About this file

This is a Request for Quote (RFP) for the USDA Animal and Plant Health Inspection Service (APHIS) Grasshopper and Mormon Cricket (GHMC) Suppression Program. The solicitation seeks to establish multiple firm-fixed price Indefinite Delivery Indefinite Quantity (IDIQ) contracts for aerial insecticide spraying across five states: Nevada, Oregon, Wyoming, Colorado, and Utah. Contractors must provide aircraft, crews, pesticides, and all necessary equipment to conduct aerial treatments of grasshopper and Mormon cricket populations on an as-needed basis during the two-year performance period from 05/01/2025 to 04/30/2027.

Key submission requirements include registering in the System for Award Management (SAM), providing detailed technical capabilities (aircraft information, pilot qualifications, EPA certifications), submitting pricing for specific state regions, and demonstrating past performance in aerial insecticide spraying. Quotes must be submitted via email to Kim Yen Tu by 1:00 PM CT on 04/04/2025. The solicitation is set aside as 100% for small businesses, with regions marked with ** having the highest probability of potential treatments. Contractors may quote for multiple states and are encouraged to provide quotes for all regions they can perform in, with estimated chemical usage ranging from 1 to 200 gallons per region depending on projected need.

1.1 Schedule Notes

1.1.1 Quantities listed on the contract are overall estimates for evaluation purposes only and are not intended to convey either a minimum or maximum quantity that will be ordered by the Government.

Contract and delivery order minimums and maximums are addressed in the following clauses: See 52.216‐19, “Order Limitations” and 452.216‐73 “Minimum and Maximum Contract Amounts”.

1.1.2 Contractors may quote/pricing for more than one state if they are capable of performing in multiple states. It is recommended that interested contractors provide quotes for all interested states/region since it is the government’s goal to have coverage for all states/regions listed in the price schedule.

1.1.3 Regions with ** have the highest probability for outbreaks and possible treatments at this time, but treatment is not guaranteed. This may be different under year two of the contract.

1.1.4 Pricing shall include all services and supplies for aerial spraying as defined in the IDIQ Statement of Work and in GHMC General Statement of Work (Attachment 1). It is expected that contractors will provide aircraft and crews as well as the required Diflubenzuron, clean crop oil, buffering agents and water to complete aerial application for each task order issued on an as needed basis. Although pricing unit is per gallon, the contractor shall include all cost to complete aerial services in the unit price. The quantities listed in the schedule are estimates for evaluation purposes only and are not guaranteed. The government may order more or less through issuance of task orders. Please see section 2.5 Task Orders for additional information.

1.1.5 Wage determination based on prevailing wage rates - Contractors performing on service contracts in excess of $2,500.00 to which no predecessor contractor’s collective bargaining agreement applies shall pay their employees at least the wages and fringe benefits found by the Department of Labor to prevail in the locality. The following US Department of Labor Wage Determinations apply to this contract: See Attachments for latest Wage Determinations that is applicable for each state. Updated and full text versions can be found at: www.sam.gov

2.0 GHMC AERIAL TREATMENT STATEMENT OF WORK

2.1. Background

The USDA, Animal and Plant Health Inspection Service (APHIS), Plant Protection and Quarantine Services (PPQ), in Grasshopper and Mormon Cricket Suppression Program intends to procure aerial services including all labor, aircraft, equipment, supervision, transportation, operating supplies, and incidentals necessary for applying grasshopper treatments.

The type of service is a full-service rangeland aerial spraying treatment using Diflubenzuron. A contractor upon award of a contract, will provide all required chemicals, clean crop oil, buffering agents and water to complete the application once a task order designed is issued. The GHMC General Statement of Work (Attachment 1) is hereby incorporated by reference and lists technical specifications, terms and conditions applicable to this contract and any contracts awarded for USDA APHIS rangeland Grasshopper and Mormon Cricket Suppression Program Aerial Application services.

2.2. Contract Type and Period of Performance

This will be a firm-fixed-price Indefinite Delivery, Indefinite Quantity (IDIQ). The contract will be for two years.

If treatment is required, the Contractor(s) may be required to commence work as early May 2025 upon official notification by the Contracting Officer through issuance of task orders. It is estimated that aerial spraying treatments will be scheduled between May and August each year on an as-needed basis.

