Amendment 3
1. One of the purposes of this amendment is to answer questions regarding solicitation SP0600-10-R-0236, regarding the requirements for the delivery of fuel to Bagram Air Base.
QUESTION 1: The OSP says index to be followed is 01-JUN-10 whereas RFP says 01 JUL-10, which one is correct JUN or JUL?
ANSWER 1: The correct PLATTS index is July 01, 2010.
QUESTION 2: The price index is to be taken as at 01-JUl-10 (or as per correction for point 1)?
ANSWER 2: The Price index is to be taken as 01-JUL-2010.
QUESTION 3: The price of PLATTS MED CARGO is to be taken on low price?
ANSWER 3: The price of PLATTS MED CARGO is to be taken as the average of prices listed on the first day of the month as published by PLATTS OILGRAM.
QUESTION 4: Then it says average of the price published in PLATTS OILGRAM, what is this price average either low & high of the said index on a particular day or month or low price average of a month, there could be numerous options, can you give a detailed example of a month?
ANSWER 4: The price is calculated using the average of the high and low published on the first day of the month.
QUESTION 5: The solicitation is FOB destination, contractor will be given the price as per decanted date, is the price is to be calculated daily or monthly, as price of PLATTS fluctuates daily?
ANSWER 5: The price will be calculated on a monthly basis, referencing the published price on the first day of the month.
QUESTION 6: Period of Performance, within the Solicitation Notice(s) posted on the FBO website, is stated as 01 Sep 2011 up to 31 Aug 2013. However, within the solicitation itself, Ordering period is stated as from Date of Award up to 31 Aug 2012 and Delivery period is stated as from 01 Sep 2010 up to 30 Sep 2012 – Would appreciate of you could kindly confirm the Period of Performance.
ANSWER 6: The period of performance has been corrected and is posted on FBO as Amendment 1 to this solicitation. The correct ordering period shall be from the Date of Award to 31 AUG 2013 and the correct delivery period shall be from 30 days after award to
30 SEP 2013.
QUESTION 7: The location for the strategic fuel reserve, i.e. estimated distance to Bagram Air Base?
ANSWER 7: The contractor who is awarded CLIN 102-ST is responsible for securing a location for the reserve. However, the reserve must be in Afghanistan and in close proximity to Bagram Air Base. The exact distance is within the contractor’s discretion. Please see note #4 in the RFP for further explanation.
QUESTION 8: How much mobilization time would be granted from award of Contract.
ANSWER 8: The Contractor will have 30 days from date of award to fill delivery orders.
QUESTION 9: The OSP, P4 - Note 6 - DBA applicable to CLIN. Do you require DBA to be listed separately from 102-ST and if so where is this to be entered on in the OSP? What rate is the DBA for this industry?
ANSWER 9: DBA should be built into the total offer price. However, all costs and fees built into the total offer price should be itemized for transparency and review purposes.
QUESTION 10: Is the QCP and inspection system to be included in the proposal?
ANSWER 10: No, the QCP and Inspection is to be provided no later than 30 days after award.
QUESTION 11: The OSP, p32 refers to a Technical Capability Performance data sheet. Is this enclosed in the package, as I’m unable to locate it or is it a self designed and produced document outlining your technical capability. The other two attachments referred to, are provided in the solicitation however, this is not evident. Please clarify?
ANSWER 11: The Technical Capability Performance data sheet is a self-designed and -produced document outlining technical capability. Responses should be specific and concise, focusing on the solicitation requirements.
QUESTION 12: In relation to ‘Storage and ordering provisions’ it’s stated that: “…It is anticipated that the contractor will only deliver reserve fuel in the event that normal supply to Bagram Air Base is disrupted”. From a quality perspective, it’s generally not advisable to keep a static fuel storage of such size and time span due to the risk of deterioration of the quality. Beside circulation requirements, a full A-re-test in such case is required after 6 months and again for each 3 months. Please verify this requirement.
It’s suggested that the storage is handled as buffer storage instead with a minimum storage level at all time, where all fuel to the end delivery point will pass through. In that way the fuel is kept in a good condition, frequently tested and circulated.
ANSWER 12: It is the Contractor’s responsibility to manage storage in a manner that allows fuel quality to remain intact. The Government’s requirement is to have stock available when needed. Therefore, the Contractor can implement controlled first-in-first-out stock replacement in order to maintain product integrity.
QUESTION 13: Please confirm that there is no epoxy coating requirements to the TT’s/storage facility used for this contract.
ANSWER 13: All trucks delivering aviation fuels shall be epoxy coated, however non-epoxy coated trucks shall be dedicated to aviation fuel use. The storage facility shall have an epoxy lining.
QUESTION 14: Can this fuel be delivered to Galaba in Afghanistan? WE have the capability to deliver to this point.
ANSWER 14: No, this requirement is for delivery to Bagram Air Base and no other delivery locations will be acceptable.
