PART 1 - DESCRIPTION OF WORK
1.1. Objectives. Remove existing roof system at building 633 and provide a new asphalt roof shingle roof system including some wood plank deck replacement, new self-adhering underlayment, new asphalt roof shingles. Install in accordance with roofing manufacturer's recommendations. Provide a 30-year manufacturer's warranty with a 120-mph wind speed coverage. Building 633 is a historical building. Therefore, the Environmental Division (ED) - Historic Preservation Program shall review and approve all material submittals for accessories, sealants sheet metal, replacement soffit, replacement fascia, paint colors, roof shingles, etc. before contractor can start work. The Contractor shall provide all work, labor, materials, related fees, and related services for construction requested herein until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract, by the Government in a professional and collaborative environment to sustain mission requirements. Construction services and finished products shall be delivered on schedule, safely, and compliant with regulatory codes and standards.
1.2. Period of Performance. The period of performance shall be one hundred and twenty days (120) calendar days after issuance of Notice to Proceed
(NTP).
1.2.1. The Contractor shall not commence work unless authorized by the Contracting Officer (KO). All technical questions shall be addressed to the Contracting Officer's Representative (COR) for resolution and clarification.
1.3. Place of Performance. The work to be performed under this contract will be performed at Building 633, Taylor Rd, located within the Fort Bliss TX Installation.
1.3.1. Occupancy: Facility will be occupied during construction. Do not enter the facility without prior approval of the KO.
1.3.2. All work shall adhere to and comply with the 2021 ICC, the Unified Facilities Criteria (UFC) https://www.wbdg.org/ffc/dod/unified-facilities-criteria-ufc (military amended codes), NFPA 101 Life Safety Code, the Architectural Barriers Act (ABA) and all other Local, State and Federal Regulations, Codes, and Standards. All Unified Facilities Guide Specification (UFGS) shall be used for this project (https://www.wbdg.org/guides-specifications).
1.4. Specific Work Requirements.
1.4.1. General.
1.4.1.1. Contractor shall ensure safe access to and egress from building and other adjacent occupied or used facilities during construction and shall provide all required barricades, fencing, covered walkways, planking, lighting, bracing, shoring, warning signs, etc. as required by Occupational Safety and Health Administration (OSHA) and Fort Bliss Regulations for the protection of workmen, staff and users.
1.4.1.2. The exact location and quantity of existing ductwork, penetrations, and equipment shall be field verified by the Contractor. Contractor shall examine existing structures, note all conditions as to character and extent of all work involved, validate and bid accordingly.
1.4.1.3. Contractor shall field verify all dimensions, exact locations and quantities before commencing Work.
1.4.1.4. Contractor shall protect building to be re-roofing, adjacent buildings, walkways, site improvements, exterior plantings, and landscaping from damage or soiling from restoration operations. The contractor shall restore any items disturbed or damaged during construction to a condition equal or better than existing at no cost to the government.
1.4.1.5. Pollution Control: Comply with DPW Environmental regulations. Limit spread of dust and debris. Remove and transport debris in a manner that will prevent spillage on adjacent surfaces and areas. Lower removed roofing materials to ground and onto lower roof levels and/or grade level using dust-tight chutes or other acceptable means of removing materials from roof areas.
1.4.1.6. The contractor shall limit construction loads on the roof to the rooftop equipment loads and uniformly distributed loads. Construction loads shall not exceed recommendations of Contractor's Professional Engineer based on a site inspection and analysis.
1.4.1.7. Weather Limitations: Proceed with re-roofing preparation only when existing and forecasted weather conditions permit Work to proceed without water entering existing roofing system or building. Remove only as much roofing in one day as can be made watertight in the same day.
1.4.1.8. Daily Protection: Coordinate installation of roofing so insulation and other components of roofing system not permanently exposed are not subjected to precipitation or left uncovered at the end of the workday or when rain is in the forecast.
1.4.1.9. The contractor shall not leave the building with any open penetrations. Any water or other damages caused by the contractor's negligence shall be the responsibility of the contractor to repair prior to completion of this project.
1.4.1.10. Temporary Weather Protection: During removal operations, have sufficient and suitable materials on-site to facilitate rapid installation of temporary protection in the event of unexpected rain.