2.3. Performance Requirement

The type and amount of equipment and personnel needed to accomplish the contract work including satellite geo-positioning guidance and recording device is the responsibility of the Contractor. The aircraft must have flat fan nozzles, the ability to accept/read shape files and the ability to overlay spayed areas on a map after treatment. Additional aircraft and equipment requirements can be found in the GHMC General Statement of work.

Overall, the work shall be done in strict compliance with the specifications provided by terms, specifications, conditions, and provisions of this Statement of Work and the GHMC General Statement of work.

The Contractor shall be liable for default unless non-performance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the U.S. Federal Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection there http://www.sam.gov/ with, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence (see clause 52.212-4 (f)).

Offerors are reminded that there are numerous biological and entomological factors that determine the time and sequence of treatments. The importance of starting and completing a program within specified limits is critical. The objective of each program is to achieve the desired coverage of the designated geographic areas within specified time frames.

No adjustment will be made in the contract price for providing additional aircraft beyond the estimated number and category of aircraft that may be required by the contract or in the estimated number of acres to be sprayed.

2.4. Pilot Minimum Background Investigations

APHIS is required to determine fitness for federal service on any individual working for or on behalf of the federal government in accordance with Title 5, Code of Federal Regulations, part 731 (5 CFR 731) and APHIS Directive 4620.10. As such, each and every pilot that is on a GHMC contract is required to submit their fingerprints to obtain a Special Agreement Check (SAC) from Defense Counterintelligence and Security Agency (DCSA) and an OF-306 form prior to flying.

The COR will provide contractor pilots with GHMC HRO 1197 form and OF-306 after contract award to fill out and return to the COR along with of two valid forms of identification. Contractor pilot fingerprints will need to be obtained at a Fieldprint location (https://www.fieldprint.com/) in their state. The Contractor should try to schedule an appointment within 10 days after contract award or as agreed upon with the State plant Health Director or COR. The FieldPrint code when making an appointment is FPUSDAAPHISPPQ. Over the last ten years the federal government has been transitioning to digital prints, so paper fingerprint cards are no longer accepted. Electronic prints are sent directly to the Defense Counterintelligence and Security Agency (DCSA) allowing the agency to receive results within 48 hours of the appointment.

The SPHD and/or COR should also remind the contractors of this requirement. Ultimately, the SPHD or COR is responsible with collecting necessary information and providing it to Personnel Security to process.

2.5. Task Orders

Performance must be made only as authorized by a task order when aerial spray service is required.

Task orders will be issued only by a contracting officer. Each task order will specify the quantity of gallons of insecticide needed for the designated spray block(s). The task order will also include additional site-specific information and maps of spray blocks for that task order. Other specific technical direction related to the task order will be provided by the COR or Authorized Program Representative.

The government is not responsible for reimbursing contractor for Diflubenzuron bought by contractor when no task orders are issued. The government recommends that the contractor purchase the necessary amount of Diflubenzuron when a task order is issued.

Payment will be made for each gallon of insecticide acceptably applied as specified in the GHMC General Statement of Work (Attachment 1), Section 4.4 “Payment for Gallons/lbs. Applied”, as well as contract clause 52.212-4. No payment will be made for any flying/spraying not ordered.

https://www.fieldprint.com/

2.6. Fair Opportunity & Ordering Procedures

Multiple task orders may be issued at a time for each state/region identified in the price schedule limited to price under the awarded contract. However, the Contracting Officer will ensure that contractors are capable of performing multiple task orders at over short period of time prior to issuing them through fair opportunity ordering procedures outlined below. The following will be followed in issuing task orders under multiple award contracts per FAR 16.505(b). Awardees will be provided a fair opportunity to be considered for each task order exceeding the micro-purchase threshold when orders are issued under multiple delivery-order contracts or multiple task-order contracts.

The value of an order is considered the total anticipated value based on all known pricing listed in the price schedule. Orders shall be within the scope, issued within the period of performance, and be within the maximum value of the contract. When there is only one contract established for a specific region, the orders will not be competed and will automatically go to the contractor who services that region.