QUESTION 15: Will there be any performance based measures incorporated into this contract?
ANSWER 15: No, this is a requirements-based, fixed-price with economic adjustment type contract.
QUESTION 16: If yes, are there any fee penalties based on performance based measures or liquidated damages?
ANSWER 16: See ANSWER 15.
QUESTION 17: Some previous large-scale DLA contracts have utilized a transition period of 6 months . Without a six month transition, and given that this is a CENTCOM war zone, it is difficult to justify the expense of tendering an offer. We encourage DESC to do this in order to provide full and open competition. Will DESC provide a six month transition from the incumbent to the new awardee/s?
ANSWER 17: No, the Contractor will only have a 30-day start up time from the Date of Award to fill delivery orders.
QUESTION 18: As CENTCOM states that its objective is to develop the northern route into Afghanistan and to further economic stability, will preference be given to an offeror that is enhancing both?
ANSWER 18: No, technical acceptability and price are the only evaluation factors.
QUESTION 19: Will the USG provide security for line haul movements within Afghanistan?
ANSWER 19: No. See clause FAR 52.212-4(l), page 12 of the RFP: “RISK OF LOSS AND TITLE.” Title and risk of loss or damage to the supplies under this contract shall remain with the Contractor until the Contractor completes download of product at the final delivery destination. The Contractor bears all risk and responsibility for loss or damage to equipment and personal injury or death of its employees, agents or subcontractors. The Contractor is responsible for obtaining adequate insurance to cover the risks. The Government will not reimburse the Contractor for claims stemming from loss or damage to product or equipment or personal injury or death of employees, agents or subcontractors.
QUESTION 20: Will the USG provide vehicle and material recovery assets within Afghanistan?
ANSWER 20: No, see ANSWER 19.
QUESTION 21: Is there space, USG provided or other, on Bagram Airbase for contractor to store the required reserve fuel?
ANSWER 21: No, it is the Contractor’s responsibility to obtain commercial storage within close proximity to Bagram Air Base.
QUESTION 22: Can USG provide regulatory guidance on the reserve fuel storage tanks and facility as they pertain to DOD, DOE, EPA, and any other requirements for the USG or Afghan Government?
ANSWER 22: The regulatory guidance and requirements for the storage would be that of the Afghani government. It is the responsibility of the Contractor to be familiar with and abide by those requirements and regulations.
QUESTION 23: Can contractor use armed security for reserve fuel farm in Afghanistan?
ANSWER 23: Proposals using armed private security to escort fuel and for reserve storage will not be considered acceptable and will not be considered for award.
QUESTION 25: The Offeror Submission Package (OSP) lists requirements for submittal and can be 34 pages. However, amendment 2 states that the total response including the OSP can be 60 pages. Are the pages in the response above the 34 page OSP at the contractors discretion for technical input or does the USG have specifics they want covered?
ANSWER 25: The Offeror is to submit a completed OSP, including government attachments (Past Performance Survey, Technical Acceptability, and Sub Contractor Roster). Any other information the Offeror provides is at the discretion of the Offeror. The complete package is not to exceed 60 pages.
QUESTION 26: Can the contractor include subK past performance in the past performance worksheet and will that past performance be deemed appropriate if applicable?
ANSWER 26: The Offeror may submit past performance data for any work performed as either a prime contractor or sub-contractor on a government contract. The work should be relevant to that described in this solicitation and performed within the past three (3) years.
QUESTION 27: Will the USG purchase the 6.5M gallons of TS-1 reserve Jet Fuel or will that be an upfront cost to the contractor to hold?
ANSWER 27: The reserve storage will be contractor-owned and be the responsibility of the contractor to obtain and manage until an order has been placed by the Government.
QUESTION 28: Contractor’s proposals are currently due on September 30th. Will the USG consider granting an extension to the due date to allow Contractor’s time to fully develop their responses and provide USG with well planned and competitive responses?
ANSWER 28: No extension will be provided.
QUESTION 29: “Proposals using armed private security to escort the fuel will not be considered acceptable and will not be considered for award.” Is it the Government’s intent for this contract to be UNARMED?
ANSWER 29: Yes, proposals using armed private security to escort fuel and for reserve storage will not be considered acceptable and will not be considered for award.
QUESTION 30: Can you please confirm the period of performance for the above contract, as from the pre-solicitation this was indicated as Sept 2011 – Sept 2013; however the full solicitation refers as follows:
ANSWER 30: The period of performance has been corrected and is posted on FBO as Amendment 1 to this solicitation. The correct ordering period shall be from the Date of Award to 31 AUG 2013 and the correct delivery period shall be from 30 days after award to
30 SEP 2013.
QUESTION 31: We have a client that brought to our attention the desire to submit a proposal in respond to solicitation # SP 0660-10-R-0236. Is there a standard form that can be used as a guideline to the when responding to the solicitation document, if so, at what contact can it be reviewed?
