52.212-2 Evaluation-Commercial Products and Commercial Services. (Tailored) (Nov 2021)
Evaluation--Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the Lowest Price Technically Acceptable. Failure to meet a requirement may result in an offer being determined technically unacceptable. The following factors shall be used to evaluate offers:
(i) Price. Initially, offers shall be ranked according to price, including any option or additive item prices if applicable. The price evaluation will document the offeror's reasonableness and affordability of the proposed total evaluated price for both the items supplied and the installation and any other costs associated with replacing items listed in the product description.
(ii) Technical. The Government shall then evaluate the five (5) lowest priced technical proposals on a pass/fail basis, assigning ratings of Acceptable, Reasonably Susceptible of Being Made Acceptable, or Unacceptable.
The proposals shall be evaluated against how proposed items meet requirements of product description and timeline of installation. Proposals that do not have SAM registration information ie: UEI and cage code may be deemed technically unacceptable.
(b) Offeror's are cautioned to submit sufficient information and in the format specified. Offeror's may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
