Section H - Special Contract Requirements

GENERAL REQUIREMENTS

VAT Procedures--Estonia

The U.S. Government does not pay Value Added Tax (VAT) or other taxes for goods or services purchased in Estonia. The current method of obtaining this VAT exemption is that contractors on USACE contracts will receive a reimbursement of VAT paid in further of a USACE directly from the Estonian Ministry of Finance (MoF). To properly receive reimbursements the below listed procedures will be followed. Be advised that contractors are responsible for providing accurate and timely information to facilitate VAT reimbursement procedures. USACE will not reimburse contractors for the costs associated with processing VAT reimbursement and will not be liable for any delays associated with VAT reimbursement.

1. As part of regularly submitted invoices, contractors shall include a line item for VAT incurred as part of executing the project (the contractor shall retain sufficient documentation to substantiate the amount of VAT included on the invoice to USACE).

2. USACE will pay contractor invoice exclusive of VAT.

3. USACE and/or the contractor will prepare the attached VAT reimbursement form in two copies for each invoice. The contractor shall prepare the form or provide sufficient information as necessary and at the request of the Contracting Officer Representative

(COR).

4. The contractor shall provide the COR with the name and bank account information for deposit of VAT reimbursement.

5. USACE shall coordinate with the Ministry of Defense for countersignature of each VAT form.

6. USACE will then return the VAT forms to the contractor. One VAT form will be retained by the contractor and one VAT form shall be submitted to the Estonian Tax Authority by the contractor.

7. The Tax Authority will deposit the reimbursement into the contractors account roughly 20 days after USACE submits the reimbursement request.

WORKERS COMPENSATION INSURANCE (DEFENSE BASE ACT) – COUNTRIES WITH

WAIVERS

(a) This clause supplements FAR Clause 52.228-3. The Department of Labor has waived application of the Defense Base Act (DBA) for performance of work by employees other than U.S. citizens and employees recruited in the U.S. in any country listed at the US Department of Labor website here: https://www.dol.gov/owcp/dlhwc/dbawaivers/dbawaivers.htm

Accordingly, this clause applies to work performed by U.S. citizens, employees recruited in the U.S. and also to work by any employee performed in a country for which a Defense Base Act waiver is not in place.

The Department of Labor (DOL) has approved multiple insurance carriers which promote a competitive market environment. Therefore, contractors shall obtain commercially available DBA insurance from a DOL authorized insurance carrier unless the contractor is under a self insurance program approved by the DOL or subject to a waiver. The DOL approved carriers and self insured employers are available at http://www.dol.gov/owcp/dlhwc/lscarrier.htm.

(b) The contractor agrees to insert a clause substantially the same as this one in all subcontracts to which DBA is applicable. Subcontractors shall be required to insert a similar clause in any of their subcontracts subject to the DBA.
