Contractual Services Officer

Email: NLCharity@co.pg.md.us

1.6 Contract Duration: The Start Date will be the date of award or notice to proceed from the Purchasing Agent or designee. The Contract term is continuous and does not lapse between snow seasons. The base period begins on the date of award and continues through June 30, 2027, with two (2) one-year option periods. If, at the time of any contemplated exercise of an option to extend the term of this Contract, the Contract is not in compliance with any participation requirements of this solicitation, the Contract shall not be extended.

1.7 The Contractor’s obligations to pay invoices to subcontractors that provided services during the Contract term, as well as the audit, confidentiality, document, and indemnification obligations of the Contract shall survive expiration or termination of the Contract and continue in effect until all such obligations are satisfied.

1.8 Each prospective Contractor shall become fully informed as to the extent and character of the work required. No consideration will be granted for alleged misunderstanding of the material to be furnished or work to be performed.

1.9 This solicitation is conducted under the procedures of Section 10A of the Prince George’s County Code.

However, it remains the responsibility of all prospective Contractor’s to check all applicable websites for amendments issued prior to the submission. Failure to acknowledge receipt of an amendment does not relieve the Contractor from complying with the terms, additions, deletions, or corrections set mailto:NLCharity@co.pg.md.us forth in the amendment, and may cause the bid/proposal/quote to be rejected as being non-responsive to the requirements of the solicitation.

1.12 Cancellation of Solicitation. The County reserves the right to cancel this solicitation, or accept or reject any and all submissions, in whole or in part.

1.13 Confidentiality of Offer/Bid Submissions. Offerors must specifically identify those portions of their proposals, if any, which they deem to contain confidential, proprietary information or trade secrets and must provide justification on why such material should not, upon request, be disclosed by the County in accordance with the

1.14 Offerors may elect to take minor exceptions to requirements of the RFP except pricing, the Statement of Work, insurance, submission requirements, or material contract terms. Any exceptions will be evaluated based on the intent of the Contract. Exceptions may be considered only if they are submitted with the technical proposal submittal. All exceptions will be taken into consideration when evaluating the Offeror’s Proposal. The County reserves the right to accept or reject any exceptions.

1.15 Award Basis. The County intends to award one or more contracts to responsive and responsible Offerors meeting the qualification criteria set forth in Section 5. Evaluation is qualifications-based, not price-based, as described in

Section 5.8; the County has established uniform hourly crew rates set forth in Attachment A (Pricing Schedule), and price is not an evaluation factor.

1.16 Incurred Expenses. The County will not be responsible for any costs incurred by any Contractor in preparing and submitting a response to this solicitation.

1.17 Substitution of Key Personnel. If this solicitation requires that a particular individual or personnel be designated by the Contractor to provide services in the resulting award, any substitution of key personnel after the contract has commenced must be approved in writing by the Purchasing Agent prior to the substitution. If the Contractor substitutes key personnel without the prior written approval of the Purchasing Agent, the contract may be terminated for default which shall be in addition to, and not in lieu of, the County’s remedies under the Contract or which otherwise may be available at law or in equity.

Form” are included as Attachments to this solicitation. The required form(s) must be completed, signed, and submitted with your bid, proposal, or quote. Failure to submit the required certification and pricing information on the prescribed form(s) will render the bid, proposal, or quote non-responsive under County law and it will be rejected.

1.22 Personnel and Equipment. The Contractor represents that it has, or shall secure at its own expense, all personnel required to perform the services under this Contract. Such personnel shall not be employees of, nor have any contractual relationship with, the County. All such changes shall be directed in writing by the Purchasing Agent or designee. The Contractor shall continue performance in accordance with the contract pending resolution of any equitable adjustment that may result from the change. If the Contractor believes that a directed change entitles the Contractor to an adjustment of the contract term, the contract scope, or any other contract right, the Contractor shall submit a written request for adjustment to the Procurement Officer within thirty (30) calendar days of the County’s written direction. Failure to submit a written request within this period shall constitute a waiver of any claim for adjustment arising from the directed change.

