3. The COVID-19 Pandemic has drastically impacted the nation causing many unprecedented challenges on our day-to-day work. The COVID-19 situation has impacted the Army’s and more specific, the MICC Fort Buchanan’s ability to conduct acquisition processes based on normal practices. The following change is intended to assist in the continuation of the acquisition process in a transparent manner. The changes will allow offerors to hand-carried bids while ensuring compliance with social distancing amid COVID-19 Pandemic. A box is provided for hand-carried proposals and is located at the Visitor Control Center (VCC) Fort Buchanan, The Borinqueneers Gate, PR 28 (Goya). Once you arrive at the Borinqueneers Gate, Fort Buchanan (before the gate guard) stay on the far right lane that will lead you to the entrance of the VCC. Hand-carried bids must be deposited in the box prior to the time established for submission of bids. The box will be inside the Visitor Control Center. You will place the bid inside the box. Only the MICC Contracting Office has access to the box key. All individuals must have a picture ID and no substitutions are authorized. Vehicles are also subject to search.

CONTRACTORS ARE CAUTIONED THAT THERE MAY BE DELAYS AT THE GATES AND

SHOULD ALLOW ADEQUATE TIME FOR ENTERING THE INSTALLATION TO ENSURE

PACKAGES ARE RECEIVED PRIOR TO THE TIME AND DATE FOR RECEIPT OF THE BID.

4. EVALUATION OF BIDS: The requirement for the Replacement of A/C at Building 315 at Fort Buchanan Puerto Rico shall be awarded utilizing Sealed Bidding Procedures in accordance with Federal Acquisition Regulation (FAR) Part 14 (FAR 52.214-19), as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS).

Award will be made to the responsible bidder submitting the lowest responsive bid in accordance with requirements and provisions herein. Unit prices shall not exceed two decimal places.

5. The Government reserves the right to reject any BID that is conditioning the quoted price.

6. In order to meet the challenges associated with social distancing, MICC Fort Buchanan will not conduct a site visit. Attachment 2, Site and Equipment Photos provides the location, access and conditions of existing A/C Building 315 at Fort Buchanan.

NOTE: BIDDERS SHALL ENSURE ALL PRICES SUBMITTED FOR THIS REQUIREMENT

CONSIDERED ALL FEDERAL, LOCAL, MUNICIPAL AND ANY OTHER REQUIRED FEES OR

TAXES APPLICABLE TO ANY AREA WITHIN THE FORT BUCHANAN COMMUNITY.

The due date to submit questions is 26 June 2020 at 10:00 a.m. Answers to questions, if any, will be submitted via an amendment to the solicitation. Contractors are encouraged to submit all questions under one email and obtain confirmation of receipt.

1.3 SUPPLEMENTARY DRAWINGS

These supplementary drawings may not be a part of the contract but are included with the drawings for information.

1.3.1 Reference Drawings

The following reference drawings are intended only to show the original construction. Drawings are the property of the Government and shall not be used for any purpose other than that intended by the contract. The drawings are half size. Full-size drawings are available at the bidder's or Contractor's expense. Information on procuring these full-size drawings may be obtained from the Contracting Officer. Full size drawings may be inspected during regular working hours at the office of the Contracting Officer.

Utilities drawings are available for this facility. Contractor may request these drawings at DPW.

Division 01 - General Requirements

SECTION 01 11 00

SUMMARY OF WORK

1.0 Definitions

Throughout the Statement of Work, certain terms Abbreviations and acronyms are used. The definitions for these items are as follows:

A. Contracting Officer: "Contracting Officer" (KO) means a person with the authority to enter into, administer, and/or terminate contracts on behalf of the appropriated fund instrumentality which is party to this contract and make related determinations and findings.

B. Contractor: The person or entity who has been awarded the contract for construction of this project.

C. CFCI: Contractor-Furnished, Contractor-Installed Equipment.

D. COR: Contracting Officer's Representative. The on-site representative(s) of the Contracting Officer with authority to act for the Contracting Officer in areas specified by the letter of designation. COR's name and phone number will be provided once the contract is awarded.

