52.252-2 Clauses Incorporated by Reference. (Feb 1998)
RFO Provision 52.212-2, Evaluation -- Commercial Items, applies to this acquisition.
As prescribed in RFO12.205(a),the following addendum is provided for this solicitation and hereby amends any language therein:
Basis for Contract Award. The Government intends to award a contract resulting from this solicitation to a single source that meets the instructions outlined in 52.212-1, and the requirements outlined in this provision if price can be determined both fair and reasonable by the Contracting Officer, RFO 12.204(a). The Government is not limited to the quote that only meets the minimum described in the below factor(s) and provides the lowest price. However, if no quote received in response to the solicitation exceeds the minimum criteria outlined in this provision, as determined by the Government; then the Government intends to award a contract to the lowest priced offer that meets the instructions outlined in 52.212-1, and the minimum requirements outlined in this provision whose price can be determined both fair and reasonable and realistic by the Contracting Officer. The Government intends to make an award without conducting exchanges with vendors after the close of the solicitation. Therefore, vendors should provide their best available pricing and technical to the Government in their initial.
However, the Government reserves the right to enter into exchanges with all, some, or none of the offers at any time during the evaluation period if deemed in the best interests of the Government to do so.
The government will make a best value determination by weighing technical capability and price. A contract may be awarded to an offeror whose quote, while not the lowest-priced, provides the best combination of these factors to meet the government's needs. Tradeoffs between price and non-price factors may be made to ensure the best overall outcome but the government is not required to do so.
Evaluation Factors. The following factors shall be used by the Government to evaluate offerors for a best value determination:
Price. At minimum, the vendor must provide pricing in accordance with the instructions outlined in FAR 52.212-1. The vendor that provides the lowest price that can be determined both fair and reasonable and realistic by the Contracting Officer, RFO 12.204(a) may be given additional consideration for awardee selection. However, the Government is under no obligation to do so. The Government intends to only evaluate prices submitted under Combined Synopsis/Solicitation section Supplies. During the evaluation process the Contracting Officer will determine a "Total Evaluated Price" (TEP) for each offeror who is eligible. The TEP is determined by totaling the amount of line items identified in Combined Synopsis/ Solicitation section Supplies or Services and Prices/Cost. For the purposes of this evaluation, a price that is deemed too high while conducting the evaluation in accordance with RFO 12.204(a) would not be considered fair and reasonable. For the purposes of this evaluation, a price that reflects a lack of understanding of the contract requirement or displays an undue risk inherent to the vendors approach would not be considered realistic.
Technical Capability. At minimum, the vendor must provide documentation that outlines the technical specifications of the products to be provided. The specifications must articulate how the products priced by the vendor meets the technical requirements outlined in Attachment 1 - Statement of Work The vendor is to provide a total projected timeline to complete/.
deliver all items.

Authorized Deviations in Clauses (Nov 2020)
(a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the date of the clause.
(b) The use in this solicitation or contract of any Defense Federal Acquisition Regulation Supplement [insert regulation name] (48 CFR Chapter 2 ) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the name of the regulation.
