2. GENERAL REQUIREMENT

This firm-fixed price contract is for entomological and pest management service, and is part of a comprehensive Integrated Pest Management (IPM) program for U.S. Embassy Bangkok, in accordance with line item A below.

The work shall be accomplished in a manner that:

• conforms to the intent of all applicable Department of State safety, health, and environmental policies, standards and regulations;

• recognizes and takes all precautions against the documented dangers of pesticide application;

• is done in a manner effective for controlling pests and causes no contamination to other parts of the property and environs;

• endangers none of the property occupants or workers; and

• leaves the areas safe for re-occupancy.

A. Description of Program: IPM is a process for achieving long-term, environmentally sound pest suppression and prevention through the use of a wide variety of technological and management practices. Control strategies in an IPM program include:

I. Structural and procedural modifications to reduce food, water, harborage, and access used by pests.

II. Pesticide compounds, formulations, and application methods that present the lowest potential hazard to humans and environment.

III. Non-pesticide technologies such as trapping and monitoring devices.

IV. Coordination among all facilities management programs that have been on the pest control effort.

The three key components of Integrated Pest Management are:

i. Prevention and pest prevalence reduction measures;

ii. Self-help measures; and,

iii. Use of Department-authorized professional-use pesticides. These components are conducted in sequence or in combination. Each element is discussed in

EXHIBIT 2: DEPARTMENT-AUTHORIZED EPA REGISTERED

PROFESSIONAL-USE PESTICIDES FOR COMMON PESTS.

Note: Professional-use pesticides are only when there is a demonstrated need, which is generally after pest prevalence reduction and self-help measures have been shown to be insufficiently effective. Lack of resident or occupant cooperation is not a reason to use professional pesticides without exhausting safer control methods.

Prior to using authorized professional-use pesticides, factors contributing to the pest problem should be understood. Without addressing these factors, long-term control of the pest problem will be difficult, if not impossible. Only professional-use pesticides that are authorized by the Department and appropriate for the target pest are permitted. Table 2 in Appendix B lists Department-authorized EPA-registered pesticides that are pre-authorized for post to use to controlling common pests. Before every professional-use pesticide, the contractor must submit a Pesticide Application Plan to COR for POSHO approval.

Professional-use pesticides are applied in various methods, however, the Department authorizes applications that target only affected areas are most likely to impact the pests, and leave minimal potential for pesticide exposure and environmental contamination following the pesticide application.

B. Contractor Service Requirements: The Contractor shall furnish all supervision, labor, materials, and equipment necessary to accomplish the monitoring, trapping, pesticide application, and pest removal components of the IPM program. The Contractor shall also provide detailed, site- specific recommendations for structural and procedural modifications to aid in pest prevention.

3. PEST INCLUDED AND EXCLUDED IN CONTRACT

A. The Contractor shall adequately suppress the following pests:

I. Indoor population of rodents, cockroaches, ants, flies, mosquitos, spiders, bugs, beetles and other arthropod and anthophila pests not specifically excluded from the contract.

II. Population of the above pests outside of the building but within the U.S. Embassy properties.

III. Termite swarmers including subterranean and dry-wood termites, as well as other wood infesting insects.

IV. Nests of stinging insects (bees, wasps, hornets, etc.) within the property boundaries of the specified building.

Individuals of all excluded pest populations that are incidental invaders inside the specific buildings, including winged termite swarmers emerging indoors.

B. The following pests are excluded from this contract:

I. Birds, bats, snakes, and all other vertebrates other than commensal rodents.

II. Pests that primarily feed on outdoor vegetation.

4. INITIAL BUILDING INSPECTIONS AND ESTABLISHMENT OF MONITORING

PROGRAM

A. Initial Inspection The Contractor shall conduct a thorough, initial inspection of the property or site within the time specified in the purchase order.

The purpose of the initial inspection is for the Contractor to:

(COR). The COR will inform the Contractor of any restrictions or areas requiring special scheduling.

B. Develop a Pest Control Plan

Prior to initiation of service, the Contractor shall submit to the COR a Pest Control Plan for each property or site identified in the purchase order within 15 days following the initial inspection. Upon receipt of the Pest Control Plan, the COR will render a decision regarding its acceptability within 15 days. The Contractor shall be on site to initiate service within 7 days following notice of approval. If aspects of the Pest Control Plan are incomplete or disapproved, the Contractor shall have 15 days to submit revisions.

The Pest Control Plan shall consist of the following parts:

I. Proposed Materials and Equipment for service: The Contractor shall provide methods for control, including name of any pesticide(s) to be used, specimen labels and Material Safety Data Sheets (MSDS sheets) for all pesticides proposed to be used. A list of brand names of rodent bait boxes and any other control devices or equipment should also be included.

II. Proposed Methods for Monitoring and Detection: The Contractor shall describe methods and procedures to be used for identifying sites of pest harborage and access, and for making objective assessments of pest population levels throughout the term of contract. The methods and procedures proposed by the Contractor must ensure the safety of building occupants and visitors to the site including the anticipated period that the premises must be vacated (if applicable), including preparations that must be carried out other than by the Contractor prior to implementation of the Pest Control Plan (e.g. removing pets, covering food handling equipment).