1.4.1.11. All work is subject to inspection and testing by the Government at all places and at all reasonable times before acceptance, in accordance with FAR 52.246-12, Inspection of Construction. Government inspections and tests do not relieve the Contractor of the responsibility for providing adequate quality control measures, nor does it constitute or imply Government acceptance of the work. The presence or absence of a Government inspector does not relieve the contractor of complying with the specified requirements, nor is the Government inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.
1.4.1.12. The new roofing surface shall be cleaned of oils, adhesive, and debris by the Contractor before Final Inspection.
1.4.1.13. The Contractor shall obtain and submit the latest written Site Clearance and Line Markings Permit (SCLMR) prior to any ground disturbance. This is an extended process and should be submitted soon after Contract is awarded. See section 2.11.2.10. for more information.
1.4.1.14. The contractor shall comply with the Fort Bliss Fire Prevention Construction guide.
1.4.2. Hazardous Material (Asbestos/Lead).
1.4.2.1. The Contractor shall review the asbestos and lead survey reports provided with this SOW to determine if any asbestos and lead containing materials will be impacted by this project. The contractor shall inform KO and COR if any asbestos and lead containing materials will be impacted during construction. The contractor shall hire a lead certified Licensed Company by the State of Texas if any material will need to be abated prior construction and submit test results. Abatement plan to be submitted to the Government for review and approval prior to execution. Contractor to follow all State and Local requirements for Abatement.
1.4.3. Architectural.
1.4.3.1. Building 633 is a historical building and the Environmental Division (ED) - Historic Preservation Program Specialist approval coordinated through the COR is required for all new materials and paint colors. Custom paint color matching may be required as part of this project. New material profiles, dimensions and textures may be required to match existing. Paint colors may require custom color matching. Existing building character defining features shall be protected before, during and after construction. Character defining features include but are not limited to ridge vents, chimneys, existing fascia/double fascia profiles, beadboard soffit profiles, entablature (cornice (including dentils), frieze, architrave), and porch headers and columns. Work shall be performed with care so as not to damage the historical building and features. The Fort Bliss Historic Preservation Specialist/Architectural Historian and COR shall discuss the historical significance and value of the building with the Contractor and subcontractors before Construction begins.
1.4.3.2. Remove existing roofing system, including all flashing, down to structural wood plank deck and provide a new asphalt shingle roof system and self-adhering underlayment. Clean and prepare surface for new roofing system. Provide a six-nail pattern at each shingle installation. Contractor must comply with the Unified Facilities Criteria (UFC) for roofing (UFC 3-110-03 Roofing, with Change 5). Installer shall be certified by the proposed manufacturer for at least the previous five years. Warranty to include: 1-year installer's warranty, 30-year no dollar limit manufacturer's watertight warranty, 20 year no dollar limit finish warranty, 20-year base metal or "material" warranty, 5-year "No Penal Sum" warranty.
a. Install asphalt shingle roofing system. Asphalt shingles: Owens Corning Duration shingles or approved equal. Color to match Owens Corning "Onyx Black". Self- adhering underlayment as manufactured by Owens Corning, "Titanium PSU30" or approved equal.
1.4.3.3. Contractor to include 500 SF of wood plank roof deck replacement, and/or infill including additional wood blocking. New planks shall be equal in dimension to existing roof planks. Contractor to field verify deck is sound and dry. Contractor to inspect for areas of deterioration and damage. Replace areas that exhibit signs of deterioration or other conditions detrimental to securement of roofing system components, including roof edge flashings. If broken or loose fasteners that secure deck panels to one another or to the structure are observed or if deck appears or feels inadequately attached, notify the COR immediately.
1.4.3.4. Remove all existing sheet metal to include flashing, counterflashing, stepped flashing, etc. at all existing pipe penetrations, exhaust fan, roof vents, chimneys, parapets, etc. Prepare for new flashing. Provide new 26-gauge, prefinished galvanized steel sheet metal, dimensions and profiles to be equal to existing. Contractor to field verify existing dimensions. Provide continuous sealant at all joints.
