Amendment 0003
1. The purpose of this amendment is to answer questions raised by offerors’ queries of Solicitation SP0600-10-R- 0235, regarding requirements for delivery of Turbine Fuel, Aviation TS-1, to Bagram Air Field via pipeline.
2. This Question and Answer (Q&A) provides resolution for the following 19 questions:
QUESTION - 1: Only one vendor with specific pipeline delivery into Bagram past performance exists, and this is the incumbent. If Past Performance is the first tier grading criteria, this creates an unfair competition. Would DESC please clarify how broadly they will consider past performance? Is it region specific (ie fuel delivery in general within the region) or task specific (pipeline delivery vs tank truck)?
ANSWER: DLA Energy will consider relevant past performance in providing fuel in a war zone or during contingency operations.
QUESTION – 2: Current proposal pricing structure does not allow for a direct comparison. The incumbent price will be solely based on the price of fuel delivery, any non-incumbent must burden the fuel delivery price with the cost of putting into place a significant infrastructure. Will any consideration be given to a non-incumbent with regards to their pricing? Based on RFI research, this burden could be as much as $0.10 per gallon over the contract life, assuming full quantity is awarded and not split.
ANSWER: DLA Energy does not plan to use weighted evaluation factors for this requirement.
QUESTION – 3: Will further consideration be given regarding proposal page counts? While it is understood that a limit is important, 60 pages (inclusive of 34 page OSP, all amendments, and all attachments) realistically provides offeror’s only 15 to 20 pages to meet all the proposal requirements. Based on the Technical Capability requirements, it will be very difficult for any non-incumbent to provide a response that conforms to the proposal requirements and also is detailed enough to clear the hurdle of technical acceptability.
ANSWER: Yes, all restrictions to page counts have been removed.
QUESTION – 4: Based on the 6 month window for non-incumbent to complete all infrastructure preparation, can it be assumed that Contract Award will be made no later than March of 2011 in order to begin operations by September 2011?
ANSWER: An award date has not been established at this time, any non-incumbent will be given six months to establish deliveries for this requirement.
QUESTION – 5: How will DLA-Energy ensure a level playing field between potential bidders and the current supplier when the current supplier already has an existing pipeline infrastructure?
ANSWER: Please see answer to question #2
QUESTION – 6: How will the cost to construct a new pipeline by potential suppliers be included in the evaluation when compared to the current supplier bid?
ANSWER: Please see answer to question #2
QUESTION – 7: Does the government own the existing pipeline? Is it owned from the ECP3 to the base or is it government owned all the way to the current supplier facility?
ANSWER: The U.S. Government owns the pipeline from inside the base parameters to ECP3.
QUESTION – 8: Will the entire government owned existing pipeline be made available to the potential suppliers?
ANSWER: Yes, the US Government-owned portion of the pipeline will be made available to potential suppliers.
QUESTION – 9: Will a semi secured fenced-in area outside the base access be made available to the potential suppliers like the existing pipeline?
ANSWER: No, it will be the responsibility of the contractor to secure its facility.
QUESTION – 10: How will the six month construction time period be evaluated in the award?
ANSWER: A detailed plan to ensure deliveries within six months of award outlining milestones and mobilization schedule needs to be submitted for evaluation. Offerors will be evaluated on their detailed narrative outlining, at a minimum, construction plans, milestones, facility schematics, and plans for operating and reserve storage
QUESTION – 11: Will the existing supplier be provided an evaluation advantage, since no construction will be required?
ANSWER: Please see answer to question #2
QUESTION – 12: Specifically, the pricing of Item 102-ST1. The RFP reflects a Quantity and Unit of Issue of Gallons for the Reserve Fuel. How is the DBA and labor costs to manage and deliver the Reserve Fuel to be priced if payment isn’t until a Delivery Order is issued and not reimbursed until the actual reserve fuel passes through the USG receipt meter? (References: Note #5 on page 5 of 65 and Storage and Ordering Provision #5 & #8 on page 5 of 65 as well as the Title and Risk of Loss on page 6 of 65.) As you know DBA insurance is paid based on labor costs and is required to be in place after award of contract. If the USG delays or never issues a Delivery Order for Reserve Fuel, the cost for DBA insurance will be delayed or not be reimbursed.
ANSWER: DBA should be built into the offer price for CLIN 102-ST1.
QUESTION – 13: In reference to INT-B19.02 Economic Price Adjustment clause, paragraph (k) Table (page 21 of 65), column VI Reference price as of 01 July 2010 is used. Will this be updated at the time of award or will the Reference Price remain based on the 01 July 2010 date throughout the entire contract?
ANSWER: The base reference of 1 July 2010 will remain constant throughout the entire contract.
QUESTION – 14: The last issue we would like clarification on is JCC-I/A Clause 952.225-0011 Government Furnished Contractor Support (page 54 of 65). We noticed that none of the boxes have been checked. Does this mean that “badging” will not be provided allowing the contractor on base to attend meetings, perform work on fuel lines or utilize facilities such as medical care, Post Office or Base Exchange?
ANSWER: Base access will only be granted at the discretion of the Base Commander at Bagram Air Field.
QUESTION – 15: I wanted to ask if this contract will give any preference to 100% local Afghan owned companies.
ANSWER: No, a preference will not be given to 100% local Afghan-owned companies.
QUESTION – 16: With regard to the above-referenced RFP, I would like to know if there is any guaranteed uplift.
After all, if we plan to build an expensive storage and fuel supply facility proximate to Bagram, we'd like some sort of volume commitment. Kindly advise.
ANSWER: No, there will be no guaranteed lift quantity.
QUESTION – 17: pipeline delivery of Jet fuel, will we have to prepare storage of fuel and deliver to Bagram Air field or we will deliver item from somewhere to Bagram airfield.
ANSWER: Contractor will be responsible for all actions necessary to provide fuel from source to Bagram Air Field via pipeline.
QUESTION – 18: Is the following statement true:
"The companies' names are Red Star Enterprises and Mina Corp. In Afghanistan, Red Star Enterprises has a sole source contract worth more than $1 billion, won without competition, to deliver fuel to Bagram Air Base, that central hub of the war effort. The Nation has obtained an unusual "memorandum of agreement" <http://www.thenation.com/images/pdfs/red-star-memo-watermark.pdf> between Red Star and the US military authorities, giving the firm exclusive ownership of a fuel pipeline that feeds directly into the base."
Here is the link I obtained the quote from:
http://www.theinvestigativefund.org/investigations/iraqafghanistan/1290/fueling_the_afghan_war/
If so, how will this affect any other companies who would like to compete for this contract?
ANSWER: DLA Energy plans to award a contract using competitive contract procedures.
QUESTION 19: I would like to schedule a site visit, would I able to do so with you?
ANSWER: Due to security concerns within the region, site visits will not be granted at this time.