The rates set forth in Attachment A (Pricing Schedule) shall not be adjusted as a result of any change directed under this section during the base period. Option-year rate adjustments, if any, are governed exclusively by

Attachment A and the Statement of Work and are limited to not more than three percent (3%) per year.

Adjustments to other contract terms resulting from a directed change shall be effected by written contract amendment executed by the Purchasing Agent in accordance with GTC § 21. No verbal direction by any County employee shall be binding on the County, and the Contractor shall not undertake any work outside the general scope of the contract without prior written authorization by the Purchasing Agent or designee.

SECTION 3

STATEMENT OF WORK

3.1 Purpose and Background

The Prince George’s County (“the County”) Office of Procurement, Business Services Division (“OOP”), on behalf of the

County’s Department of Public Works and Transportation (“DPW&T”), is soliciting qualified, experienced, and properly equipped contractors to provide comprehensive snow and ice removal services for designated sidewalks, shared-use paths, and bridge sidewalks throughout the County’s maintained network. This initiative is being advanced in response to increasing pedestrian activity, heightened risk exposure associated with winter weather events, and the County’s obligation to maintain safe, accessible, and passable pedestrian infrastructure.

The purpose of this contract is to establish a reliable and scalable service delivery model that ensures the timely clearing and treatment of pedestrian facilities during and following snow and ice events. The County recognizes that sidewalks and bridge walkways present unique operational challenges and safety risks, particularly in high-traffic areas and critical access corridors. As such, this effort is intended to supplement, not replace, County roadway snow operations by deploying dedicated contractor resources focused exclusively on pedestrian infrastructure.

The County’s objective is to maintain continuous, safe, and Americans with Disabilities Act (ADA)-compliant pedestrian access to priority locations, including but not limited to transit stops and corridors, public schools, emergency service facilities, and high-volume commercial areas. These locations are essential to maintaining mobility for residents, including those who rely on walking, public transportation, or mobility assistance devices, particularly during and immediately following winter weather events.

This contract also reflects a broader strategic alignment with regional best practices, as peer jurisdictions have implemented standalone sidewalk and pedestrian snow removal programs to address service gaps and mitigate risk. By establishing a formalized and performance-driven contract structure, the County seeks to improve operational efficiency, ensure accountability, and deliver consistent service levels across all designated pedestrian routes.

Additionally, this initiative supports the County’s commitment to public safety, risk mitigation, and equitable service delivery. Timely and effective snow and ice removal on pedestrian infrastructure is critical to reducing slip and fall incidents, limiting potential liability, and ensuring that all residents, including vulnerable populations, have safe access to essential services. This effort directly advances the County’s Vision Zero objectives by prioritizing the safety of all roadway users and reinforces its commitment to a multimodal transportation network that is accessible, resilient, and responsive to winter weather conditions.

3.2 Scope of Work

The Contractor shall furnish all labor, equipment, materials, supervision, and incidentals necessary to perform comprehensive snow and ice removal and mitigation services on designated public sidewalks, shared-use paths, and bridge sidewalks, as directed by the County. Services shall be performed in a timely, continuous, and workmanlike manner to ensure safe, passable, and ADA-compliant pedestrian access during and following winter weather events.

The Contractor’s responsibilities shall include, but are not limited to, the following:

• Clearing snow and ice from sidewalks and bridge sidewalks to a minimum continuous passable width of thirty-six (36) inches, or greater where site conditions allow, ensuring accessibility for pedestrians and mobility devices.

• Application of approved ice-melting agents, deicers, or abrasives, as necessary, to prevent refreezing and to maintain safe walking conditions. Materials shall be applied in a manner that is effective, controlled, and minimizes environmental impact.

• Removal and relocation of snow in a safe and controlled manner to avoid obstruction of pedestrian pathways, vehicular travel lanes, drainage systems, fire hydrants, curb ramps, transit stops, and other critical infrastructure.

