II.D. Technical Proposal

The Technical Proposal shall include the information requested below for the non-price factors described in Section VI. Non-Price Factors, when combined, are significantly more important than Total Evaluated Price.

The term "similar projects" shall be defined for evaluation purposes projects that meet all three elements of size, complexity, and type as further defined herein. The project requires the phased working of various aspects of the project as day-to-day functions of the Land Ports of Entry are accommodated for the full duration of construction with minimal impact on operations.

Each project need not contain every element, but the combination of projects should demonstrate the ability to perform these services in a satisfactory manner.

Similar in size projects are:

● Exceed $5,000,000 in total construction costs, two (2) projects completed in the last eight (8) years from the date of the Solicitation. One (1) of the two (2) project submissions can be incomplete; however, it must be 75% complete from the date of the proposal submission.

Similar in complexity projects are:

● Project is occupied during normal business hours to allow traffic flow to continue during construction

Similar in type projects are:

● A project consisting of major modernization or renovation for road repair of a Land Port of Entry (LPOE), complex, military base, commercial docks, or facility area, University Campuses, and highway road construction repair projects.

Additional examples include, but are not limited to, highways, airport runways, tarmacs, commercial dock areas, bridges, and distribution center projects.

● Projects involving Privately Owned Vehicles (POVs) and commercial primary inspection lanes with booths, secondary POV inspection area with inspection canopies, and road and paving site work that meet the minimum depth (8 inches thick) of concrete.

Examples of Projects NOT considered similar:

● Stand-alone parking lots, sidewalks, and driveways

GSA’s asphalt, concrete (and cement), glass and steel requirements establish numeric global warming potential (GWP) limits for each of the EPA-approved construction materials: concrete (and cement), asphalt, steel, and glass (IRA-Eligible Materials). For each IRA-Eligible Material, GWP limits have been established for the best performing 20% of materials in terms of embodied carbon, as reported in terms global warming potential (Top 20% Limits), the best performing 40% of materials in terms of embodied carbon (Top 40% Limits) and better than industry average (Better Than Average Limit). In accordance with its proposal, Contractor shall provide all IRA-Eligible Materials required for performance of the Contract in compliance with the following IRA Limits.

Note that a single project could count for multiple team members if they worked together on it. Team members having successfully worked together on similar projects is desirable, but not essential, and could result in additional favorable consideration during the evaluation.

Offeror’s Team is encouraged to provide information on problems encountered on the identified contracts and the project team’s corrective actions.

3. FACTOR 3 – Technical and Management Approach

Weight: 20%

a. FACTOR DESCRIPTION:

Factor 3 considers the Offeror’s understanding of the technical project goals, requirements, and risks associated with planning, managing, and controlling the work to achieve timely completion within scope and budget.

The Management Plan shall be tailored to this project and shall describe the Offeror’s technical approach on how the work will be accomplished on time and within budget. This factor considers proposed design-build experience in concrete placement, managing, sorting, and removal of concrete and demolition waste. In addition, the plan shall include the following:

Management Plan shall include an organizational chart indicating offeror’s organizational structure and key personnel listed by name and title and who will be full-time, part-time, and on or off site.

Management Plan shall include a narrative explaining quality assurance/quality control plan.

Management Plan shall include a schedule that is well planned and include phasing to provide the best possible outcome for design and construction activities while avoiding excessive shut down time.

b. MINIMUM STANDARDS

The minimum standard is met when the Offeror’s proposed Management Plan demonstrates the following:

● Includes all submittal requirements as listed in the next section.

● The Plan is tailored specifically for this project and includes detailed phasing arrangements.

● The Offeror has a comprehensive and logical plan for executing the design build project, performing quality control, managing resources, coordinating various trades, and coordinating with the government.

● The proposal has a logical schedule with major milestones identified and activities laid out in a critical path method (CPM) schedule.

● The Plan reasonably identifies the main risk drivers for this project with an acceptable mitigation strategy.

Some examples of when the standard is exceeded include:

● The Offeror’s Plan includes innovative ideas to minimize tenant impact.

● The Offeror has demonstrated experience with solving problems and tracking and controlling the schedule, resulting in time and cost savings.

● The firm’s management approach for coordinating the work of various trades with the GSA and the tenant agencies has been successfully implemented on more than two past projects, as evidenced by a brief description/narrative.