1.4.3.5. Contractor shall provide continuous sealant at all existing pipe penetrations, flashing, vents, etc.
1.4.3.6. Remove and provide all new woof soffit boards, prime and paint (two coats). New wood dimensions to be equal to existing. Contractor to field verify existing soffit dimensions and profiles. Soffit materials to be approved by the ED Historic Preservation Program Specialist prior to construction.
1.4.3.7. Remove and provide all new wood fascia boards, prime and paint (two coats). New wood dimensions to be equal to existing. Contractor to field verify existing fascia dimensions and profiles. Fascia materials to be approved by the ED Historic Preservation Program Specialist prior to construction.
1.4.3.8. Scrap, prime, and paint (two coats) existing soffit over porch including frieze, architrave, and header. Prepare exterior wood for painting, thoroughly clean the surface, scrape off loose paint, address any damage (rot, cracks), sand for a smooth finish, fill any gaps or holes, prime the wood, and then apply exterior wood primer and two coats of exterior wood paint. Contractor to identify areas of wood that need replacement and review with the Government. Protect existing light fixtures during construction.
1.4.3.9. Repoint all masonry chimneys, use 'O' type mortar. Newly pointed mortar shall match adjacent, clean historic mortar in color, texture, aggregate, hardness, profile and workmanship. Materials to be approved by the ED Historic Preservation Program Specialist prior to construction.
1.4.3.10. Repair all existing sandstone chimney caps with two-part concrete epoxy.
1.4.3.11. Provide and install stainless steel chimney caps with bird screen.
1.4.3.12. Provide tapered insulation crickets at high sides of all roof mounted equipment, skylights, corners, etc. and along walls as required to provide positive drainage. Slope for all crickets shall match the adjacent roof assembly.
1.4.3.13. Provide new permanent 'D' ring type fall protection roof anchors. Minimum 5,000 lb (22.2 kN) tensile strength. Anchors shall be installed prior to roof system installation. Coordinate with the manufacturer to ensure installation will not void the roof warranty. Installation of permanent anchors to comply with OSHA 1926.502(d)(15) and should be designed and installed with the oversight of a Qualified Person for Fall Protection.
Contractor to include the cost of wood blocking required to meet OSHA standards fall protection standards.
1.4.3.14. Protect all existing roof top equipment to include antennas, lightning protection, exhaust fans, HVAC, evaporative units, water, gas and electrical lines, etc. during construction. Remove if necessary to allow for construction and reinstall once construction is complete. Coordinate with government representative and building personnel prior to disconnect any equipment. Contractor to test lightning protection and antennas to ensure that equipment is working properly. Any lighting protection that is removed during construction shall be reinstalled by a UL Certified Lightning Protection Professional (Journeyman).
1.4.4. Structural. Not Applicable.
1.4.5. Civil. Not Applicable.
1.4.6. Fire Protection. Not applicable.
1.4.7. Electrical.
1.4.7.1. The contractor shall utilize extreme caution when working on the roof, there is 35 feet of #4 triplex service wire east of the building. The contractor should ensure that the workers are 10 feet away from Rio Grande Electric service wire. The contractor should submit a Demand Maintenance Order (DMO) through the Service Order Desk to RGEC if a cover up (rubber blanket) is required at least three days prior.
1.4.7.2. Electrical work will be required for the removal and reinstallation of the HVAC units. Electrical reconnections shall be made in accordance with all current and applicable Codes.
1.4.7.3. Provide weatherproof exterior junction boxes, when required.
1.4.8. Telecommunications.
1.4.8.1. Furnish incidental work and materials to disconnect, remove, store, secure, protect, and reinstall applicable roof telecommunication equipment, connections, and features. Protect temporary terminations. Any communication cable either Fiber or Copper coming in aerially into the building will need to be decommissioned, prevented from being damaged, and re-installed per the current Installation Information Infrastructure Architecture (I3A) and UFC Army regulations and standards. Any damage or cut cables will be reported to The Project Manager Network Enterprise Center (NEC). Operations & Plans Branch via the COR.
1.4.8.2. Current I3A Army Communication Standards 2010. If any communication lines, equipment, or hardware is disturbed, it will need to be reinstalled IAW the most current 3 UFC 580-01 ISP Communication Standards.
