2.0 National Guard (NG) Agency Protest Program:
NG Agency Protest Program is intended to encourage interested parties to seek resolution of their concerns with the National Guard (NG) as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office (GAO) or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods as if filed at the GAO. The NG protest decision goal is to resolve protests within 35 calendar days from filing. An agency protest may be filed with either the Contracting Officer or the NG Agency's Protest Decision Authority, but not both, in accordance with NG protest procedures.
To be timely, the protests must be filed with the periods specified in FAR 33.103. To file a protest under the NG Agency Protest program, the protest must request resolution under that program and be sent to the address below:
National Guard Bureau
Office of the Director of Acquisitions/ Head of Contracting Activity
ATTN: NGB-AQ-O
111 S. George Mason Dr.
Arlington, VA 22204
Email: ng.ncr.ngb-arng.mbx.ngb-task-order-ombudsman@mail.mil
All other agency-level protests should be sent to the Contracting Officer for resolution at the address in the solicitation.

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
1. Technical Approach - the offeror's technical proposal will be evaluated against the items in PWS paragraph 5. The Government will evaluate the technical proposal to ensure a complete understanding of the services to be performed and to ensure the offeror's approach successfully aligns with the Government's expectations. Failure to present a concise and coherent approach to the tasks in PWS paragraph 5 shall render the offeror's technical proposal unacceptable.
2. Past Performance - The Government shall obtain recent (last 3 years) and relevant CPARS for each Offeror. Any recent or relevant CPARS for any Offeror found with Marginal or below ratings in any rated area for the past three years for similar services shall render the Offeror's past performance unacceptable. If any Offeror does not have recent and relevant CPARS, they may submit past performance of up to 5 previous contracts for the Government's consideration.
3. Price - The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the base year. Evaluation of options shall not obligate the Government to exercise the option(s). This evaluation will also evaluate the potential extension of services under FAR 52.217-8 (Option to Extend Services). As part of the price evaluation, the Government will evaluate the Option to Extend Services under FAR Clause 52.217-8 by adding one-half of the offeror's final option period price to the offeror's total price. Thus, the offeror's total price for the purpose of the evaluation will include the base periods, total of options, and one-half of the last year option to determine the price basis.. The Government may evaluate the Offeror's proposed price using the techniques defines in RFO FAR 12.204(b) in order to support the determination of reasonableness.
Technical is more important than Past Performance. All non-priced factors, when combined, are significantly more important than Price.
(b) Options (not applicable).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) Basis for award. Award will be based on a determination of best value to the Government, price and other factors considered. "Best Value" means the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit in response to the requirement. Because this is a Best Value procurement using a Tradeoff, the Government may award to other than the lowest priced Offeror. However, the Government will not make an award at a significantly higher price to achieve only slightly superior performance capability. To that end, as non-Price factors approach equality from a qualitative perspective, Price will become a more determinative factor.
