10A-144(f).

2. If any federal, State, or County law or federal or state contract or grant requires payment of a higher wage or precludes compliance with § 10A-144, that law shall prevail.

3. A Contractor must not split or subdivide a contract, pay an employee through a third party, or treat an employee as a subcontractor or independent contractor, to avoid imposition of any requirements under § 10A-144.

The Contractor is jointly and severally liable for subcontractor noncompliance. An aggrieved employee, as a third-party beneficiary, may enforce payment of wages due under § 10A-144 by civil action and recover unpaid wages with interest, reasonable attorney’s fees, and damages for retaliation (§ 10A-144).