1.4.8.3. If any communication lines need to be moved, please do so IAW I3A and UFC standards. If trenching or marking is required, please submit requests to usarmy.bliss.106-sig-bde.mbx.nec- dig-permits@mail.mil as we are not tied in with 811. Please contact the Network Enterprise Center (NEC) before disturbing any communications equipment the contractor may come across (network switches, fiber lines, etc.). Please do not dispose of any communications equipment the contractor may come across. Please request a site visit by the NEC NLT 7 days prior to work start date and NLT 7 days prior to project completion to ensure surveys and inspections ensuring communication lines are operational. If fiber needs to be pulled through duct banks, please ensure pathways have been checked and cleared.
1.4.9. Mechanical/Plumbing/HVAC. Not Applicable.

PART 2 - GENERAL REQUIREMENTS.
2.1. Basic Guidelines.
2.1.1. Preconstruction Conference. Prior to the start of any construction work an authorized representative of the KO will schedule and conduct a preconstruction conference. The notification will include specific details regarding the date, time, and location of the conference, any need for attendance by sub-Contractors, and information regarding the items to be discussed.
2.1.1.1. The Contractor's Project Manager (PM), Superintendent, and Quality Control Manager (QCM) shall attend this meeting. Minutes of the meeting will be prepared and signed by the Contractor. The minutes shall be sent to the COR for review and approval no later than 24 hours after the meeting.
2.1.2. Construction Documents. Contractor shall have a copy of the Contract, Scope of Work (SOW), Drawings, and specifications at the construction site at all times.
2.1.3. Licenses and Permits. The Contractor shall verify all dimensions and investigate existing site conditions prior to submitting proposal. The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits. The Contractor shall comply with all applicable laws and regulations, including but not limited to Building Codes, Federal Law, Texas State Law, Occupational Safety and Health Administration (OSHA) regulations, Army and installation regulations.
2.1.4. Contractor Furnished Items. Everything included in this paragraph and its subparagraphs is basic to the contract and should be included in the contract price.
2.1.4.1. The Contractor shall provide all labor, supervision, transportation, vehicles, supplies, equipment, materials and services required to perform work under this contract. The Contractor shall, as necessary, provide all equipment needed to perform the work safely and to meet the requirements herein.
2.1.5. Installation Property. Contractor shall exercise extreme caution to protect building finishes, private property, military property, historic material, cultural resources, etc., from damage during the performance of these contract requirements. Contractor shall be responsible for all loss or damage to Government and private property while executing contract requirements as a result of negligence on behalf of the Contractor, subcontractors, or any representatives of the Contractor or subcontractors.
2.1.6. Contractor Vehicles. Contractor's personnel, whose tasks involve operation of any vehicles, shall possess a valid U.S. state driver's license, certificates and permits, applicable for the type and class of vehicle being operated.
2.1.6.1. Limited Access. The Contractor shall only use existing roadways when transporting personnel and/or material during the execution of the contract. The Contractor shall strictly adhere to the foregoing and shall not develop new ingress or egress roads.
2.1.6.2. Parking. The Contractor shall ensure that its personnel use designated parking areas only. Personal and non-construction related vehicles shall not be parked on grassy, gravel, or landscaped areas (unless identified as acceptable in drawings).
2.1.7. Buy American Act. Construction Materials. Applying to contracts for the construction, alteration, or repair of any public building or public work in the United States, the Contractor shall utilize commercially available off-the-shelf (COTS) construction materials in accordance with Executive Order 10582 and 41 U.S.C. chapter 83, Buy American.
2.2. Key Personnel. The personnel listed below are considered essential to the work being performed under this contract. Prior to substituting, removing, replacing, or diverting any of the specified individuals, the Contractor shall notify the KO fifteen (15) working days in advance and shall submit a written request and justification (including proposed substitutions) in sufficient detail to permit evaluation of the impact on this Contract.
