Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Technical Factor I:
Factor I will be evaluated on an Acceptable/Unacceptable basis utilizing the Technical
Acceptable/Unacceptable ratings in Table 1 below. In order to be considered Acceptable, quoters must receive an acceptable rating to demonstrate they are fully capable of meeting the Section 2.0, 4.0, 5.0 and 6.0 in the SOW through their submission. The quoter must address these specifications in sufficient detail so that the Government can reasonably determine that the quoter possesses the ability to deliver a compliant hotel venue.
Table 1-Technical Acceptable/Unacceptable Ratings Table
Technical Rating Description
Acceptable Quoter meets the requirements of the solicitation
Unacceptable Quoter does not meet the requirements of the solicitation
A rating of "Unacceptable" for Factor 1(See 52.212-1 Addendum) means that the offeror's quote is not awardable and will not be further evaluated.
Quoters simply providing general statements or paraphrasing/parroting the SOW in whole or in any part shall be rated unacceptable.
The Government will award on the basis of technical acceptability and price unless the contracting officer is aware of past performance information related to the low price quote/offer which indicates that quote/offer may not represent best value. In that case, the Government reserves the right to consider the past performance of other quotes/offers, conduct a technical acceptability, price, past performance tradeoff, and award to other than the lowest price quote/offer.
Price will be evaluated IAW FAR 12.203
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
(b) . The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the Options (if applicable) basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) . A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in Notice of award the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
Addendum to Evaluation - Commercial Product and Commercial Services
The Government intends to award a Firm-Fixed-Price (FFP) purchase order as a result of this solicitation in accordance with FAR Part 12-Acquisition of Commercial Products and Services. Award will be made to that quoter whose quote is most advantageous to the Government under the selection criteria set forth in this solicitation. The Government intends to evaluate quotes and award a purchase order based on initial quotes. Therefore, the quoter's initial quote should contain the quoter's best terms from a non-price and price standpoint. However, the Government may contact any or all quoters with questions concerning their responses. The Government reserves the right to award a purchase order to other than the lowest priced quoter; award a purchase order without exchanges; or award a purchase order after exchanges, whichever is in the best interest of the Government.
The Government intends to award a FFP purchase order to the responsible Quoter whose quote represents the best value after evaluation in accordance with the factors in the solicitation The Quoter's quote by utilizing the Tradeoff Source Selection process.
shall be in the form prescribed by and shall contain a response to each of the areas identified in ADDENDUM TO FAR 52.212-1 of the solicitation.
The evaluation of quotes will consider the non-priced Quote to be significantly more important than the Price Quote. Within the non-priced quote, Factor I-Technical and Factor II-Past Performance are of equal importance.
Factor I: Technical
The quoter's technical submission will be evaluated on its feasibility, comprehensiveness, and the degree to which the quoter demonstrates its understanding of, and capability to successfully accomplish, the qualifications requirements listed above in the
Instructions to Offerors to the solicitation.technical factor I in Addendum FAR 52.212-1
The technical submission will be evaluated on an Acceptable/Unacceptable basis utilizing the "Acceptable/Unacceptable" rating Table below. Quoters receiving an 'Unacceptable' rating will be considered un-awardable and will not be further evaluated.
Quoters simply providing general statements or paraphrasing/ parroting the PWS in whole or in any part may receive a rating of unacceptable.
Factor II - Past Performance
The past performance evaluation factor assesses the degree of confidence the Government has in a quoter's ability to meet the contract's requirements based on the quality of a demonstrated record of recent and relevant performance. There are three aspects to the past performance evaluation: recency, relevancy, and quality. These are combined to establish a single performance confidence assessment rating for each quoter.
Past Performance Recency: Recency is the first aspect of the past performance evaluation and is the time period during which past performance references are considered relevant. Recency is critical to establishing the relevancy of past performance information. For purposes of this solicitation, recent past performance is performance that has taken place within five (5) years as of the issuance date of this solicitation. Performance outside of this stated period will not be considered for evaluation purposes.
Past Performance Relevancy: Regarding relevancy, each past performance reference under each quoter's Past Performance submission will be evaluated to determine its scope and magnitude relative to the instant requirement. The following definitions will apply to this evaluation:
- Scope: Experience in the areas described in PWS sections 2.0, 4.0, 5.0 and 6.0 (inclusive of subsections).
- Magnitude: The similarity of the dollar value of actually performed work that exists between the PWS and the quoter's referenced contracts during the stated five-year period established by the solicitation.
The relevancy rating assigned to each past performance reference will be considered in determining the weight to be given to that reference in the overall Past Performance Confidence Assessment. References determined to be "Not Relevant" will not be further considered. Similarly, the quality of performance under a past performance reference that has no relevance to the instant requirement will not be considered in the overall assessment of past performance confidence. In determining the rating for the past performance factor, past performance of greater relevancy will have more influence on the past performance confidence assessment than past performance of lesser relevance.
Past Performance Quality: The third aspect of the past performance evaluation is to establish the overall quality of the quoter's past performance. The Government will review all past performance information collected and determine the quality of the quoter's performance, including general trends and usefulness of the information, and will incorporate this into the performance confidence assessment.
Past Performance Confidence Assessment: The overall assigned rating for past performance will be the Past Performance Confidence Assessment rating, defined in the table below. The assignment of this rating will be based on the overall quality of the recent and relevant past performance and will also consider the source of the information, the context of the data, and general trends in the quoter's performance. The quality of performance under a past performance reference that has no relevance to the instant requirement will not be considered in the overall assessment of past performance confidence. Evaluation will focus only on work already performed. Work yet-to-be performed will not be considered.
If the quoter's past performance is determined to be not relevant as defined in the solicitation, then the quality of the quoter's past performance will not be evaluated through a confidence assessment and the past performance factor will be rated as "Neutral Confidence." If an quoter's past performance is determined to be relevant, then each past performance reference under the quoter's past performance submission that contributed to the determination of relevance (i.e., each reference that is rated at least somewhat relevant) will be evaluated to determine the quality of the quoter's performance under that reference. The quality of performance on contract references that are rated Not Relevant is not evaluated even when the overall past performance is found to be relevant.
In the case of quoters for which there is no information on past contract performance or where past contract performance information is not available, the quoter may not be evaluated favorably or unfavorably on the past performance factor. In this case, the quoter's past performance is unknown and assigned a performance confidence rating of "Neutral Confidence." Although an quoter that lacks recent, relevant past performance may not be rated favorably or unfavorably with regard to past performance, the Government may determine that a "Substantial Confidence" or "Satisfactory Confidence" past performance rating provides better value to the Government than a "Neutral Confidence" past performance rating.
