Clauses and Provisions

Evaluation Criteria http://www.acquisition.gov/

If a contract is awarded resulting from this solicitation to a responsible offeror, the offer shall conform to all the solicitation requirements and the offer shall represent the best value to the Government. NOTE: FAR Part 2.101 defines Best Value as "the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit in response to the requirement." The government best value determination may use all two of the following factors to evaluate offers, in no particular order of importance:

(1) Technical, and

(2) Price

The following is inserted as new paragraph (d) of the provision:

(d) BASIS FOR CONTRACT AWARD: The Government will utilize the best value method per FAR Subpart

12.2. An award, if any, will be made to the responsible offeror who submits a quote that (1) conforms to the requirements of the solicitation; (2) that receives a rating of “Acceptable” on the Technical Acceptability Factor;

and (3) that submits the quote with the lowest total evaluated price (TEP), provided that the TEP is not unbalanced and is determined to be fair and reasonable. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions to Offerors – Commercial Products and Commercial Services, the offeror accedes to the terms of this model contract. Failure to meet a requirement may result in an offer being determined unacceptable. The evaluation process will include the following:

(1). Technical Acceptability Factor. The government will evaluate technical acceptability of each offer based on a pass/fail basis and assign an Acceptable or Unacceptable rating as described in Table 1 below. Technical Acceptability Factor is broken down into two (2) subfactors.

Table 1. Technical Ratings Rating Description

Acceptable Offeror’s qualifications meet the requirements of the solicitation.

Unacceptable Offeror’s qualifications do not meet the requirements of the solicitation.

SUBFACTOR 1 – Experience/Education: This subfactor is met when an offeror thoroughly, completely, and accurately submits and fully addresses one of the following criteria in this subfactor. Submit 1) a copy of a degree/major in Music, or 2) prior experience information (such as 1-year previous experience as a worship music director) with the attachment 2, Past/Present Experience Information. The past/present experience information provided by the offeror will be verified and evaluated based on the information received and information independently obtained by the Government.

SUBFACTOR 2 – Music Demonstration: Offerors must pass the music demonstration which is going to be coordinated between the government and offeror, and the demonstration will be evaluated in accordance with the following method:

Offerors will be evaluated on four (4) pieces of written music (two traditional hymns, two contemporary worship songs), which they will receive on the day of the evaluation. Offerors will be evaluated on their ability to read music, play the notes as listed, vocalize, and to perform the provided music satisfactorily in terms of melody, tempo, rhythm and dynamic, making nor more than 3 mistakes or missed notes.

(2). Price Evaluation Factor. The government will rank all offers by TEP. The price evaluation will document the fairness and reasonableness of the TEP. The Government reserves the right to perform various price analysis techniques to ensure pricing is fair and reasonable, and realistic.

Total Evaluated Price: A TEP will be computed for each offer in order to meet the requirements of FAR Parts 6 and 17. The price of a six-month extension authorized by 52.217-8, Option to Extend Services, will be added to the proposed price for each potential contract performance period.

The TEP is a two-part computation. First, the offeror’s total proposed price will be determined by multiplying the quantities identified in the requested services list by the amount, limited to two decimal places, for each Contract Line Item Number (CLIN) to confirm the extended total amount for each CLIN; the sum of all extended amounts will be the offeror’s total proposed price. Second, the total proposed price (total amount for CLINs 0001 – 2001) plus the sum of Option to Extend Services clause 52.217-8 formula (shown below) will constitute the TEP.

The formula for the Option to Extend Services amount is as follows:

Base Year = CLIN Amount x 0.5* Option 1 = CLIN Amount x 0.5* Option 2 = CLIN Amount x 0.5* Option 3 = CLIN Amount x 0.5* Option 4 = CLIN Amount x 0.5*

(4) Offerors are cautioned to submit sufficient information and in the format of this solicitation. Offerors may be asked to clarify certain aspects of their quotations. Exchanges conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for quotation revision. The government intends to award a contract without discussions with respective offerors.

The government, however, reserves the right to conduct discussions if deemed in its best interest.

(5) The Government reserves the right to award a contract for less than the quantity indicated in the solicitation.

Contractors should only provide pricing for the amount of time they can actually provide the service.