The proposed substitution of personnel must meet or exceed the experience and other technical requirements of the personnel being replaced. No change in personnel shall be made by the Contractor without the prior written consent of the KO. However, in urgent situations, as determined or agreed to by the KO, an oral request to substitute key personnel may be approved and subsequently ratified by the KO in writing. Such ratification shall constitute the consent of the KO required by this paragraph. The KO will notify the Contractor within ten (10) working days after receipt of all required information of the decision on the substitution(s). In the event the proposed substitution of key personnel does not meet or exceed the experience and other technical requirements of the personnel being replaced, substitution of acceptable replacements for the individuals as specified below. The key personnel listed below may, with the consent of the contracting parties, be amended during the course of the Contract to either add or remove personnel as necessary.
Project Manager (PM)
Superintendent
Site Safety and Health Officer (SSHO)/ Quality Control Manager (QCM)
2.2.1. Project Manager (PM). The Contractor shall provide a PM.
2.2.1.1. The role of the Construction PM is to be the Government's Point of Contact (POC) for the project and administration of construction. Per project, the PM is accountable for:
2.2.1.1.1. Management of performance of all trade Contractors, review and analysis of SOW, architectural and engineering drawings and specifications; ensuring contract documents and regulations are comprehended and followed; supervision of Construction Superintendent(s), reviewing and approving their reports, submittals, monitor reported difficulties, and correcting safety violations/ deficiencies; developing, tracking, updating and controlling construction schedule; project management plan, and associated costs to achieve completion of project; coordinating the closure of a project.
2.2.1.2. The PM shall possess the following:
2.2.1.2.1. Language. Full professional working proficiency at speaking, listening, reading, and writing in English.
2.2.1.2.2. Experience. Five (5) years of experience (within the last ten (10) years) working as a Construction PM (or in a position with equivalent responsibilities) managing multiple construction projects simultaneously related to the project.
2.2.2. Superintendent. The Contractor shall assign one competent superintendent for the project. The superintendent shall be accountable for overall supervision and management of job site coordination, day-to-day operations, schedule adherence, enforcement of safety and quality, managing subcontractors, has authority to act for the Contractor, and shall be on site at all times during Construction. The superintendent is required to attend facility turnover meetings (Red Zone meetings), partnering meetings, and quality control meetings. The qualification requirements for the alternate superintendent are the same as for the superintendent. The superintendent shall not have the responsibilities of QCM.
2.2.2.1. The Superintendent shall possess the following:
2.2.2.1.1. Language. Full Professional working proficiency at speaking, listening, reading, and writing in English.
2.2.2.1.2. Experience. Five (5) years' experience (within the last ten (10) years) working as a Construction Superintendent (or in a position with equivalent responsibilities), managing multiple construction projects simultaneously related to the project. The superintendent must be familiar with the requirements of Engineering Manual (EM) 385-1-1 and have experience in the areas of hazard identification and safety compliance. The individual must be capable of interpreting a critical path schedule and construction drawings. The KO may request proof of the superintendent's qualifications at any point in the project if the performance of the superintendent is in question.
2.2.3. Site Safety and Health Officer (SSHO). The SSHO shall be accountable for overall supervision and management of the Contractor's safety program(s) and plan(s). Contractor shall assign one SSHO for the project who will work simultaneously as the SSHO and QCM. The SSHO shall be on site at all times during construction to implement and administer the Contractor's safety program and Government-accepted Accident Prevention Plan. An alternate shall be identified in the Construction Safety Plan to serve in the event of the SSHO's absence. The requirements for the alternate are the same as the SSHO. The SSHO shall meet the requirements of EM 385-1-1 Section 1. The SSHO must ensure that the requirements of 29 CFR
1926.16 are met for the project. It is responsibility of the Contractor to express to the KO in the event that due to the complexity of the project, one employee will be required for each position.
2.2.3.1. The SSHO shall be the Government's POC for all aspects relating to safety. The SSHO responsibilities include, but are not limited to facilitating and ensuring the completion of facility safety assessments/investigations of reportable and non-reportable mishaps involving personal injury accidents, property damage, and cases of occupational illnesses; recording accident reports in an accurate, complete, and timely manner;
assuring that claims for injuries and illnesses are posted in the Occupational Safety and Health Administration log; promoting and furnishing applicable safety and health, accident prevention, and investigation training for Contractor's employees; assessing and evaluating work environment, identifying potential hazards, and aiding Contractor, Construction PM, and Construction Superintendent during work place inspections; supporting Contractor, Construction PM(s), and Construction Superintendents in investigating accidents and developing measures to prevent recurrences.
