About this file
This is Amendment 0001 to Solicitation 75N71MN26R00051, a Request for Quotation (RFQ) under FAR Part 12 issued by the Office of the Assistant Secretary for Mission Support (OMAS) at HHS, located at 5600 Fishers Lane, Rockville, MD 20852. The amendment is effective September 9, 2026, and revises Section M.6.2 and provides responses to questions received during the solicitation's open question period.
The solicitation is for specialized legal recruiting services focused on placing attorneys in health law, life sciences, healthcare-regulatory, and closely related legal practice areas. Factor 2 (Specialized Legal Recruiting Experience) evaluates the quoter's organizational experience recruiting attorneys in specialized subject-matter areas including Medicare/Medicaid/CHIP, drug pricing/340B, ACA, fraud and abuse, HIPAA/health information governance, health IT, and complex federal healthcare litigation. The evaluation considers experience recruiting attorneys at seniority levels from attorney-advisor through associate general counsel and comparable leadership roles, experience placing candidates with active bar membership, and demonstrated recency and volume of placements showing established pipeline and market reach. The Government guarantees a minimum base period payment of $205,392 (equivalent to two successfully-placed GS-15 positions and one SES position), which does not carry over to option periods. Work is performed at the contractor's location with virtual coordination; no HHS facility access, background investigations, or HHS identification cards are required. There is no U.S. citizenship requirement, though contractor personnel must meet standard employment eligibility requirements. The amendment also clarifies that the two required senior recruiters need not be full-time if referral timelines and quality levels are met, and addresses how small businesses may leverage principal experience and how past performance references should be documented for key personnel.

M.6.2 FACTOR 2 - Specialized Legal Recruiting Experience
The Government will evaluate the quoter’s organizational (corporate) experience performing legal recruiting or executive-search services for attorneys in health law, life sciences, healthcare-regulatory, or closely related specialized legal practice areas. This factor measures depth and relevance of the quoter’s demonstrated experience, as distinct from Past Performance, which measures how well prior work was performed.
Evaluation elements:
● The Government will evaluate relevance of the quoter’s experience to the specialized subject-matter areas listed in PWS Section 3.0 Section C.2.1 (e.g., Medicare/Medicaid/CHIP, drug pricing/340B, ACA, fraud and abuse, HIPAA/health information governance, health IT, and complex federal healthcare litigation).
● The Government will evaluate experience recruiting attorneys at the seniority levels described in the PWS (attorney-advisor through associate general counsel and comparable leadership roles).
● The Government will evaluate experience placing candidates possessing active bar membership and specialized legal expertise and experience supporting employers with high qualification bars and hard-to-fill searches.
● The Government will evaluate recency and volume of relevant placements sufficient to demonstrate an established pipeline and market reach in these practice areas.
Standard/basis: The more relevant, recent, and substantial the quoter’s demonstrated specialized legal-recruiting experience, the more favorably it will be evaluated.

Question
Ref # (If
Provided) Question Answer
1 Factor 2 Would our life sciences recruiting experience be considered relevant under Factor 2, even though it has not specifically been legal recruiting? If not, could the experience of the two proposed senior recruiters satisfy that requirement?
Factor 2 looks at your company's experience recruiting attorneys in health law, life sciences, healthcare regulatory, or closely related legal practice areas. You may submit your life sciences recruiting experience and we will consider it, but it will be evaluated as less relevant than experience placing attorneys.
The experience of the two proposed senior recruiters is relevant if the experience meets the criteria and the proposed recruiters will perform in those functions for the contract.
2 Are the two required senior recruiters expected to be dedicated full-time to the contract, or can they support the work as needed?
They do not have to be full time. C.6 requires only that at least two senior recruiters assigned to the contract have the five years of experience described, so long as the referral timelines in F.3.1 and the acceptable quality levels in the QASP at C.7 are met.
3 Could you please clarify how the $205,392 minimum guaranteed payment in the base period is intended to work?
The $205,392.00 in M.9 is the Government's guaranteed minimum for the base period only. It does not carry over into the option periods, and option periods are funded only if they are exercised.
Payment runs through the milestone structure in B.4. The minimum guarantee for the base period is the equivalent of two successfully-placed GS-15 positions and one SES position.
4 Factor 2 For purposes of Factor 2, can a small business rely upon the relevant legal recruiting experience of its principal when that experience was gained through a legal search firm previously owned and operated by that principal, and the principal will personally manage and perform the work under this requirement?
If yes, should this experience be presented under Factor
2 as organizational experience, key personnel experience, or both?
Yes. The Government will consider the principal's legal recruiting experience under Factor 2 where that principal will personally manage and perform the work under this requirement.
The proposal should identify the firm where the experience was gained, the principal's role and the type, volume, and recency of the attorney placements involved, and the relationship between that firm and your company.
The experience may be presented under both factors.
5 Section L.8 Section L.8 permits Past Performance references for key personnel with relevant experience. When a proposed key person gained that experience while working for another company, may the client for whom
Yes. L.8 allows past performance references by the client for whom the work was performed. On the questionnaire, enter the company that actually held the contract in the Prime Contractor
Name field, or in the Subcontractor Name field if the work was
7571MN26R00051 (Q&A)
that individual performed the work complete the Past
Performance Questionnaire based upon the key person's performance? If so, how should the Prime
Contractor Name and/or Subcontractor Name fields on the questionnaire be completed?
performed under a subcontract. Identify the proposed key person by name and role in the description portion of the questionnaire.
6 Section F.2 The place of performance is described as "the
Contractor's primary place of performance with virtual coordination" (Section F.2). Will Contractor personnel require access to HHS facilities, sensitive information, or information systems that would trigger the background investigation and ID card process under clause 352.204-73?
No. Under F.2 the work is performed at the Contractor's own place of performance with virtual coordination, and the requirement does not include access to HHS facilities, sensitive information, or HHS information systems.
Clause 352.204-73 applies where agency access is required, and no risk or sensitivity level designations have been assigned to contractor positions under this requirement. Background investigations and HHS identification cards are not anticipated.
7 Is there any U.S. citizenship or U.S.-location requirement applicable to Contractor personnel who do not require HHS facility or system access (e.g., staff performing sourcing/screening remotely)?
No. There is no U.S. citizenship requirement and no requirement that Contractor personnel be located in the United States.
However, the contractor and its employees must still be authorized to work in the U.S. (i.e, meet standard employment eligibility requirements).
8 Is this a new requirement, or is there an incumbent contractor currently performing this or a substantially similar scope for OGC? If there is an incumbent, please identify the contractor, if releasable.
New requirement.
9 Section M.6.2 references "PWS Section 3.0" for the specialized subject-matter areas. Can the Government confirm this refers to the subject-matter list in PWS
Section C.2.1, as no numbered "Section 3.0" appears in the PWS as issued?
Confirmed. The reference to “PWS Section 3.0” in Section M.6.2 is intended to refer to the specialized subject-matter areas identified in PWS Section C.2.1.
10 Block 14 of the SF1449 indicates "Request for
Proposal," while Sections L and M describe RFQ procedures under FAR Part 12.6 (quotation is not an offer; no FAR Part 15 discussions). Can the
Government confirm this acquisition is being conducted as an RFQ under FAR Part 12?
Confirmed. This acquisition is being conducted as a Request for
Quotation (RFQ) under FAR Part 12. The reference to “Request for Proposal” in Block 14 of the SF 1449 is an administrative error. Sections L and M of the solicitation govern the quotation submission and evaluation procedures.