III. Service Schedule for Each Building or Site: The Contractor shall provide an Inspection Service Schedule once a month per location and Treatment Service Schedules upon need, or as specified by the Contracting Officer’s Representative (COR) for issues that need immediate care and will cause harm or additional property damage without early treatment.

V. Commercial Pesticide Applicator Certificates or Licenses: The Contractor shall provide a list identifying the on-site person(s) who will be performing the pest control work. A model Pest Control Plan form is included as Exhibit 1 of this purchase order.

NOTE:

The Department must approve all pesticides used by the Contractor. Department-authorized professional-use pesticides (DAPU) are found in Exhibit 2, Department-Authorized EPA- Registered Professional-Use Pesticides for Common Pests. Use of non-chemical and self-help pesticides in lieu of professional-use pesticides is encouraged as appropriate for the pest problem.

As a rule, the Contractor shall not apply pesticides in any area inside or outside the premises - i.e., in any room, closet, hallway, stairwell, court, driveway, planting bed, and similar locations - unless the Contractor's inspections confirm the presence of pests in that specific area.

The Contractor shall deliver all materials and supplies to the site in the original unopened containers bearing the name of the manufacturer and details for proper mixing, application, storage and disposal. The Contractor shall apprise all workers, supervisory personnel, and any other contractors who will be at the work site of the seriousness of the hazard and of proper work procedures, which must be followed.

The Contractor shall coordinate any and all pesticide use and activities with the COR prior to actual application. No pesticide application shall occur unless advance preparations have been completed (Section 5B).

If the COR is not the POSHO, the COR will receive the approval of the POSHO before instructing the Contractor to begin application. The COR shall ensure that he/she has copies of the Material Safety Data Sheets and pesticide labeling for the pesticides being used and that the Contractor also has copies of said information so that protective measures and/or spills may be properly addressed.

The COR shall provide the Contractor with the following:

i. Access to all identified areas for pest control.

ii. Water and electricity from outside of the work area (The Contractor shall be responsible for the tie-ins to these services.)

iii. A designated space for the Contractor to park vehicles necessary to perform the work, if required.

iv. The name and phone number of at least one building authority who can be contacted 24 hours a day, if other than the COR.

The Contractor shall adhere to the following rules for pesticide use:

A. Approved Products: The Contractor shall not apply any pesticide product that has not been included in the Pest Control Plan or approved in writing by the COR.

B. Pesticide Storage: The Contractor shall not store any pesticide product in the buildings specified in this contract.

C. Application by Need: Pesticide application shall be according to need and not by schedule. As a general rule, application of pesticides in any inside or outside area shall not occur unless visual inspection or monitoring devices indicate the presence of pests in that specific area. Requests for preventive pesticide treatments in areas where surveillance indicates a potential insect or rodent infestation will be evaluated by the COR on a case-by-case basis. Written approval must be granted by the COR prior to any preventive pesticide application.

D. Minimization of Risk: When pesticide use is necessary, the Contractor shall employ the least hazardous material, most precise application technique, and minimum quantity of pesticide necessary to achieve control.

10. PEST CONTROL TREATMENT

A. Emphasis on Non-Pesticide Methods:

i. When it is determined that a professional pesticide must be used in order to obtain adequate control, the Contractor shall apply a Department-authorized professional-use pesticide that is appropriate for the target pest and situation. The Contractor shall conduct the application in compliance with all instructions and precautions noted on the specimen label as well as Department specifications, which are a subset of the labeling.

ii. The Contractor shall be responsible for application of pesticides according to the label and Department specifications (refer to the Department’s Integrated Pest Management Program document). All pesticides used by the Contractor must be EPA registered and/or authorized by the Department.

iii. Transport, handling, and use of all pesticides shall be in strict accordance with the manufacturer's label instructions; all applicable U.S. Federal laws and regulations;

and any applicable international or host country laws and regulations.

B. Insecticides and Termite to Cracks and Crevices: The Contractor shall minimize the use of liquid pesticide applications wherever possible. As a general rule, the Contractor shall apply all insecticides as “crack and crevice” treatments only, defined in this contract as treatments in which the formulated insecticide is not visible to a bystander during or after the application process.

"Crack and crevice treatment" is defined herein as an application in which the stream of pesticide is never visible. Small amounts of insecticides are applied into cracks and crevices in which insects hide or through which they may enter buildings. Such openings commonly occur at expansion joints, between different elements of construction, and between equipment and floors. These openings may lead to voids such as hollow walls, equipment legs and bases, conduits, motor housings, junction or switch boxes.

“Spot applications” are limited to areas in which insects are likely to occur, but which will not be in contact with food or utensils and will not ordinarily be contacted by people or pets.

These areas may occur on floors, walls, and bases or undersides of equipment. For this purpose, a “spot” will not exceed 3 square feet.

