the overtime.
2. Clauses FAR 52.222-2 Payment for Overtime Premiums is added to the solicitation.
FAR 52.222-2 Payment for Overtime Premiums. (July 1990)
(a) The use of overtime is authorized under this contract if the overtime premium does not exceed *_____$0_________ or the overtime premium is paid for work—
(1) Necessary to cope with emergencies such as those resulting from accidents, natural disasters, breakdowns of production equipment, or occasional production bottlenecks of a sporadic nature;
(2) By indirect-labor employees such as those performing duties in connection with administration, protection, transportation, maintenance, standby plant protection, operation of utilities, or accounting;
(3) To perform tests, industrial processes, laboratory procedures, loading or unloading of transportation conveyances, and operations in flight or afloat that are continuous in nature and cannot reasonably be interrupted or completed otherwise; or
(4) That will result in lower overall costs to the Government.
(b) Any request for estimated overtime premiums that exceeds the amount specified above shall include all estimated overtime for contract completion and shall—
(1) Identify the work unit; e.g., department or section in which the requested overtime will be used, together with present workload, staffing, and other data of the affected unit sufficient to permit the Contracting Officer to evaluate the necessity for the overtime;
(2) Demonstrate the effect that denial of the request will have on the contract delivery or performance schedule;
(3) Identify the extent to which approval of overtime would affect the performance or payments in connection with other Government contracts, together with identification of each affected contract;
and
(4) Provide reasons why the required work cannot be performed by using multishift operations or by employing additional personnel.
* Insert either “zero” or the dollar amount agreed to during negotiations. The inserted figure does not apply to the exceptions in paragraph (a)(1) through (a)(4) of the clause.