E. DPW: The Directorate of Public Works at Fort Buchanan.

F. Government: "Government" or "entity of the Government" means any entity of the legislative or judicial branch, any executive agency, military department, Government Corporation, or independent establishment, the U.S. Postal Service, or any appropriated fund instrumentality of the Armed Forces. Under this contract, the term "Government' may also refer to other Federal Agencies having jurisdiction under this contract.

G. Offeror: The person or entity submitting a proposal in response to the RFP. After the contract is awarded, this term will refer to the person or entity that was awarded the contract (the Contractor).

1.2 WORK COVERED BY CONTRACT DOCUMENTS

1.2.1 Project Description

The work includes all review and verification of drawings information contained within the package provided, and all supplemental information required to prepare final construction documents for the NEW AIR COOLING CONDENSER CHILLER SYSTEM BUILDING 315 (AFRC) AT FORT BUCHANAN, PUERTO RICO, with criteria as described herein. The information shall include, all aspects of construction in this field, for a quality product which is in compliance with industry codes and standards such as: all new construction; incidental demolition; temporary construction and restoration; relocation of utility features, and accessories; calculations of any alternatives offered; and provision and installation of all fixtures, materials and equipment for a complete and usable facility as desired and intended by the Government as provided criteria herein.

1.2.2 Location

The project is located at building 315 in Fort Buchanan, Puerto Rico. A proposed location map is included in the attached drawings (DPW-PR-0002-20). All prospective bidders are encouraged to visit the site and familiarize with all conditions that might affect the work or cost thereof while not required, a site visit is highly recommended. Any observations that could have been made during a site visit cannot be regarded as a changed condition.

1.2.3 Project Site Overview

Refer to provided reference drawings for specific project site limits. The intent of this project is to replace the existing air cooling chiller system (including, and other incidental work associate to facility for building 315.

1.2.3.1 Site Information

A. PROJECT SITE: The project site is portrayed on drawings included within the package.

B. TOPOGRAPHY: Not Used.

C. VEGETATION: Not Used.

D. UTILITY RESOURCES FOR TEMPORARY FACILITIES AND CONSTRUCTION: Water and power for temporary facilities may be obtained from existing utilities systems by means of connections using meters.

The government will provide connections points but, Contractor will execute the connections. The government may provide non-potable water source as needed, for consumption effort.

E. CLIMATE AND MICRO-CLIMATE: The climate of the general area Fort Buchanan, Puerto Rico is hot and humid.

F. SANITARY FACILITY: The Contractor shall provide and maintain within the construction area minimum field-type sanitary facilities approved by the Contracting Officer. Government toilet facilities will not be available to Contractor's personnel.

1.3 OCCUPANCY OF PREMISES

Facilities and roads on post will remain operational during performance of work under this Contract unless approved by the Government. For A/C equipment disposal and delivery, construction project, Contractor shall provide an MOT Plan for Government evaluation and approval.

Before work is started, arrange with the Contracting Officer a sequence of procedure, means of access, and space for storage of materials and equipment.

1.4 EXISTING WORK

Based on: "Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements" requirements:

a. Contractor shall examine the site and determine for themselves the existing conditions and general character of the site. Claims for additional cost due to conditions that could have been verified by site investigation will not be permitted.

b. Sizes, materials, and capacities of existing utility lines may be verified by site investigation or upon request through the MICC office.

c. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remains.

d. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.

The Government designated four (4) A/C mini split units next to the chiller to be remain in place. Contractor shall protect the designated salvaged material (existing 4 mini split units) and their associated equipment and components until a delivery of the new chiller machine is fully operational and running.

1.9 CODES AND STANDARDS

1.9.1 GENERAL:

A. The project shall be constructed in accordance with the applicable codes, standards, parameters or regulations noted in this section or other sections of the request. In the event of conflict between codes, standards, or regulations, the most stringent requirement shall apply.

B. Reference to standard specifications of any technical society, organization, or association, or to codes, manuals or regulations of Federal, State, or local, authorities shall mean the latest standard, code, manual, regulation, specification, or tentative specification adopted and published at least 30 days prior to submittal of proposals, unless specifically stated otherwise.

C. The reference of any code or standard listed below to the “building official” or the authority having

“jurisdiction” or “governmental authority” shall be interpreted to refer to the Contracting Officer as being the authority for code interpretation.

