ADDENDUM TO 52.212-2

52.212-2 EVALUATION-COMMERCIAL ITEMS (NOV 2021)

1. BASIS OF AWARD:

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation (LPTA in accordance with FAR 15.101-2). Offers that do not conform to the requirements of the solicitation may be rejected without further evaluation or discussions. The following factors shall be used to evaluate offers:

Factor 1 – Technical Subfactor 1 – Company Qualifications Subfactor 2 – Personnel Qualifications Subfactor 3 – Experience

Factor 2 – Past Performance

Factor 3 – Price

Using the Lowest Priced Technically Acceptable (LPTA) process, the Government will evaluate price and the following non price factors: Technical Acceptability and Past Performance. The LPTA process is accomplished through the establishment of minimum requirements to be evaluated on an “acceptable” or “unacceptable” basis. In order to be considered awardable, there must be an “acceptable” rating in every non- price factor/subfactor.

Award will be made to the offeror who has the lowest priced technically acceptable offer. Any vendor listed on the www.epls.gov (excluded Parties Listing) is prohibited from receiving Government awards regardless of technical and pricing factor results.

2. Evaluation Methodology

The Government intends to award a contract resulting from this solicitation to the offeror who is deemed responsible in accordance with the FAR Part 9.1, as supplemented, whose quote conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by the addendum to FAR 52.212-1 “Instructions to Offerors – Commercial Items” of this solicitation) and is judged, based on the evaluation factors and subfactors, to represent the lowest price technically acceptable quote.

Step 1 – The Government will first evaluate all quotes for Total Evaluated Price (TEP) then rank the offerors from lowest to highest TEP. A price fair and reasonable determination will be made on the apparent successful offer prior to award. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement, including the six-month extension available under FAR Clause 52.217-8, Option to Extend Services. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

Step 2 – The apparent lowest price quote will then be evaluated for Technical Acceptability. Quotes must be rated “Acceptable” for all technical subfactors in order to be determined technically “Acceptable”. If the lowest priced offeror’s technical proposal is “Unacceptable,” the next low offeror’s technical quote will be evaluated, continuing until an “Acceptable” technical rating with acceptable performance is identified.

Step 3 – The lowest priced, technically “Acceptable” offeror’s past performance will be evaluated. If the lowest prices, technically “Acceptable” offeror’s past performance is determined to be “Unacceptable,” the Government will evaluate past performance of the next lowest priced, technically acceptable offer. This process will continue, as needed, until an offer is rated “Acceptable” for past performance.

Step 4 – Once the lowest priced technically acceptable offer with acceptable past performance is identified, an evaluation will be conducted of the next lowest priced offer in order to determine technical acceptability. This evaluation is done to establish a basis that the lowest priced offer is fair and reasonable through competition. The Government reserves the right that if the lowest priced, technically “Acceptable” offeror’s past performance is determined to be “Acceptable,” the evaluation process will stop and the award will be made to the offeror, pending the aforementioned price fair and reasonable determination.

3. ADJECTIVAL RATINGS:

3.1 Factor 1: Technical

The Technical Factor shall be evaluated using the following adjectival ratings:

TABLE 2 – Technical Ratings Rating Description Acceptable Acceptable Quotes clearly meets the minimum requirements of the solicitation.

Unacceptable Unacceptable Quotes does not clearly meet the minimum requirements of the solicitation.

3.1.1 Offers will be evaluated to determine compliance with all requirements of the solicitation, including any attachments and exhibits. The evaluation criteria will be applied to all offers in the same manner. Each proposal will be evaluated strictly in accordance with its content; the Government will not assume that performance will include areas not specified in the offeror’s written proposal. An offer must clearly meet all requirements (no partial offers shall be considered) to be considered “technically acceptable”. Technical proposal clearly meets the minimum requirements of the solicitation will be rated acceptable when it demonstrates a sound, rational, effective and efficient technical approach and when the application of the proposed methodology demonstrates:

3.1.2 The Government’s technical evaluation team will evaluate responses to determine either technically acceptable or technically unacceptable (price excluded). In order to be considered technically acceptable, the response for each subfactor must be determined acceptable and must demonstrate a clear understanding of the requirement on all areas described below, in the solicitation and the response must demonstrate a practical/functional technical approach that meets the needs of the solicitation. Failure to meet the criteria will render the response to be technically unacceptable and will not be considered for award.

3.1.2.1 Subfactor 1 – Management Approach

The quotes shall be evaluated against the following technical subfactors:

The Government will evaluate offerors’ proposed methodology for planning, organizing, directing, and controlling its staff in performance of the tasks identified in the solicitation, PWS, and associated attachments. The proposal will be evaluated based on the soundness of the approach, the feasibility of the approach, and the comprehensiveness of the document. An assessment of the proposed management roles, controls, Quality Control Plan (QCP) and communications will be evaluated on likelihood of success, with minimal disruption to schedule and risk to the Government. A detailed approach that demonstrates the offeror’s significant understanding of the program’s objectives, operating environment, and the demands and constraints in regards to the customers supported.

3.1.2.2 Subfactor 2 – Staffing Approach

The Government will evaluate the proposed staffing approach to assess the offeror’s understanding of the requirement to provide personnel with the required knowledge, skills, and qualifications to fulfill the requirements of the PWS to include the ability/capability of the personnel to support the designated position and the ability to designate personnel for assignment to the specific functional areas. The offeror will be evaluated on the reasonableness and comprehensiveness of the approach. The staffing approach will also be evaluated to determine the offeror’s ability to recruit and retain a workforce sufficient to satisfy the requirements stated in the solicitation and associated attachments and reduce performance risk. The staffing approach will also be assessed for the likelihood that the identified staffing approach for key and management support personnel will meet the requirements of the PWS, to include Contract Manager. The staffing approach will also be assessed to determine if the offeror provided a realistic phase-in plan that demonstrates the capability to acquire but not limited to personnel, equipment, material, and supplies to perform PWS requirements from the first day of performance and throughout the duration of the contract.
