Addendum 52.212-2---Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation)
(a) The Government will award a contract resulting from this solicitation Evaluation factors. to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors will be used to evaluate offers:
Technical
Price
Past Performance
BASIS FOR AWARD:
(1) Award will be made to a single offeror who is deemed responsible in accordance with the Federal Acquisition Regulations (FAR) Overhaul, whose quote conforms to the solicitation requirements, and whose quote, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, is the lowest priced technically acceptable (LPTA) offer. A determination of a fair and reasonable price will be conducted. The Federal Acquisition Regulation (FAR), as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS) and the Army Federal Acquisition Regulation Supplement (AFARS) will be used to evaluate the offer and award this requirement. The following factors shall be used to evaluate offers.
(2) This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR 15.2), Evaluation and Award, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Award will be made to a single offeror deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements (to include all stated terms, conditions, and all other information required by the solicitation), is determined to be a fair and reasonable price, and whose proposal, judged by an overall assessment of the evaluation criteria specified in this solicitation, represents the Lowest Priced Technically Acceptable (LPTA) offer. The Government will utilize an LPTA evaluation method for this requirement. Only those proposals determined to be Technically Acceptable will be eligible for award. Offerors whose technical proposals are determined "Unacceptable" will not be eligible for award. Furthermore, quotes with unacceptable ratings for past performance will not be considered for award. Trade-Offs between cost/price and non-cost/price factors are not permitted. Unreasonably, high, unbalanced, inaccurate or incomplete price proposals may be the grounds for eliminating a proposal from competition.
(3) As set forth in FAR 52.215-1(f)(4), the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.202(a)(2), clarifications and award without discussions). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event that discussions are held, a competitive range determination will be made. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit efficient competition among the rated technically acceptable proposals.
(4) The adjectival ratings to be utilized for proposal evaluations are Adjectival Ratings: consistent with the DoD Source Selection Procedures and the Army Source Selection Supplement (AS3). A single rating system will be used to evaluate Technical Capability and Past Performance (see tables below). The price submission will not be scored or rated. Price will be evaluated for reasonableness, completeness/accuracy, balance, and will not receive an adjectival rating.
(5) Evaluation criteria consist of factors. The quote will be evaluated Evaluation Criteria: under three evaluation factors:
Factor I: Technical
Factor 2: Price
Factor 3: Past Performance
The Government will evaluate the extent to which the offeror's technical Factor 1-Technical: proposal demonstrates:
(a) Body and Structural Repairs:
(1) The contractor shall remove and replace the damaged rub rails.
(2) The contractor shall remove and replace the fender crown.
(3) The contractor shall remove and replace two (2) Gortite roll-up doors, ensuring proper track.
(b) Fabrication, Paint and Bodywork:
(1) The contractor shall perform all necessary welding, sheet metal repair, bodywork, sanding to restore the structural integrity and contour of the affected area.
(2) The contractor shall paint, refinish and bluff the repaired side of the unit. The final finish shall seamlessly match the existing vehicle paint code, gloss, texture and with no visible transition lines.
(c) Decals and Graphics:
(1) The contractor shall manufacture (or procure) to install replacement graphics and striping on the rear passenger side. All graphics shall precisely match the existing Army/Command livery in size, color, font and reflective properties.
(d) Parts and Material Standards:
(1) All replacement components (specifically Gortite doors, rubrails and fender crowns) shall be New-Original Equipment Manufacturer (OEM) or functional equivalents that meet or exceed Pierce Manufacturing specifications.
(e) Operational Integrity and Cleanliness:
(1) Upon completion of repairs, the contractor shall ensure all electrical sensors or lighting associated with the replaced Gortite doors and body panels are fully functional.
(2) The contractor shall return the vehicle to the Government in a clean state, free of metal shavings, welding slag, sanding dust, paint overspray in the cab, compartments or chassis.
Note Must Acknowledge: All Maintenance Technicians must be certified by Pierce Manufacturing specialized in working on Fire Trucks. If this is not acknowledged by the contractor may result in their quotes being rejected by technical.
Price will not be scored or rated. Evaluation of price will be performed using Factor 2- Price: one or more of the price analysis techniques in FAR 15.404-1(b). Through these techniques, the Government will determine whether prices are reasonable, complete, and balanced. If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government-obtained information, additional information IAW FAR 15.4 may be required to support the quoted price. To be viable for award, an Offeror's price must be determined fair and reasonable. The Offeror's total quoted price will be utilized to evaluate if the quote represents a fair and reasonable price.
The past performance evaluation will assess the offeror's Factor 3- Past Performance: probability of meeting the solicitation's requirements as indicated by that offeror's record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offeror's recent past performance and focusing on performance that is relevant to the services being procured under this solicitation. Offerors are cautioned that in conducting the performance risk assessment, the Government will use data provided in the offeror's quote and data obtained from other sources, such as the Contractor's Performance Assessment Report System (CPARS) or similar systems and State Department Watch Lists.
(a) Each offeror will receive performance confidence assessment rating based on the offeror's recent past performance, focusing on performance that is relevant to the contract requirements.
(b) The Past Performance Evaluation Team will review this past performance information and determine the quality and usefulness as it applies to performance confidence assessment.
(c) Assigning Ratings. The Past Performance Factor will be assigned one of the ratings defined below.
Past Performance Evaluation Rating Table
The Technical Factor will receive one of the adjectival ratings defined below:
(d) A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Note: Technical and Past Performance is rated equally when combined.