1.9.2. BASIC REQUIREMENTS:

A. GENERAL: Construction shall be in accordance with the following codes, standards, and regulations. The most stringent shall govern when differences occur.

1) Building, Structural, Plumbing and Mechanical Codes: the latest edition of the Standard Building, Plumbing and Mechanical Codes and the Puerto Rico State Building, Plumbing and Mechanical Codes.

2) Electrical Codes: National Electrical Code, latest edition. National Electrical Safety Code, latest edition. NFPA and National Safety Code.

3) National Fire Protection Association Fire Codes, latest edition, and MIL. HANDBOOK 1008A, Fire Protection for Facilities (copies provided upon request).

4) Applicable OSHA Standards and Regulations.

5) Applicable International Mechanical Code, International Plumbing Code, ASHRAE, SMANCA and Air Quality

Standards, Codes and Regulations.

B. STRUCTURAL: In addition to the general requirements stated above, structural will meet the latest editions of the following codes, standards, and specifications:

1) The Aluminum Association, “Specifications for Aluminum Structures.”

2) American Iron and Steel Institute (AISI), “Specifications of Cold-Formed Steel structural Members.”

3) American Welding Society (AWS), “Structural Welding Code.”

4) American Society for Testing Materials (ASTM) as noted.

5) Metal Building Manufacturers Association (MBMA), “Low Rise Building Systems Manual.”

6) Steel Deck Institute (SDI), “Publication 25” and “Diaphragm Manual.”

7) Steel Joist-Institute (SJI), ‘Standard Specifications, Load Tables and Weight Tables for Steel Joists and Joists

Girders,” 40th or latest Edition.

C. ARCHITECTURAL: In addition to the general requirements stated above, architectural construction will meet the latest editions of the following codes, standards, and specifications.

D. PLUMBING AND MECHANICAL: In addition to the general requirements stated above plumbing and mechanical construction will meet the latest editions of the following codes, standards, and specifications:

1) Exterior and interior water lines shall meet American Water Works Association (AWWA) and latest version of the International Plumbing Code (ICP) specifications for the service required. Domestic water lines, if plastic, shall bear the NSF seal.

2) All mechanical equipment provided, furnished and installed shall be in compliance with local codes and ordinances and the applicable codes and standards of the National Sanitation Foundation (NSF), the National Fire Protection Association (NFPA), the Underwriters Laboratories (UL) and the American Standard Plumbing Code.

3) Plumbing shall be installed in accordance with the latest edition of the National Standard Plumbing Code.

4) The proposed work shall be analyzed for fire code compliance utilizing the National Fire Protection Association

(NEPA) standards.

E. HVAC: In addition to the general requirements stated above HVAC construction will meet the latest editions of the following codes, standards, and specifications:

1) If encountered electrical, communication or other utilities obstructing the passage of the ductwork or refrigerant lines, Contractor shall provide alternatives or a feasible solution for Government evaluation and approval.

2) Insulation, control systems, dampers, smoke detectors and A/C equipment shall follow the Building, International Building Code, and Department of the Army Energy Guidance’s.

F. ELECTRICAL: In addition to the general requirements stated above, electrical equipment shall conform to the requirements of the National Electrical Code (NEC), American Institute of Electrical Engineers, American Standards Association, National Electrical Manufacturers Associations and Underwriters Laboratories, Inc.

G. FIRE PROTECTION: Fire protection shall be in accordance with the Standard Building Code (SBC), NFPA

National Fire Protection Association Codes and Standards, current edition as of the date of the contract.

H. PAVEMENTS AND ASSOCIATED SITE ELEMENTS: Construction specifications shall be in accordance with the Puerto Rico Department of Transportation Standards and Specifications.

1.9.3 TECHNICAL ORGANIZATIONS AND REGULATORY AGENCIES:

Throughout the Construction Industry including master specification guides developed by United States Army Corps of Engineers, Construction Specifications Institute and the American Institute of Architects, certain acronyms and/or abbreviations are used to refer to various technical and regulatory organizations which provide standards for their respective trade. The following acronyms and abbreviations are defined to mean the listed organization, and are provided for the Contractor’s convenience, to be used as applicable, based on the nature of the work trade. PART 2 PRODUCTS, SUBSTITITIONS AND OTHER REQUIREMENTS

2.1 PRODUCTS

A. In its proposal, the Contractor will specify products by referenced standards and/or by manufacturer's name, model number, or trade name.

