52.212-2 Evaluation-Commercial Products and Commercial Services. (Tailored) (Nov 2021)

Evaluation-Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a fixed price contract resulting from this solicitation. Quotes will be evaluated for technical acceptability utilizing the following factors and the award will go to the lowest priced technically acceptable quote.

Factor1 - Health Inspection Report: One legible copy of the state or local government health inspection report for the proposed food preparation facility, if and as required by state and local regulations. The health inspection shall be conducted less than 12 months from the quote submission due date. The facility must have received a score of "A" or "B"; 85 or above" or "pass", if pass/fail inspection system is used. The score must be clearly annotated on the report. Failure to provide an acceptable health inspection report will render the quote submission unacceptable.

Factor 2 - The Government will evaluate past performance on an acceptable/unacceptable basis to determine past performance acceptability. The past performance evaluation is an assessment of the offeror's probability of successfully performing the required effort; therefore, past performance evaluation is not a determination of contractor responsibility.

The past performance assessment is based on the offeror's record of recent and relevant past performance with respect to the services specified in the solicitation requirements. There are two aspects to the past performance evaluation: (1) the recency and relevancy of the past performance, and (2) the quality of that past performance. Past performance is recent if it is within the previous 36 months. Past performance is relevant if it involves contracts valued at a minimum of $25,000.00.

Adjectival Rating Description

Acceptable Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown (See note above).

Unacceptable Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of a company without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the company may not be evaluated favorably or unfavorably on past performance but shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

(b) Options. The Government will evaluate quotations for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quotation is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(End of provision)

52.217-8 Option to Extend Services. (Nov 1999)

Option to Extend Services (Nov 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within the current contract performance.

(End of clause)

52.217-9 Option to Extend the Term of the Contract. (Mar 2000)

Option to Extend the Term of the Contract (Mar 2000)

The Government may extend the term of this contract by written notice to the Contractor within the current contract period; provided that the (a) Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

If the Government exercises this option, the extended contract shall be considered to include this option clause.(b)

The total duration of this contract, including the exercise of any options under this clause, shall not exceed three years.(c)

(End of clause)

52.252-6 Authorized Deviations in Clauses. (Nov 2020)

Authorized Deviations in Clauses (Nov 2020)

(a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the date of the clause.

(b) The use in this solicitation or contract of any Defense Federal Acquisition Regulation Supplement (48 CFR 2) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the name of the regulation.

Addendum to 52.212-1, Instructions to Offerors - Commercial Products and Commercial Services

REQUEST FOR QUOTE (RFQ) - FAR 52.212-1 ADDENDUM

THIS REQUEST FOR QUOTE (RFQ) IS ISSUED AS A COMMERCIAL ACQUISITION USING A COMBINATION OF FEDERAL

ACQUISITION REGULATIONS (FAR) PARTS 12 AND 13.

FAR 52.212-1(c) is replaced with:

The Vendor shall agree to hold the prices in its quote firm for 90 calendar days from the date specified for receipt of quotes.

I. Instructions to Vendors:

Vendors shall submit quotes and questions regarding this RFQ solicitation via email to:

Contract Specialist: tara.e.glass.civ@army.mil

Contracting Officer: darrell.e.may.civ@army.mil

Questions shall be submitted to the Contract Specialist and Contracting Officer no later than 10:00 am Eastern Time (ET) on December 30, 2025, to allow time for a written response. No remarks or written responses to questions by government personnel shall change or qualify any of the terms or conditions of this RFQ. The RFQ may only be changed by a formal written amendment issued by Mission and Installation Contracting Command (MICC) Fort Knox, Kentucky.

II. Quote Submission Requirements:

a) Vendors shall ensure all required documents are attached with their quotation, only documents in .pdf format will be accepted. Attachments submitted in a format other than .pdf and documents accessible only through hyperlinks will be considered non-compliant.

b) One legible copy of the state or local government health inspection report, if and as required for the proposed food service preparation facility. The proposed food service preparation facility is to be used for the duration of the awarded contract unless a change is approved by the Contracting Officer. The health inspection shall be completed less than 12 months from the date quote submissions are due. The facility must have received a score of "A" or "B"; 85 or above or "pass", if pass/fail inspection system is used. The score must be clearly annotated on the report. Failure to provide an acceptable health inspection report will render the quote non-compliant.

c) One copy of any required subcontractor agreement, fully executed by both the prime contractor and the subcontractor (if any portion of the effort is to be subcontracted). Any use of subcontractors shall have a written agreement. Verbal agreements are not acceptable. If the effort will not be subcontracted and the prime contractor name and/or address do not match the name and/or address on the provided health inspection report, a technical description shall be provided in sufficient detail explaining why there is a difference in names and locations. This description may include other documents if necessary. Failure to provide a signed subcontractor agreement or a further detailed explanation (as described above) will render the quote non-compliant.

d) Unit prices in the quote shall be completed using the Contract Line-Item Number (CLIN) schedule in the RFQ (NOTE: failure to quote on all items may render the quote non-compliant and the quote may not be considered). Vendors shall submit all unit prices to the whole penny; any fractions will be rounded to the next higher whole penny per unit for evaluation and award purposes.

e) Award will be made to a single Vendor who is deemed responsible in accordance with the FAR, whose quote conforms to the solicitation requirements, and whose quote, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Priced Technically Acceptable quote.

f) Trade-offs between cost/price and non-cost/price factors are not permitted. The Government will evaluate proposed prices for reasonableness using price analysis techniques in accordance with the guidelines in FAR 15.404-1(b). Proposed prices evaluated as unreasonable may be grounds for eliminating a quote from competition.