ANSWER 31: No, Offerors are to use the OSP and respond accordingly. The Offeror is to submit a completed OSP, including government attachments (Past Performance Survey, Technical Acceptability, and Sub Contractor Roster). Offerors are advised to pay attention to clauses INT-L2.11-4 and M72.
QUESTION 32: On Page 4 of the solicitation, under the CLINS, reference is made to Tank Truck (TT). Is TT the only acceptable means of delivery of fuel or are TTR or TW (as defined in INT-I1.01 DEFINITIONS (DLA ENERGY JUN 2009)) also acceptable?
ANSWER 32: The Government expects TT only; however, the Offeror is free to offer any mode of transit as long as it conforms to the M72 Clause “EVALUATION OF OFFERS
(EXCEPTIONS/DEVIATIONS) (DLA ENERGY APR 1997).
QUESTION 33: Regarding security, can you describe the procedure for coordinating official convoy security with the Afghanistan Ministry of the Interior? Is there a fee or tax involved with this?
ANSWER 33: No such security advice will be provided. Please note, proposals using armed private security to escort fuel and for reserve storage will not be considered acceptable and will not be considered for award.
QUESTION 34: Having read through the solicitation I would just like to confirm that the only prerequisite/registration prior to submission of the proposal is to be registered on FBO’s. Please could verify that no other registration is required?
ANSWER 34: Additional registration is required. The Central Contractor Registration (CCR) web-site states, “A foreign company that performs work outside the United States is required to register in the CCR system in order to be awarded a contract, except under extenuating circumstances, in accordance with Federal Acquisition Regulations 4.1102(a)(5) in the FAR.” The contract performance period is for two years, which does not qualify this procurement as a situation of ‘extenuating circumstances.’
QUESTION 35: Furthermore, is there any pre arranged site visit to Bagram Airbase to acquire an understanding of ‘soak periods’ at the VCP’s for tanker delivery? If there is no visit planned prior to submission, is it possible to forward a POC who can provide such information?
ANSWER 35: There will be no site visit prior to award. There may be a 24-hour ‘soak’ or ‘cool down’ period prior to downloading fuel and this time may be extended. The determination of time is up to the discretion of the Base Command. POC information will be given after award.
QUESTION 36: Finally, the solicitation mentions a Quality Control Plan however; it is not clear whether this has to be included in the solicitation or just available upon award. Please clarify.
http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/04.htm#P463_53254
ANSWER 36: The Offeror should have enough understanding of QC to put forth a knowledgeable offer. A complete QCP is not required in the solicitation. It is required no later than 30 days after award.
2. Clause INT L2.11-4 is hereby replaced and now reads as follows:
INT-L2.11-4 E-MAIL PROPOSALS (DLA ENERGY AUG 2010)
(a) Offerors may submit proposals via e-mail. E-mail proposals are subject to the same rules as paper proposals.
(b) E-mail receiving data and compatibility characteristics are as follows:
(1) E-mail address: ______________________________________.
(2) The DLA Energy accepts attachments in—
(i) Adobe Acrobat;
(ii) Microsoft Excel;
(iii) Microsoft Word; and
(iv) Microsoft PowerPoint.
(c) Initial proposals, modifications and proposal revisions submitted via e-mail must contain a signature.
(d) Attachments that are not in .pdf file format must be sent password protected for “read only” to ensure the integrity of the data submitted.
(e) Proposals submitted electronically through a single e-mail must be no more than 10 MB. DLA Energy’s mail server will reject messages larger than 10 MB.
(f) The DLA Energy e-mail filter will scan the incoming e-mail and attachments for viruses and key words. Abbreviations for terms such as “Analysts” or using “3Xs” as placeholders in a document are found in the filter’s adult content library and may result in the e-mail delivery being delayed. Offerors are encouraged to verify receipt of e-mail offers by contacting the Contracting Officer prior to the solicitation closing time.
(g) If any portion of an e-mail proposal received by the Contracting Officer is unreadable, the Contracting Officer will immediately notify the offeror and permit the offeror to resubmit the proposal. The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the offeror and the resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timeliness, provided the offeror complied with the e-mail submissions instructions provided in this paragraph and with the time and format requirements for resubmission prescribed by the Contracting Officer.
(h) The Government reserves the right to make award solely on the e-mail proposal.
However, if requested to do so by the Contracting Officer, the apparently successful offeror promptly shall submit the complete signed original proposal.
3. The offer submission email address has been changed. Please forward all offers to DLA
Energy at email: DLAE-PCB@dla.mil
4. The offeror’s complete proposal, including the 34-page OSP, shall not exceed 60 pages;
insure that pages are numbered sequentially. Pages in excess of the 60-page limitation will not be considered in the evaluation of the proposal (including attachments, appendices, or references).
mailto:DLAE-PCB@dla.mil
5. All offerors must complete blocks 8, 15a, 15b and 15c of the SF 30 and return a copy of this amendment with their offers.