• Maintenance of accurate and complete work logs, including but not limited to personnel hours, equipment utilization, material usage, service times, and locations serviced, in accordance with County reporting requirements (see SOW

§3.5).

• Execution of services at designated locations (see SOW §3.7), which shall be assigned by the County’s Office of

Highway Maintenance (OHM) prior to and/or during snow events. Contractors shall remain flexible and responsive to real-time operational adjustments and reassignment as directed by the County.

• Continuous monitoring and re-servicing of assigned areas as necessary to maintain passable conditions throughout the duration of the event and until otherwise directed by the County.

Target service areas may include, but are not limited to:

1. Bridge sidewalks, overpasses, and elevated pedestrian facilities

2. Sidewalks adjacent to County-maintained arterial roadways and major thoroughfares

3. Bus stop landing pads, transit access points, and ADA curb ramps

4. Public access ways in proximity to County buildings, schools, emergency facilities, and other priority public assets

All work shall be performed in a manner that prioritizes public safety, minimizes disruption, and ensures compliance with all applicable accessibility standards and County performance expectations.

3.2 Contractor Responsibilities and Tasks

Activation Criteria

3.2.1 Threshold for Activation:

Contractor services will be activated only when snow accumulation exceeds two (2) inches, as determined by projected measurements or as otherwise directed by OHM based on field assessments or National Weather Service forecasts.

3.2.2 Activation Process:

The Contractor shall not commence work unless expressly directed to do so by the County via written or verbal notice from

DPW&T Office of Highway Maintenance (OHM).

Upon activation, the Contractor must acknowledge the deployment order within thirty (30) minutes and mobilize assigned crews within two (2) hours. Contractor’s acknowledgement shall be provided via text message, telephonic, or email. See

SOW §3.9.

3.2.2.1 To ensure effective communication with all field personnel, especially in diverse workforce settings, the Contractor is required to have staff available and on-call during all operational periods. These supervisors must be capable of communicating effectively with non-English- speaking operators to relay critical instructions, safety updates, and operational changes as directed by the County.

The presence of bilingual supervisors is a mandatory requirement to promote operational clarity, reduce response delays, and ensure compliance with County directives. Failure to maintain this standard may result in performance penalties or removal from active status. This requirement shall be satisfied within the standard Crew Rate set forth in Attachment A and shall not be submitted or billed as a separately priced line item.

3.2.3 Stand-By Status:

The County may place the Contractor on formal “stand-by” status in advance of forecasted snow events. Stand-by designation must be issued in writing by OHM and shall not exceed twelve (12) hours unless extended by the County. See

SOW §3.6.2. Stand-by operations will be paid at 50% of the approved hourly rate.

3.2.4 Snow and Ice Removal

• Remove snow to a minimum width of thirty-six (36) inches, ensuring ADA compliance and unobstructed passage

• Prevent snow accumulation from interfering with access to crosswalks, hydrants, bus stops

• Apply environmentally safe, pre-approved de-icing materials immediately after snow removal to prevent surface refreezing

3.3 Material Supply

3.3.1 The Contractor shall be solely responsible for providing all required ice-melting materials, abrasives, and transport containers.

3.3.2 All materials must be approved by the County prior to the start of the season through Safety Data Sheet (SDS) submittal process. SDS information must be submitted via email or hand delivered to the Office of Highway Maintenance during equipment inspections or no later than December 1. See SOW §3.9

3.3.3 Materials used must not corrode structural steel, concrete surfaces, or stormwater inlets and must be comparable to those used by MDOT SHA.

3.4 Crew Deployment and Equipment

3.4.1 Required Minimum Equipment per Crew formation:

A “Crew” shall be defined as a minimum of four (4) crew members plus one (1) supervisor (five (5) personnel total), assigned to operate as a single, self-sufficient unit capable of performing sidewalk and pedestrian facility snow and ice removal operations. Each crew shall be equipped, at a minimum, with the following:

• Four (4) walk-behind snow blowers and/or powered brooms (gas or electric), maintained in good working order and…