2.2.3.2. The Safety Manager shall possess the following:
2.2.3.2.1. Language. Full professional working proficiency at speaking, listening, reading, and writing in English.
2.2.3.2.2. Experience. Five (5) years' experience (within the last ten (10) years) working as a SSHO (or in a position with equivalent responsibilities), identifying potential risks and hazards, investigating accidents, and promote occupational safety on multiple construction projects, simultaneously, related to the project.
2.2.3.2.3. Certification. SSHO shall possess active credentials as a Certified Safety and Health Official (CSHO) in construction or Master Certification (MC) from an OSHA Training Institute Education Centers.
2.2.4. Quality Control Manager (QCM). The QCM shall be accountable for overall supervision and management of the construction's quality control and management program(s) and plan(s). Contractor shall assign one QCM for the project who will work simultaneously as SSHO and QCM. The QCM shall be on site at all times during construction and alternate shall be identified in the Construction Quality Control Plan to serve in the event of the QCM's absence. The requirements for the alternate are the same as the QCM. It is the responsibility of the Contractor to express to the KO in the event that due to the complexity of the project, one employee will be required for each position. The QCM shall not have the responsibilities of superintendent.
2.2.4.1. The QCM is to be the Government's POC for all aspects relating to quality control. the QCM responsibilities include but are not limited to the supervision and management of the Contractor's quality control and management program(s) and plan(s) in accordance with specifications; inspecting work for conformance to project plans and specifications identifying issues arising during construction and verifying that deficiencies have been corrected; recording and notifying the PM and/or Superintendent of problems on a timely basis so that corrections can be made without impact to the project schedule; creating, updating and maintaining the project submittal log and all other project specific quality control reports; reviewing shop drawings and submittals for conformance with project specifications by direct review and by leveraging the knowledge and experience of others in the project team when necessary; scheduling, reviewing, certifying, and managing submittals, including those of subcontractors, designers of record, consultants, manufacturers, offsite fabricators, suppliers, and purchasing agents; tracking preparatory, initial, and follow-up control phases and control, verification, and acceptance tests including documentation; continuing development of the project Quality Control Plan to address the specific needs of contract, as required; examining the work area to assure that all required preliminary work has been completed and is in compliance with the contract; reviewing drawings and each paragraph of applicable specifications, reference codes, and standards applicable to work being performed in the field.
2.2.4.2. The QCM shall possess the following:
2.2.4.2.1. Language. Full professional working proficiency at speaking, listening, reading, and writing in English.
2.2.4.2.2. Experience. Five (5) years' experience (within the last ten (10) years) working as a QCM (or in a position with equivalent responsibilities), managing multiple construction projects simultaneously related to the project.
2.3. Utilities. The Government will provide electricity and water for Contractor use in conjunction with this contract where available, and commodities will be at no cost to the Contractor. The Contractor shall instruct employees in utilities conservation practices. The Contractor shall be responsible for operating under conditions that preclude the waste of utilities. Contractor shall meter all utilities used and report them to Sustainability & Energy and Engineering Services Division. To coordinate the use of utilities please contact the COR. The Contractor shall provide its own sources of utilities (water, electricity, etc.) needed to complete the work in the SOW at locations where Government utilities are not available.
2.3.1. Utilities Cutovers and Interruptions. All anticipated utility outages shall be coordinated with DPW through the COR. A minimum advance notice of fourteen (14) calendar days shall be provided by the Contractor. Make utility cutovers and interruptions after normal working hours or on Saturdays, Sundays, and Government holidays unless directed otherwise. Conform to procedures required in paragraph Work Outside Regular Hours.
2.3.2. Portable Latrines. The Contractor shall be responsible for furnishing portable latrines as required by OSHA and American National Standards Institute (ANSI), for the use of employees at such locations as designated by the KO or COR.
2.4. Hours of Operation.
2.4.1. Normal Work Hours. The Contractor shall perform all work during normal work hours. Normal work hours are defined as the time period from 0730 hours (7:30 AM) to 1630 hours (4:30 PM) MDT/MST, Mondays through Fridays except on Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor shall not be reimbursed when the Government facility is closed for the above reasons.