● The Risk Mitigation plan successfully addresses likely issues without impacts to performance or the Government.

● The Offeror identifies experience indicating superior understanding of the effort and resources required for coordinating and sequencing the work on similar construction projects, and that experience supports the Offeror’s ability to complete the requirements.

c. SUBMITTAL REQUIREMENTS:

The Offeror shall submit a Management Plan addressing the following critical components:

1. A narrative discussion of the management philosophy and plan for executing the project; discuss an effective system for controlling day to day project issues and potential changes.

2. An organizational chart delineating relationships and lines of authority for Key Personnel proposed for this project. The chart will identify who is on-site full time, off-site full time, and who is a combination of both.

3. Identification of risk articulating the unique risks for this project that are relevant and realistic. The Plan must identify the risk event, probability of occurrence, the impact of the event if it occurs and a description of the mitigation strategy used to manage the risk. Consider impacts on labor, materials, and equipment as a result of the Eagle Pass area market cost inflation.

4. Identify cost control methods and demonstrate how the Offeror intends to control costs during construction to ensure the project is completed within budget.

5. Preliminary project schedule that addresses all submittal requirements and provides sufficient detail to track and control construction of the project. The project schedule must be a CPM schedule that shows the sequencing of tasks (predecessors and successor relationships) and the critical path for a schedule that runs from the contract award date through the required date for contract completion. Include scheduling milestones on a bar chart or Gantt chart showing major actions necessary to successfully deliver the project. This schedule is not included in the factor or proposal page count limit.

6. Offerors shall provide a Design and Construction quality assurance/quality control plan that contains the Offeror’s methodology for controlling quality during both design and construction. The Plan shall also demonstrate how the Design-Build Contractor will attain the quality throughout both the design and construction portions of the Work. The Plan shall also address coordination and quality assurance surveillance plan of subcontractors.

7. Explanation of the firm’s plan to track and control the project schedule. Include plans for “recovery” if behind schedule.

4. FACTOR 4 – Sustainability: LEC Construction Materials

Weight: 15%

This project is funded in part by Section 60503 of the Inflation Reduction Act (IRA) of 2022, which provides funding for purchase of construction materials with substantially lower levels of embodied greenhouse gas emissions.

GSA’s IRA Low Embodied Carbon (LEC) asphalt, concrete (and cement), glass and steel requirements establish numeric global warming potential (GWP) limits for certain EPA-approved construction materials: concrete (and cement), asphalt, steel, and glass (IRA-Eligible Materials).

For each material, GWP limits have been established for the best performing 20% of materials in terms of embodied carbon (Top 20% Limits), the best performing 40% of materials in terms of embodied carbon (Top 40% Limits), and better than industry average (Better Than Average Limit).

This Evaluation Factor calls for Offeror commitments to furnishing IRA-Eligible Materials with the lowest possible GWP values. IRA Limit commitments proposed under this evaluation factor will be incorporated into the successful offeror’s resultant contract.

Individual materials’ GWP values may be found on individual manufacturers’ environmental product declarations (EPDs). EPDs must meet the standards reflected in GSA’s IRA Low Embodied Carbon asphalt, concrete (and cement), glass and steel requirements (see Compliance Documentation criteria listed for each IRA-Eligible Material).

Technical Acceptability

Offerors will only meet the standard for technical acceptability under this Factor if they commit to furnish all required IRA-Eligible Materials with a GWP better (lower) than each IRA-Eligible Material’s Better Than Average Limit.

Scoring

Offerors meeting the standard for technical acceptability will receive a number of Raw Scores, one for each IRA-Eligible Material required by the Contract:

● Offerors will receive a Raw Score of 100 for each IRA-Eligible Material commitment that is better (lower) than GSA’s Top 20% Limits.

● Offerors will receive a Raw Score of 40 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Top 40% Limits.

● Offerors will receive a Raw Score of 20 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Better Than Average Limit.

Offerors shall complete the “IRA Sustainability Factor Table” attached to this solicitation (Attachment 4) by filling out the applicable IRA Limit they commit to meet for each IRA-Eligible Material. Based upon the offeror’s selection in the “IRA Limit Commitment” column, the associated Raw Score, the Weighted Score, and the Total Weighted Score will be automatically calculated.