C. Application of Insecticide to Exposed Surfaces or as Space Sprays: Application of insecticides to exposed surfaces or as space sprays (“fogging”) shall be restricted to exceptional circumstances where no alternative measures are practical. The Contractor shall obtain approval of the COR prior to any application of insecticide to an exposed surface or any space spray treatment. No surface application or space spray shall be made while tenant personnel are present. The Contractor shall take all necessary precautions to ensure tenant and employee safety, and all necessary steps to ensure the containment of the pesticide to the site of application.

If the proposed pesticide is not already authorized in the Department’s Integrated Pest

Management Program document, the Contractor must submit a written request for authorization to the COR prior to any pesticide application. The COR shall render a decision regarding the treatment prior to its application. The Contractor shall take all necessary precautions to ensure tenant and employee safety, and all necessary steps to ensure the containment of the pesticide to the site of application. Other than spot or crack and crevice treatments, no applications of professional-use pesticides shall be made while tenant occupants are present.

D. Insecticide Bait Formulations: Bait formulations shall be the standard pesticide technology for cockroach and ant control, with alternate formulations restricted to unique situations where baits are not practical.

E. Monitoring: Sticky traps shall be used to guide and evaluate indoor insect control efforts wherever necessary.

11. RODENT CONTROL TREATMENT

A. Indoor Trapping: As a general rule, rodent control inside buildings shall be accomplished with trapping devices only. All such devices shall be concealed out of the general view and in protected areas so as not to be affected by routine cleaning and other operations. Trapping devices shall be checked on a schedule approved by the COR. The Contractor shall be responsible for disposing of all trapped rodents and all rodent carcasses in an appropriate manner.

C. Use of Rodenticides: Mechanical or sticky traps are the preferred method of rodent population reduction. In exceptional circumstances, when rodenticides are deemed essential for adequate rodent control inside buildings, the Contractor shall obtain approval of the COR prior to making any interior rodenticide treatment. All rodenticides, regardless of packaging, shall be placed either in locations not accessible to children, pets, wildlife, and domestic animals, or in EPA-approved tamper-resistant bait boxes. As a general rule, rodenticide application outside buildings shall emphasize the direct treatment of rodent burrows wherever feasible.

D. Use of Bait Boxes: All bait boxes shall be maintained in accordance with EPA regulations, with an emphasis on the safety of non-target organisms.

The Contractor shall adhere to the following five points:

i. All bait boxes shall be placed out of the general view, in locations where they will not be disturbed by routine operations.

ii. The lids of all bait boxes shall be securely locked or fastened shut.

iii. All bait boxes shall be securely attached or anchored to the floor, ground, wall, or other surface, so that the box cannot be picked up or moved.

iv. Bait shall always be placed in the baffle-protected feeding chamber of the box and never in the runway of the box.

v. All bait boxes shall be labeled with the Contractor's business name and address, and dated at the time of installation and each servicing.

The Contractor shall be responsible for:

- notifying the COR about the location of all rodent burrows on the premises that must be filled, and

- be responsible for removing rodent carcasses.

The Contractor shall not store any pesticide product or container on Government property.

12. STRUCTURAL MODIFICATIONS AND RECOMMENDATIONS

Throughout the term of this contract, the Contractor shall be responsible for advising the COR about any structural, sanitary, or procedural modifications that would reduce pest food, water, harborage, or access. The Contractor shall be responsible for adequately suppressing all pests included in this contract regardless of whether or not the suggested modifications are implemented. The Contractor will not be held responsible for carrying out structural modifications as part of the pest control effort. However, minor applications of caulk and other sealing materials by the Contractor to eliminate pest harborage or access may be approved by the COR on a case by case basis. The Contractor shall obtain the approval of the COR prior to any application of sealing material or other structural modification.

13. PROGRAM EVALUATION

The COR will continually evaluate the progress of this contract in terms of effectiveness and safety, and will require such changes as are necessary. The Contractor shall take prompt action to correct all identified deficiencies.

14. QUALITY CONTROL PROGRAM

The Contractor shall establish a complete quality control program to assure the requirements of the contract are provided as specified. Within five (5) working days prior to the starting date of the contract, the Contractor shall submit a copy of his program to the Contracting Officer.

The program shall include at least the following items:

A. Inspection System: The Contractor’s quality control inspection system shall cover all the services stated in this contract. The purpose of the system is to detect and correct deficiencies in the quality of services before the level of performance becomes unacceptable and/or the COR identifies the deficiencies.

B. Checklist: A quality control checklist shall be used in evaluating contract performance during regularly scheduled and unscheduled inspections. The checklist shall include every building or site serviced by the Contractor as well as every task required to be performed.

C. File: A quality control file shall contain a record of all inspections conducted by the Contractor and any corrective actions taken. The file shall be maintained throughout the term of the contract and made available to the COR upon request.

D. Inspector(s): The Contractor shall state the name(s) of the individual(s) responsible for performing the quality control inspections.