B. When specified only by referenced standard, the Contractor may submit any product meeting this standard by any manufacturer to Contracting Officer for approval.

C. Products listed in this request, by manufacturer's name, model number, or trade name has been so listed for guidance purposes.

2.2 SUBSTITUTIONS - NOT USED

2.3 FUNCTIONAL REQUIREMENTS

2.3.1 GENERAL:

A. The criteria for the Contract for Direct Expansion-Air Cooled Screw Chiller Replacement for Bldg. 315 at Fort Buchanan, Puerto Rico provided herein represents the desired features and minimum construction requirements for this project. This criteria is not, however, intended to restrict the Contractor from providing quality-based alternatives to achieve the objectives desired.

B. Additional functional and information is provided in this and following sections.

C. Independent consultation with the User/Using Agency and the Installation concerning the functional requirements prior to award is prohibited since evaluation of proposals will be based on requirements stated in the requirement.

Verification of data can be obtained by contacting the Contracting Officer.

2.3.2 SITE DEVELOPMENT

A. Site development includes what is necessary for the Direct Expansion-Air Cooled Screw Chiller replacement for Bldg. 315, modification of utilities impacted (such as: storm water, sanitary sewer, potable water, communication system, concrete surface repairs, painting and electrical), as well as clean-up of the site from demolition and construction activities.

2.3.3 WORK STAGING AREAS

A. Contractor shall obtain approval from the Contracting Officer’s Representative (COR) for all work staging areas prior to the beginning of any work at the project site. All materials and equipment shall be stored in the designated and approved work staging areas only. The Contractor must define the number, size and location of the desired areas for approval. Subsequent changes must also be approved by the COR prior to use. The Contractor’s material storage areas shall be surrounded by security fencing.

B. DISPOSAL: All trash and construction debris must be disposed of off-post at the Contractor’s expense.

Disposal must follow EPA guidelines and be hauled to a licensed disposal site. Contractor must submit receipts to Contracting Officer as proof of disposal.

2.4 GENERAL REQUIREMENTS

2.4.1 GENERAL:

A. Upon award of the contract and Notice to Proceed (NTP), Contractor shall perform all necessary civil, structural, mechanical, and electrical systems in accordance with the requirements and parameters established in this requirement.

B. During the performance of this contract, Contractor shall comply with all federal, state, local, and installation environmental laws, regulations, policies, and standards. The Contractor will determine what permits are needed, prepare permit applications and submit same to the proper state/federal agency. The Contractor shall pay all application fees and shall include the cost of said fees in the price proposed for the work. A copy of each permit will be forwarded to the DPW Environmental Division.

2.4.2 DEMOLITION

A. The project shall include selective demolition of some existing structures and utilities located in the site for the replacement of the Direct Expansion-Air Cooled Screw Chiller system.

B. Demolition of structures of Air Conditioning system may include:

1) Existing Air Cooled Chiller including, electrical and plumbing connections, compressors, condensers, control system, curbs and attached power disconnect switch and recycling of refrigerant.

C. All demolition conducted on site shall satisfy the applicable environmental regulations including but not limited to: hazardous materials, disposal regulations, dust and debris control, safety (ANSI A106), and protection of unaffected work.

D. Demolished materials shall become the property of the Contractor unless noted or determined to be reused or turned over to the Using Agency and shall be the Contractor’s responsibility to dispose of.

E. Contractor shall promptly clean up any spillage from adjacent areas in accordance with local ordinances.

2.4.3 SITE UTILITIES

A. Existing utilities along the project site shall be detected, marked and protected, from being damaged by the required new work.

