RFP #HQ0034-20-R-0211

# Reference Category Vendor Question Government Response

Solicitation #HQ0034-20-R- 0211, Section SF 1449 -

Continuation Sheet, CLIN 0001 - 0008, pages 3 to 6

Technical

The solicitation uses multiple contract types for the various groups of services (e.g.

occupational health services, independent medical examinations, and independent medical reviews). For example, CLINs X001 and X002 are T&M and CLINs X003 and X005 are Labor Hours (LH). The healthcare industry standard for commercial services from private providers is the use of firm fixed prices. For example, the reimbursement methods for healthcare insurance fixed price per service identified by a CPT Code or HCPCS codes.

Private provider businesses are set up to support these types of payment methods and do not typically have the ability to support the required infrastructure to support government T&M and LH contracts. Request reconsideration of the use of a hybrid contract type as this will provide severe limitations on the ability to recruit/maintain a private provider network for the contract and to provide more offerors the ability to respond and submit a proposal.

Recommendation considered; however, the contract type will remain as a hybrid type contract.

Solicitation #HQ0034-20-R- 0211, Clauses Incorporated by

Reference, FAR Clause 52.222- 41 and 52.222-43, page 9 of 87

Technical

The RFP contains FAR 52.222-41, Service Contract Labor Standards and FAR 52.222-43, Fair Labor Standards Act and Service Contract Labor Standards-Price Adjustment (Multiple Year and Option Contracts). Request removal of these clauses and Attachment 9 as this is a contract to be performed overwhelmingly by physicians and medical professionals, who are not “service employees.”

Since the Act requires the payment of minimum compensation for work performed under the contract, and recordkeeping to prove that such compensation was paid, the compliance burden for the average medical practice would be burdensome. The inclusion of these clauses will make it very difficult to obtain medical practices as subcontractors – especially in addition to the any background requirements.

The physicians themselves are exempt from the Act as “professionals.” 29 C.F.R. § 541.304

(a) & (b). Moreover, some nurses and physician assistants are also exempt. 29 C.F.R. §

541.301(e). Other nurses and medical technicians are apparently covered, and will have to be paid the minimum compensation in the wage determination applicable to their locality. These individuals may work for the prime and/or a subcontractor. In addition, other individuals performing duties on the contract may be exempt as “administrative” workers.

Request removal of FAR clauses 52.222-41 and 52.222-43 from the RFP.

Please see Amendment 0002 for updated the solicitation which removes the clauses.

Solicitation HQ0034-20-R-0211, FAR Clause 52.216-1 "Type of

Contract," page 41 Contract

Recommend a firm fixed type contract type due to the limitations in the ability to recruit/maintain a private provider network for the contract and to provide more offerors the ability to respond and submit a proposal.

Recommendation considered but the contract type will be as contemplated, per page 41, clause 52.216-1 Type of Contract and PWS section 1.6.6.

These page limits are very restrictive and do not permit the ability to fully address the RFP and PWS requirements. Respectfully request additional page count such as a minimum of 5, preferably 10 pages, per subsection.

Please see Amendment 0002 of the solicitation for the updated page count.

Section A. Proposal Volumes Requirement; Section A.1.6, Contract Please clarify the file types for each proposal file that is required. Are both Adobe (PDF) and

"Instructions to Offeror;"

Section E. Factor 1 - Technical

Approach and Capability (Volume IV), page 75

Contract

The RFP states there is a 30 calendar day phase-in period. Establishment of a new contract and all associated activities such as background investigations and training typically require longer time periods. Respectfully request extending the phase-in period ot a minimum of 60 calendar days.

Please see Amendment 0002 for the updated Solicitation and phase-in period.

Attachment 1 - PWS, Section

Attachment 1 - PWS, Section

1.6.5 - Place of Performance, Technical

Please clarify the place of performance. The contract type and focus on staffing suggests that all work is performed at a government facility and parts of the PWS clearly require use of a private provider office location (i.e. contractor site). Please provide examples of a "government Private Provider provided office space".

Please see amendment 0002 for the updated PWS which clarifies that the place of performance is at a Private Provider office space or via Telehealth.

Attachment 1 - PWS, Section

Defense Industrial Security Clearance Office." Please clarify how this clearance requirement aligns with the Security Requirements in Section 1.6.7. A SECRET security clearance is more rigorous and requires much more time to acquire than a NACI.

See Amendment 0002 for the updated PWS section 4.2 - Facility Clearance.

Attachment 1 - PWS, Section

4.2 - Facility Clearance, page 11 Contract

Please clarify the scope of "contractor personnel" who must be granted up to and including possible SECRET security clearance. Does this apply to all providers, nurses, etc.?

Attachment 11 - Technical

Exhibit 3 - Estimated workload Contract

Please clarify the workload content. The level varies from one to five FTE for a nationwide contract which does not appear to be enough capacity - or coverage of all geographic locations.

The workloads and the historical data are estimates. Bidders should use professional knowledge and judgement while developing their proposal.