2.6.1 Orders valued between $2,500 and $250,000

For task orders valued within this range, the contracting officer is not required to contact each of the multiple awardees before selecting an awardee if the contracting officer has information available to ensure that each awardee is provided a fair opportunity to be considered for each order (FAR 16.505 (b)). The contracting officer will consider the following information:

1) IDIQ firm fixed unit price (Price Schedule)

2) Capacity/capability to perform services when requested.

3) Past performance on earlier orders under the contract, including quality, timeliness.

A contractor must notify the Contracting Officer within one day after receipt of task order if they are unable to perform due limited capacity (performing on multiple task orders already) or in ability to deploy/coordinate treatment services within reasonable timeframe.

2.6.2 Orders valued over $250,000

In the event where multiple IDIQ contracts are issued for the same region for task orders over $250,000 task orders shall be placed on a competitive basis. The Contracting Officer will provide fair notice to all contractors who are able to perform for that region and afford all contractors responding to the notice a fair opportunity to submit an offer within the designated timeframe. The contracting officer will consider the following information:

1) Firm fixed prices established in the Pricing Schedule, including proposed discounts to fixed unit prices.

2) Capacity/capability to perform services when requested.

3) Past performance on earlier orders under the contract, including quality, timeliness.

2.6.3 Exceptions to the fair opportunity process (FAR 16.505(b)(2)(i):

The contracting officer shall give every awardee a fair opportunity to be considered for a task order exceeding $2,500 unless one of the following statutory exceptions applies:

a) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

b) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

c) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

d) For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

2.7. Accident Reporting, Investigation, Rescue, and Salvage Responsibility

• In the event of an incident or accident involving the aircraft, the pilot, if able, must notify the PPQ supervisor as soon as practical.

• The Contractor must maintain an accurate record of all aircraft accidents, incidents and injuries to Contractor or Government personnel arising in the course of performance under this purchase order and must immediately notify the Contracting Officer of all such accidents, incidents or injuries. The Contractor must not permit removal or alteration of the aircraft following an accident until authorized by the Contracting Officer except in emergencies such as threat to life or property, blocking airport runways, etc. The Contractor must make available his personnel, records, and any equipment, damaged or undamaged, deemed necessary by the Accident Investigation Board to determine accident cause factors.

• The Government will be responsible for any costs involved in disassembly of any aircraft, aircraft engine, propeller, rotor assembly or appliance necessary to determine probable accident or incident cause.

• The Contractor will be responsible for rescue operations of the Government and Contractors' personnel employed under this contract.

• Salvage of damaged or demolished aircraft will be done at the Contractor’s expense. No equipment or personnel performing under this contract may be used on such operations unless authorized by the Government.

• When search for and rescue of Government and Contractor’s personnel or repair of aircraft which are out of commission (either at the base camp or in the field) is made necessary by the failure of the Contractor’s equipment or accidents caused by his employees, the cost of such search, rescue and repairs is solely the responsibility of the Contractor.

2.8. Liabilities of Contractor and Government

The Government will not assume any responsibility whatsoever for loss or damage of equipment owned or operated by the Contractor, his agents, or employees or subcontractor or for the injury to or death of the Contractor, his agents or employees or subcontractor. The Contractor will be responsible for any negligent or wrongful acts or omissions of the Contractor, his employees, agents or subcontractors and employees or agents of the subcontractor(s) incident to the performance of this contract. The Contractor will hold and save the Government, its officers, and employees harmless from all liability for any death or damage to all persons (other than the liability of the Government to Agriculture employees directly engaged in performing work under this contract as provided under the Federal Employee's Compensation Act) or to real or personal property, including negligent use of spray material, which results from the operation of, or incident to, equipment furnished by the Contractor, or otherwise incident to performance of the contract. However, the Contractor will not be responsible for any negligent or wrongful acts or omissions of the U.S. Department of Agriculture, its employees, the U.S.

Department of Agriculture's cooperators, or their employees.

2.9. Invoicing

USDA, APHIS uses the Invoice Processing Platform (IPP) for electronic submission and tracking of invoices and payment information to its suppliers of goods and services. Invoices shall be submitted electronically to the IPP invoicing system. Invoice attachments in IPP shall include the IDIQ and order number. The contractor may register at Enroll at https://ipp.gov. Invoices shall be submitted in accordance with Terms and conditions defined in each task order.

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information ( 44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial products or commercial services, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.