2.4.4 FENCING

A. No fences shall be damaged by the required new work.

2.4.5 NEW CONSTRUCTION

A. Contractor shall provide an efficient Direct Expansion-Air Cooled Screw Chiller System similar to existing characteristics and capabilities to the existing chiller. Also, contractor shall provide a new control system capable to control and monitor the existing air handling units (AHU) dedicated to reads temperatures and relative humidity per spaces. Contractor shall provide a chiller machine capable to fit in the existing concrete slab of the facility Bldg. 315.

B. The new control system shall have a main controller, field equipment controller (FEC) and input/output module (IOM) expansion devices to integrate, communicate and control the 10 existing AHU and 1 pump to the web-based Metasys system. Contractor shall perform the programming of all 11 devices and shall provide the associated cables to those devices for proper installation.

C. The air conditioning chiller machine shall have an external dedicated power disconnect switch NEMA 4X.

D. Contractor shall provide mechanical and electrical equipment and components classified as Energy Star product.

E. Contractor shall provide the necessary configuration to ensure the airflow intended to be delivered from the new

Direct Expansion-Air Cooled Screw Chiller machine meet the parameters, standards and requirements of the original air conditioning construction. Contractor shall test, adjusting and balance the new Direct Expansion-Air Cooled Screw Chiller system to make sure the existing capacity for each supply and return grilles remain the same as were designed originally. Also, Contractor shall provide an official report by a certified technician demonstrating that the system is in compliance with local and federal standards, codes and regulations. The report shall indicate the amount of volume (CFM’s) tested, adjusted and balanced at the discharge point of the new Cooled chiller.

F. Contractor shall provide and install every electrical equipment and connection as indicate on drawings (sheets E-1 and E-2).

G. The contractor shall repair and paint any structure affected by the work of the new air conditioning system, finished in the same or better way than the existing one.

H. For ALL equipment presented in submittals, Contractor shall comply with the Buy American Act.

I. Contractor shall provide a communication protocol system for Chiller machine compatible and capable to be monitored into our BacNet MSTP network. Also, shall provide and install all the necessary equipment to be fully operational and functional.

J. Contractor shall rent a chiller with the same capabilities and parameters to the existing chiller machine while is performing the installation, calibration, programming and set up of the new Direct Expansion-Air Cooled Screw Chiller machine. Contractor shall provide the electrical and water connections and delivery and pick up of the rental chiller machine. Contractor shall locate the rental chiller outside of the existing chain link fence.

2.4.6 NEW UTILITIES

A. New layout of the utilities impacted shall be inspected and tested according to parameters established in applicable local and federal codes and standards.

2.4.7 STORM WATER MANAGEMENT AND DRAINAGE - NOT USED

2.4.8 DELIVERIES OR PERFORMANCE

A. PERFORMANCE TIME

Contractor shall have 120 calendar days to complete the entire project.

1. CONSTRUCTION PHASE shall not exceed (120) Calendar days from Notice to Proceed. The completion time specified includes final clean-up of the premises. If the project is delayed because of Government requirements, the Contractor shall be provided an equal amount of time added to the completion date.

2.4.9 SPECIAL CONTRACT REQUIREMENTS

A. CONTRACT QUALITY CONTROL/QUALITY ASSURANCE

1) Definitions:

a. Contractor Quality Management System (CQMS): The means by which the contractor assures himself that his construction comply with the requirements of the contract.

b. Contractor Quality Control (QC): The Contractor’s inspection, examination and control of his own, his suppliers’, and his subcontractor’s work and activities to ensure compliance with contract requirements.

c. Contractor Quality Assurance (QA): The means by which the Contractor fulfills his responsibility for assuring that the QC system is functioning effectively.

2) General: The Contractor shall establish and maintain an effective quality management system in compliance with contract clauses. The CQMS consists of a plan, procedures, and organization necessary to provide a materials, equipment, workmanship, fabrication, construction and operations which comply with contract intent and specific requirements. The system shall cover construction functions, both on site and off site, and shall be keyed to the proposed construction sequence. The contractor will designate a Professional Engineer as the responsible CQMS authority. Different professionals may be assigned QC responsibilities for the construction phases under supervision of the QC Chief. Quality management personnel shall also be charged with the responsibility of overseeing the Contractor’s Safety Program. This duty will be clearly set forth in the CQMS documentation.