In addition, for each IRA-Eligible Material identified in the IRA Sustainability Factor Table, offerors shall submit EPDs listing that material’s GWP. Such EPDs must meet the standards reflected in GSA’s IRA Low Embodied Carbon asphalt, concrete (and cement), glass and steel requirements (see Compliance Documentation criteria listed for each IRA-Eligible Material).

Raw Score Supplement Offerors will receive a supplemental 10 points on Raw Scores for each IRA-Eligible Material where the material’s submitted EPD reflects the lowest GWP value received in the competition for that material. For instance, where two offerors propose materials meeting the Top 20% Limit for glass, and Offeror A submits a glass EPD reflecting a GWP value lower than that reflected in Offeror B’s glass EPD, Offeror A and B will receive raw scores of 100 and 90 for that material, respectively. During evaluations, the Government will add Raw Score Supplements, if any, to offeror’s Preliminary Weighted Scores to calculate Final Weighted Scores. In the event of a tie for lowest-GWP values for a given material, those tied offerors will all receive the Raw Score Supplement for that material.

Note 1: By submitting an offer, Offeror consents to unrestricted GSA use of supplier names and the GWP values associated with supplier materials. Such information may be disclosed publicly or used to inform other low embodied carbon procurement activities. Technical solutions, supplier pricing and supplier-offeror terms and conditions will not be shared. Any objection shall be transmitted to the Contracting Officer by the due date for offers and shall adhere to 41 C.F.R.

§ 105-60.601.

Note 2: For each offeror that is unable to submit any of the compliant EPDs by the proposal due date, the offeror shall submit a statement for each such missing compliant EPD (a) certifying that it is unable to submit a compliant EPD by the proposal due date, and (b) promising to submit a compliant EPD within 120 days from the contract award ((a) and (b) collectively constituting an “EPD Pledge”). Failure by an offeror to submit either a compliant EPD or an EPD Pledge (as described in the immediately preceding sentence) for each IRA-Eligible Material listed in the IRA Sustainability Factor Table by the proposal due date shall result in the offeror’s proposal being unacceptable. Offerors submitting an EPD Pledge in lieu of a compliant EPD for a given IRA-Eligible Material will not be eligible for a Raw Score Supplement for that material, as described above.

Any awardee that submitted an EPD Pledge in lieu of a compliant EPD for a given IRA-Eligible Material will still be bound by IRA Limit Commitments made in their IRA Sustainability Factor Table. Note as well that the contract resulting from this solicitation shall have the following provision: “Within 120 days after contract award, the Contractor shall submit a compliant EPD for any IRA-Eligible Material for which the Contractor was unable to submit a compliant EPD by the proposal due date (if any). Such EPD must reflect GWP values that comply with the IRA Limit Commitments incorporated into the contract. GSA shall not issue a Notice to Proceed with construction services to the Contractor until the Contractor has submitted a compliant EPD for each IRA-Eligible Material for which the Contractor was unable to submit a compliant EPD by the proposal due date.”

(1) The Sustainability Factor will be scored as outlined in this Section above.

(2) GSA will verify Offeror’s scoring and that IRA Limits are supported by environmental product declarations (EPDs) from proposed suppliers.

(3) GSA will verify that Offeror’s EPDs adhere to EPD standards reflected in GSA’s IRA Low Embodied Carbon asphalt, concrete (and cement), glass and steel requirements (see Compliance Documentation criteria listed for each IRA-Eligible Material).

(4) GSA will make any scoring adjustments necessary to correct patent errors.

Once GSA has verified the Offeror’s scoring and, if necessary, made any corrections, the overall weighted score will be assigned an adjectival rating, as follows:

Weighted Score Adjectival Rating

100 points Exceptional

90-99 points Very Good

20-89 points Satisfactory

Unacceptable Unacceptable

Note 1: Any proposal that does not meet the standard for Technical Acceptability will be rated as “Unacceptable” under this factor and will be ineligible for award.

Note 2: Any proposal that furnishes all required IRA-Eligible Material with a GWP better (lower) than GSA’s Top 20% Limits will receive a Total Weighted Score of 100 points (Exceptional), with Raw Score Supplements potentially increasing the Total Weighted Score to 100 points.

Note 3: If an EPD is not available, GSA will review the offeror’s EPD Pledge.
