52.211-8 TIME OF DELIVERY (JUN 1997)

(a) The Government requires delivery to be made according to the following schedule:

REQUIRED DELIVERY SCHEDULE

WITHIN 6 MONTHS OF CONTRACT AWARD

Item No. Quantity of Contract

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

OFFEROR'S PROPOSED DELIVERY SCHEDULE

Within Days

After Date

Item No. Quantity of Contract

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

Army Contract Writing System (ACWS) Transition Information for Offerors

a. The Department of the Army is in the process of deploying a new contract writing software application to Army contracting offices worldwide. Known as the Army Contract Writing System (ACWS), this modern software application will replace legacy Army contract writing systems.

b. During this transition period, Offerors are hereby advised:

1. The Contracting Office may use any combination of contract writing systems to create and release documents related to this solicitation (i.e., solicitation amendments and awards, if any). As a result:

i. Solicitation may contain different offer submission instructions than other solicitations released by the same Contracting Office (i.e., requiring offer submission via the Procurement Integrated Enterprise Environment (PIEE) Solicitation Module versus e-mail). Offerors should review all offer submission instructions contained in the solicitation documents and direct any questions or concerns to the designated point of contact contained in the solicitation.

ii. If ACWS is deployed prior to contract award, documents received from the Contracting Officer or view on the System for Award Management (SAM.gov) or other forums may appear noticeably different than the initial solicitation or previous solicitations or awards from the same Contracting Office. This is normal and expected.

iii. A change between contract writing systems may cause important information concerning solicitation response (amendments) or accepted terms (awards) to take on different formatting or appear in different parts of later documents issued. Offerors shall review all documents carefully to locate this important information and direct any questions or concerns to the designated point of contact contained in the solicitation.

2. The Government does not intend to use the transition between contract writing systems to effect any changes to solicitation or award terms and conditions without accompanying document narratives explicitly stating such changes are deliberate and desired. While the Contract Specialist and Contracting Officer will take care to minimize or eliminate any inadvertent changes when adapting to the new contract writing software, the Offeror, maybe the first to identify such errors. Therefore, Offerors shall:

i. Notify the designated point of contact contained in the solicitation immediately if any observed changes, removals, or additions that would affect award eligibility, violate, or alter existing quote/ proposal terms, or could affect Contract performance post-award.

ii. Take special care to ensure all fill-in Clauses are populated and remain populated across documents received from the Contracting Office throughout the solicitation and award process.

iii. Notify the designated point of contact contained in the solicitation for guidance if any inadvertent change is noticed or suspected between document issuances.

3. In the unlikely event that a network disruption, contract writing system error, or financial system error threatens timely award of the requirement set forth in this solicitation, the Contracting Officer:

i. May elect to use alternative mechanisms to obligate funds and allow work or deliveries to legally begin to the benefit of, and with legal protection for, both parties.

ii. Will incorporate the latest version of this Solicitation into such mechanisms to serve as a framework for contract execution until any such system problems are resolved.

iii. Will ensure any action taken does not conflict with the stated offer evaluation and award methodology of this requirement.

iv. Will issue a complete, properly formatted award that accurately reflects this requirement and all applicable terms and conditions once systems return to normal.

4. After contract award, the Contracting Officer will correct problems affecting award documents (if any) via bilateral modification, at no cost to the Contractor. Any such modification will reconcile the award with the latest version of this solicitation reflecting deliberate action by the Contracting Officer (i.e., the first issuance if no amendments, or the latest amendment with accompanying narratives), inclusive of any documented pre-award negotiations or accepted supplemental offer terms.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Entry Gate Criteria

The quoter must be rated acceptable for the following criteria in order to proceed to full quotation evaluation:

Entry Gate Criteria:

1. Crane must be a crawler crane with telescoping boom.

2. Crane must have a lifting capacity of at least 240 US Tons.

3. Crane tracks must be equipped with removable track pads for highway crossing.

4. Crane must be equipped with an enclosed cab with heating and air conditioning controls, windshield wipers, standard nighttime light package.

Evaluation Factors

This evaluation will utilize comparative analysis IAW FAR 13.106-2(b) to provide the best value to the Government. Award may be made to other than the lowest priced quote if the Government determines that a price premium is warranted due to technical merit.

However, the closer the merits of the technical quote are to one another, the greater will be the importance of price in making the award determination. In the event that two or more technical quotes are determined technically equivalent, award may be made to the lower priced quote provided the price is reasonable. Responses to this solicitation will be evaluated against the following factors:

Factor 1: Technical Factor 2: Past Performance Factor 3: Price

FACTOR 1: Technical.

The quoter shall provide technical information based off of the requirements of the Purchase Description (PD). The information shall provide, at a minimum, the following information:

a. Provide a detailed breakdown of the specifications of the proposed equipment. Quoters shall demonstrate that they meet or exceed each of the items that are listed in section 4.0 Requirements of the 240 Ton Telescoping Hydraulic Crawler Crane PD

b. Demonstrate a structured approach to preventative maintenance and repair of the 240 Ton Telescoping Hydraulic Crawler Crane. Include distance from service technicians to LEAD as well as response time, warranty information, maintenance plan information (if applicable), and parts country of origin and availability.

c. Provide a training plan in accordance with 4.10 of the Purchase Description.

Mere re-statements of the requirements or statements from the quoters that the quote is compliant that do not include a description of product technical capability is unacceptable.

Additional consideration will be provided to those quotes that exceed the requirements as provided in the PD and provide additional safety features such as cameras for rear view, swing and winch movements as well as ground pressure readings.

If the quote is determined unacceptable in any of the technical evaluation factors or subfactors, the quote may not be considered for award.

In addition to the information submitted by quoters, the Contracting Officer may consider other information reasonably related to the evaluation factors, to include the personal knowledge of the competitor's commercial and Government customers and past performance databases. The Government may consider any other value added benefit offered in its best value determination.

The Contracting Officer is not obligated to evaluate all information submitted from each offeror. For example, the Contracting Officer may curtail evaluation of an offeror's submission if at any point the Contracting Officer determines the competitor is unlikely to provide best value.

The Contracting Officer may communicate with an offeror at any time during the evaluation without regard to the FAR 15.3 rules concerning competitive range determinations and discussions. The Contracting Officer may also identify the offeror most likely to provide best value and hold negotiations solely with that offeror to finalize the order and/or negotiate more favorable terms for the Government.

Factor 2: Past Performance

A. The Government will evaluate the quoter’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the PD.

B. Quoters shall submit all relevant information on Government and/or commercial contracts for the prime offeror and each major subcontractor, those subcontractors expected to perform twenty (20) percent or more of the effort, in performance or awarded during the past three years, from the issue date of this Request For Quote (RFQ), which are relevant to the efforts required by this RFQ. The Government may consider a wide array of information from a variety of sources, but is not compelled to rely on all of the information available. The Government is not required to consider the past performance of all quoters.

C. Offerors shall include the most recent and relevant efforts (within the past three years) in their quote.

Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned an “unknown confidence rating” and its quote will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the quoter in its quote and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the North American Industry Classification System (NAICS) 333120. Data used in conducting performance risk assessments shall not extend past three years prior to the issue date of the RFQ but may include performance data generated during the past three years without regard to the contract award date.

Factor 3: Price.

Offerors must propose on all items. The total evaluated price will be computed by adding the total estimated amount for each item.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES (MAY 2024) ALTERNATE I (FEB 2024)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