3) Quality Management Plan: The plan will include as a minimum:

a. A description of the quality management organization.

b. The number, classifications, qualifications, duties, responsibilities and authorities of personnel.

c. The method of construction review proposed to assure that the construction meets all contract intent and specific requirements.

d. Procedures for processing, reviewing, and approving shop drawings, and other submittals.

e. Documentation format for QC activities and testing.

4) Coordination Meeting. As soon as practicable after contract award and before start of performance, the

Contractor shall conduct a conference call with the Contracting Officer and discuss the CCMS, if deemed necessary. A copy of the letter, signed by the Contractor or an authorized official of the company, which describes the responsibilities and delegates the authorities of the Chief of Quality Management will be furnished to the Contracting Officer within 10 days of contract award.

5) Notification of Changes: After acceptance of the QC plan, the Contractor shall receive the Contracting Officer’s approval in writing of any proposed change to his QC system or QC personnel.

6) Corrective Action: At any time it is determined by the Contracting Officer that the QC system, personnel, instructions, controls, tests, or records are not providing construction which conforms to contract requirements, the Contractor will be required to correct the deficiency, i.e. replacement of personnel, additional QC inspections, etc.

B. WORK HOURS: Contractor will be permitted to work during the hours of 7:00 am - 4:00 pm, Monday through

Friday, excluding federal holidays, unless otherwise coordinated. As much as is practicable, work must be planned and cleaned up at the end of each work day. Contractor must coordinate work schedule closely with COR and the facility manager to minimize any business disruptions. If Contractor determine that is practicable to performed work outside of normal duties Hours, it is his responsibility to officially request in writing for Government Consideration. Contractor shall not, at any time, performed work outside of normal duty hours without the proper approval of the Government.”

C. CONSTRUCTION SUPERVISION: The Contractor shall provide direct on site supervision or assign and have on the work site at all times a competent superintendent, in which shall have a minimum of 5 years of experience and competent within HVAC area, executed projects over a $1,000,000 and has the authority to act for the Contractor during the performance of this contract and until the work is completed and accepted.

Recommend include something like: “Contractor is responsible to provide a superintendent knowledgeable in the work to be performed under this contract. Individual shall have the expertise required to perform this tasks efficiently. Required to communicate effectively in English and Spanish language. Also, Contractor is responsible to maintain good communication with the Government at all times.” Contractor shall submit the appointment of the superintendent to the Contracting Officer in writing prior to beginning work.

D. INSTALLATION RULES & REGULATION: The contractor shall be responsible for complying with the Fort

Buchanan Rules and Regulations to include registering vehicles with the Provost Marshall.

E. CONTRACTOR PERSONNEL REQUIREMENTS:

a. Trainings and Basic Requirements

1) Notwithstanding the provisions of the General Clauses entitled "Identification of Employees 1965 Jan", the

Contractor will be required to coordinate with the Contracting Officer, background checks and clearance for his personnel in order to have access to the military installation and the job site. Contractor is responsible for providing adequate identification of his personnel while accessing the military installation.

The Contractor shall provide a current personnel roster listing all employees and the last four numbers of social security number for each to the Contracting Officer 10 days after contract award in conjunction with Background Check Form DD form 369 (most current version). Also, Contractor is responsible to submit any changes immediately for approval. No new employee shall be assigned to the contract without the proper clearance or certifications required exclusively for work in connection with this contract.

Approved access are provided annually. Once the Contracting Officer execute the Option Period a new DD Form 369 is required to renew the access for another year. Any background that comes with remarks needs to be address by the correspondent employee and resubmit for clearance. Failure to pass background check will denied access to Fort Buchanan automatically. Waivers are not allowed under this section.

ALL NON-US GARRISON ID CARD APPLICANTS WILL PROVIDE A VALID AND ORIGINAL FORM

OF ID (STATE DRIVER’S LICENSE, PASSPORT, AND SO FORTH, WHICH COMPLIES WITH

PUBLIC LAW 109-13 (THE REAL ID ACT OF 2005)). THIS IS TO PROVE IDENTITY (FOR ENROLL-

MENT INTO THE AIE DATABASE IF AVAILABLE) AND ISSUE A VISITOR PASS OR CARD.
