(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. 52.212-1 Instructions to Offerors--Commercial Products and Commercial Services (Deviation Date)
(a) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. As a minimum, offers shall include--
(1) The solicitation number;
(2) The name, address, telephone number of the Offeror;
(3) The Offeror's Unique Entity Identifier (UEI) and, if applicable, Electronic Funds Transfer (EFT) indicator;
(4) Information necessary to evaluate the factors contained in the provision at 52.212-2 or as described in the solicitation;
(5) Responses to provisions that require Offeror completion of information, representations, and certifications (other than those collected via the System for Award Management (SAM)); and
(6) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and any solicitation amendments.
(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(c) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.
(2) Any offer, modification, or revision received after the time specified for receipt of offers is "late" and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.
(d)Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror's initial offer should contain the Offeror's best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.
(e)Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed Offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.
(3) The overall ranking of all Offerors when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award.
(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.
(6) Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.

Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Technical Approach
The Government will evaluate the offeror's technical approach based on its feasibility and the degree to which it demonstrates a comprehensive understanding of the requirements in the Performance Work Statement (PWS).
The evaluation of the Technical Approach will be conducted in two phases. First, the Government will evaluate the offeror's written technical submission. Second, for those offerors deemed most highly rated based on the written submission, the Government reserves the right to request a live technical demonstration. An offeror not invited to provide a demonstration will be considered technically unacceptable and will be removed from further consideration for award. The final rating for the Technical Approach factor will be based on a combined assessment of both the written submission and the live demonstration (if held).
If conducted, the live technical demonstration will be evaluated on the following aspects:
User Interface and Experience: The offeror's ability to demonstrate an intuitive, "no-code" or low-code user interface that allows a non-technical user to perform key tasks, such as setting up a custom weather alert and generating a mission-specific forecast.
JWICS/C2/SIPR Integration Approach: The offeror's ability to demonstrate how their API data payload is structured and to articulate how this data would be visualized and manipulated within a representative JWICS/C2/SIPR interface, addressing potential challenges such as data latency and bandwidth limitations.
Clarity of Information: The offeror's ability to demonstrate how their platform clearly communicates complex meteorological information, such as model bias and operational impacts, to both expert forecasters and general operational planners.
Past Performance
The past performance evaluation results are an assessment of the offeror's probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror's record of relevant and recent past performance information that pertains to the services outlined in the solicitation requirements. Past performance information will be gathered from information provided by the offeror, information gathered from the Contractor Performance Assessment Reporting System (CPARS), and any other reasonable source that 20 CONS can obtain (surveys, telephone interview, etc.). There are two aspects to the past performance evaluation: a) recency & relevancy; b) performance acceptability.
Contractors must submit no more than three (3) recent and relevant contracts performed for Federal agencies or commercial customers where offerors performed as the prime contractor that demonstrate offeror's ability to successfully perform the scope and breadth of the requirements described in the Performance Work Statement of this solicitation. Past performance information submitted more than the first three contracts will not be evaluated.
Recency & Relevancy
Each vendor's present/past performance will be evaluated to determine whether it is recent and relevant. is defined as efforts where performance Recent past performance is ongoing or performed within the past three (3) years from the date of issuance of this solicitation. Each vendor's present/past performance will also be evaluated to determine whether it is relevant to the effort being acquired. includes performance of efforts involving requirements that are similar or greater in Relevant past performance scope and/or complexity than the effort described in this solicitation.
Each vendor's recent and relevant past performance will be evaluated, and the vendor will be assigned a single rating of "acceptable" or "unacceptable" based on the vendors probability of meeting contract performance requirements.
Rating Descriptions:
"Acceptable" - Based on the vendor's performance record, the Government a reasonable expectation that the vendor will successfully perform the required has effort, or the vendor's performance record is unknown.
"Unacceptable" - Based on the vendor's performance record, the Government reasonable expectation that the vendor will be able to successfully perform has no the required effort.
Price
The Government will evaluate the total proposed price for reasonableness. The price evaluation will consider whether the proposed price reflects a clear understanding of the requirements in the PWS and is consistent with the offeror's proposed technical approach.
(b) The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government Options.
may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
The total evaluated price will be determined by adding the value of each Contract Line Item (CLIN), plus 50% of CLIN 0003. The additional 50% of the CLIN 0003 prices represents the total cumulative price of RFO 52.217-8. Should IAW RFO clause 52.217-8 be exercised in the future, the price will be pro-rated to the actual performance required. Before a contract may be awarded, the contracting officer must determine the price fair and reasonable per RFO 15.
(c) . A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result Notice of award in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
