SECTION B - Supplies or Services and Prices/Costs
Section B – Fixed Price
B.1 BRIEF DESCRIPTION OF SERVICES
This requirement is to obtain highly specialized recruiting services for attorneys including executives and senior managers with specific, extensive expertise in areas of critical need for The Office of the General
Counsel (OGC) and the Department.
B.2 TYPE OF CONTRACT
The acquisition will result in a firm-fixed-price purchase order with fixed unit prices for successful placements. Quotations shall not propose percentage-based fees, salary multipliers, contingent percentage commissions, or fees calculated from a candidate’s salary, grade, step, bonus, relocation amount, or other compensation.
B.3 SEVERABLE SERVICES
The services acquired under this contract are severable services. Funds are only available for use for the contract line item (CLIN) to which they are obligated. Unused funds from one CLIN may not rollover for use in other periods.
B.4 CONSIDERATION AND PAYMENT
In consideration of satisfactory performance of the work as described throughout this purchase order, the
Contractor shall be paid only for accepted placement milestones at the fixed unit prices established in the order. The estimated placement quantities are provided for evaluation and planning purposes and do not guarantee any number of placements unless otherwise stated in the order. If options are exercised, funding will be obligated by modification to the purchase order. The base period and option periods are priced as follows:
CLINs Contract Period Estimated Placement
Quantity
Fixed Unit Price /
Extended Price
CLIN 1 Base Period 22 $
CLIN 2 Option Period 1 12 $
CLIN 3 Option Period 2 8 $
CLIN 4 Option Period 3 5 $
CLIN 5 Option Period 4 3 $
TOTAL EVALUATED PRICE (Base + Options) $
Payment shall be made only after COR acceptance of the applicable milestone in accordance with the following fixed, non-percentage payment structure:
Fixed Placement Payment Structure
The Contractor shall quote a fixed unit price per successful placement for each CLIN period.
For each successful placement, payment shall be made in two installments: (1) forty percent (40%) of the applicable fixed unit price after the candidate enters on duty (EOD) and the COR accepts the final placement report; and (2) sixty percent (60%) of the applicable fixed unit price after the candidate remains continuously employed in the position for thirty (30) calendar days following EOD and the COR accepts the 30-day onboarding confirmation.
1) No separate referral payment is authorized. Candidate referrals, candidate assessment packages, recruitment status reports, and other pre-placement deliverables are included in the applicable fixed unit prices and are not separately billable unless expressly stated in the purchase order.
2) The Contractor shall not submit an invoice for a placement milestone until the COR has accepted the applicable milestone deliverable.
If a hired candidate voluntarily leaves before one year for reasons not caused by the Government, the
Contractor shall perform one replacement search at no additional charge. In the case of Option Year 4, if a candidate leaves before six months for reasons not caused by the Government, the Contractor shall perform one replacement search at no additional charge. Amounts already paid for the departing hire shall be credited against payment for the replacement placement, and no additional payment is due until the replacement candidate reaches the applicable unpaid milestone.
The Government will not owe payment for a candidate who is hired if that candidate submitted an application or was already under active Government consideration independent of Contractor efforts before the Contractor presented the candidate to OGC. At each Task 1 intake meeting, the COR will provide a list of candidates already under active consideration for that position.