2.4.1.1. Federal Government Holidays. For Government holidays visit https://www.opm.gov/policy-data- oversight/pay-leave/federal-holidays /#url=Overview .
2.4.1.2. This list of holidays relates to Government duty days and is not intended to supplement or otherwise alter the provisions of any Wage Determination regarding applicable paid holidays.
2.4.1.3. It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel will not be a reason for an additional period of performance, or entitlement of compensation except as set forth within the contract. In the event the Contractor's personnel work during the holiday, the Contractor may reimburse them; however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked, unless stipulated otherwise. This provision does not preclude reimbursement for authorized overtime work if applicable.
2.4.1.3.1. When the Department of Defense grants excused absence to its employees, the Contractor agrees to continue to provide sufficient personnel to perform critical tasks already in operation or scheduled, and shall be guided by the instructions issued by the KO or the COR.
2.4.1.4. If Government personnel are furloughed, the Contractor shall contact the KO or the COR to receive direction. It is the Government's decision as to whether the contract price/cost will be affected as a result of Government shutdown and/or furloughed Government employees. In the event that Government shutdown and/or furloughed Government employee does impact contract price/cost, a negotiated settlement will be reached as deemed appropriate by the KO.
2.4.2. Approval of Work Outside Normal Work Hours. Work outside regular working hours requires KO approval. Make application fifteen (15) calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the KO may approve work outside regular hours. During periods of darkness, the different parts of the work must be lighted in a manner approved by the KO.
2.5. Approval of work other than normal work-hours of the military reservation will be based upon the requirements of the task, technical or safety factors and not for the convenience of the Contractor. This is not intended to restrict the Contractor to an 8-hour day if the segment of project requires continuous work until completed because of mission requirements, the technical nature thereof, in the interest of safety, or to prevent damage to the project or other property. The Contractor shall give prior notice of such requirements to the KO. The KO may authorize the Contractor to perform work outside of normal working hours and/or working days. When the Government requires the Contractor to work outside normal hours, the Contractor shall be notified at the onset of the project, but not less than 24 hours in advance.
2.6. Historical Properties. All work performed on historic properties, or within historic districts and view sheds, shall meet the Secretary of Interior's Standards for the Treatment of Historic Properties; AR 200-1: Environmental Protection and Enhancement; the Fort Bliss Integrated Cultural Resource Management Plan (ICRMP); the Fort Bliss Programmatic Agreement for the Management, Operation, and Development of Historic Properties; and all associated regulations. The code of Federal Regulations can be found at eCFR :: 36 CFR Part 68 -- The Secretary of the Interior's Standards for the Treatment of Historic Properties.
2.6.1. The Historic Architecture Program within the Fort Bliss Directorate of Public Works - Environmental Division (DPW-ED) or DPW-ED Cultural Resource Manager (CRM) shall review and approve the project before any work begins. All coordination with DPW-ED shall be made through the COR.
2.6.2. The Contractor shall comply with all of the laws, regulations, orders, and procedures governing historic preservation, including the following documents: National Historic Preservation Act of 1966 (NHPA) as amended, and the Integrated Cultural Resource Management Plan (ICRMP) for Fort Bliss. All work done on historic properties, or properties within the view shed of a historic district must be reviewed and approved by Cultural Resource Manager (CRM) Staff prior to start of work. Contact Fort Bliss Historic Architect, for details and requirements. Coordinate with Fort Bliss Historic Architect POC via COR.
2.6.3. The Contractor shall provide maximum protection, take every reasonable means, and exercise care to prevent unnecessary damage to exiting historic structures, contemporary structures, landscape plantings, natural features, roads, utilities, and other public or private facilities. Special attention shall be given to historic structures, natural and landscape features of the areas to protect these elements and their surroundings. In addition, Contractor shall remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain and repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the KO. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.
2.7. Environmental. The Contractor shall perform all work in such a manner as to minimize the polluting of air, water, or land and shall, within reasonable limits, control noise and the disposal of solid waste material, as well as other pollutants. The Contractor shall comply with AR-420-47 Solid & Hazardous Waste Management, Title 40 CFR Part 260 through 273 and with all Federal, State, and local laws and regulations concerning environmental pollution control. Compliance by Subcontractors shall be the responsibility of the Contractor.
2.7.1. Permits.
2.7.1.1. Hazardous Material Abatement. The Contractor shall coordinate all hazardous material removal with the DPW-ED through the COR and execute all projects in strict adherence to the latest installation, Federal, state, and local regulations. Copies of the ten (10) day notification shall be required prior to any abatement. Copies of all clearance reports, air monitoring, and waste manifests shall be required at the completion of the project.
All notifications and records pertaining to hazardous materials shall be submitted to the Fort Bliss Safety Office, Industrial Hygiene Services, COR, and DPW-ED Asbestos and Lead Program Manager.
2.7.1.2. Air Emissions. Construction Operating Permits may be required prior to the installation of a significant, stationary, and/or air emissions source. Possible sources include but are not limited to: boilers, generators, paint booths, baghouses, cyclones, painting operations, wood working operations, welding operations, de-painting or blasting operations, engine test cells, solvent baths/degreasers, fuel storage tanks, or fueling operations.
The air emission units listed above may also require a modification to the installation's Title V Permit and cannot be installed nor operated until a permit is issued by the state permitting authority as applicable. Coordinate with the Air Program Manager via the COR for further guidance.
2.7.1.3. Batch Plant. Asphalt or concrete not trucked in by a supplier but produced on-site using an asphalt or concrete batch plant shall be permitted and allowed to relocate in accordance with State of Texas rules. Directorate of Public Works Environmental Division (DPW-ED) is not responsible for the permit and relocation request, Contractor and or owner/operator of the batch plant is responsible for securing necessary permit and relocation authorization.
2.7.2. Storm Water Pollution Prevention Plan (SWPPP). If more than an acre is to be disturbed during construction, the Contractor shall submit a SWPPP for approval. Contractor's final SWPPP shall be submitted no later than (NTL) fifteen (15) calendar days after contract award.
2.7.3. Hazardous Materials Requirements
2.7.3.1. Certification of Asbestos Free Construction. Texas House Bill 1927, effective September 2001, requires a Safety Data Sheet and a signed statement by an architect, engineer or Texas Department of Health Inspector identifying presence of asbestos containing material in all construction building materials (reference Texas Asbestos Health Protection Rules, Section 295.34, Part J). The Contractor shall provide a signed statement a CERTIFICATION form and attached with Safety Data Sheet (SDS) on each construction material (i.e. interior & exterior material of construction including mastic, sealant, roofing felt, roofing coating, non-roofing coating, floor tile and mastic, pipeline wrap, any type of friction material, etc.) and equipment.
Any excavation could encounter asbestos-containing concrete pipe, a.k.a. transite. If, during excavation, transite pipe is found the material shall not be disturbed by grinding, breaking, scraping or crushing, but shall be abated or removed by a licensed company with properly trained personnel using best management practices to prevent worker exposure, and proper handling and disposal of Asbestos Containing Materials (ACM) pipe; or excavation deviated to leave transite pipe undisturbed and left abandoned in place. If ACM pipe is encountered contact the Lead/Asbestos Program via the COR for further guidance.
2.7.3.2. Hazardous/ Regulated Materials. Hazardous materials (new) that are required for the project need to get approval from AFSB-FB through the Haz-Mart. The SDS is submitted to the Haz-Mart for review and approval. Once approved it can be brought and used on the installation and must be stored according to the manufacturer's recommendation.
2.7.3.3. No material other than construction materials, e.g. PVC, CPVC, or other suitable materials, will be brought into the installation.
2.7.4. Construction Waste Management and Disposal
2.7.4.1. Salvage, Waste, and Disposal. The Contractor shall dispose of excess scrap, materials, debris or waste at an approved off-post location IAW applicable Local, State and Federal laws and regulations and pay any related fees. Burning or burial of materials is not permitted. The Contractor shall maintain a clean work area free of construction debris.
2.7.4.2. Daily Clean Up. The cleanup of the work site shall include, but…
