(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
EVALUATION METHODOLOGY
A. PROPOSAL EVALUATION FACTORS/CRITERIA
Proposals received will be evaluated in accordance with the instructions contained in this section.
B. IDENTIFICATION OF EVALUATION FACTORS
A detailed and complete analysis of each Offeror’s proposal will be performed. The Government contemplates the award will be made based on the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Tradeoffs are not permitted. Proposals are evaluated for acceptability but not ranked using non-cost/price factors.
Factor 1 – Technical Approach Factor 2 – Past Performance Factor 3 – Cost/Price
Factor 1 will be evaluated using an Acceptable or Unacceptable rating approach. The following ratings standards shall be used:
Rating Standards for Factor 1: Technical Approach
ACCEPTABLE UNACCEPTABLE
Proposal meets the requirements of the solicitation outlined in Sections 3.1, 3.2, 3.3, and 3.5.
Proposal does not meet the requirements of the solicitation outlined in Sections 3.1, 3.2, 3.3, and 3.5.
Factor 2 will be evaluated using an Acceptable, Unacceptable, or Neutral rating approach. The following ratings standards shall be used:
Rating Standards for Factor 2: Past Performance
Factor 3 will not be rated adjectivally or scored.
An Unacceptable rating for Factors 1 and 2 will result in the elimination of an Offeror’s proposal from consideration for award.
C. SOURCE SELECTION USING LOWEST-PRICED, TECHNICALLY ACCEPTABLE PROCESS
The proposal that provides the lowest price and is otherwise technically acceptable in all factors will be selected for award. To be considered technically acceptable, no technical factor in the proposal may be determined to be unacceptable. The failure of a proposal to meet any of the factors will result in a technically unacceptable rating and preclude award.
Offerors shall meet the requirements described in the performance criteria, as well as other solicitation requirements.
D. EVALUATION PROCESS
The evaluation process will be conducted in accordance with the Source Selection Plan (SSP), beginning with the release of the pre-solicitation notification and concluding with the debriefing of unsuccessful Offeror(s).
E. NOTIFICATION
A pre-solicitation notice will be issued via SAM.gov for 15 calendar days and the solicitation will be issued via SAM.gov for 30 calendar days after applicable reviews and approvals are completed.
F. QUESTIONS
The solicitation will describe procedures that allow for the Offerors to review the solicitation and ask questions up through an established deadline.
G. ANSWERS
The Government will provide all questions and their corresponding answers to all Offerors through the issuance of an amendment to the solicitation via SAM.gov.
H. PROPOSAL RECEIPT
All proposals will be submitted to the BEP Contract Specialist, Ariel Dillon and Contracting Officer, Brandy Idemudia, by no later than the established closing date and time for receipt of proposals. Proposals not received by the closing date and time will not be considered for award.
I. PROPOSAL OPENING
Proposals will be opened after the closing date and time specified in the solicitation. The Contract Specialist/Contracting Officer will perform an audit to ensure that proposals include all elements the solicitation requires. The cost/price volume will be properly abstracted and evaluated by the Contract Specialist and Contracting Officer. Offeror technical proposals deemed to be responsive will be forwarded to the SSET for the SSET’s evaluation.
J. EVALUATION OF PROPOSALS
ACCEPTABLE UNACCEPTABLE NEUTRAL
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
No recent/relevant past performance record is available, a meaningful assessment rating cannot be assigned
The evaluation process will be conducted and documented in accordance with the evaluation factors outlined in FAR 52.212-2 of the solicitation and this plan. The Government reserves the right to make award on initial offers. However, discussions may be required, if deemed necessary by the Contracting Officer.
K. TECHNICAL PROPOSAL EVALUATION
Each member of the SSET will review each Offeror's written technical proposal. Ratings, notes, comments, narrative discussion of strengths, weaknesses, and any deficiencies must be made within the individual evaluation forms, and not in the technical proposals.
The evaluators will not be allowed to perform any audio or video recordings of the evaluation process. When noting strengths, weaknesses, or deficiencies, the evaluator will not record observations in the evaluation form that may be categorized as inflammatory, biased, unfair, and should provide specific proposal references whenever possible. Evaluators should avoid presuming anything for or against the Offeror.
L. TECHNICAL PROPOSAL SSET OVERVIEW
Evaluation of Factor 1 – Technical Approach and 2– Past Performance, should be based strictly upon the contents of the technical proposal and not on personal knowledge of the Offeror's capability or performance (e.g., as an incumbent).
SSET members should know that each evaluation form completed must reflect an accurate and fair evaluation. Since each proposal must be evaluated against the evaluation criteria, and not in comparison against other proposals, evaluators must ensure their comments are consistent across proposals. For example, if one Offeror is given credit for a certain attribute, other Offerors whose proposal demonstrates the same attribute must be given the same credit. Consistency must be applied to both positive and negative comments across each and every proposal that features common attributes. Each SSET member’s evaluation form must stand on its own and be understood by other readers without any additional explanation or clarification. To avoid confusion, evaluators should cross out and initial any notes or evaluation form versions that no longer reflect the opinion delivered in their final product. Upon completion of the evaluation, draft evaluation forms will be destroyed.
Each SSET member shall assign an adjectival rating for each factor defined in the evaluation form, according to the criteria defined in FAR 52.212-2 of the solicitation. Furthermore, the SSET team will identify the strengths, weaknesses, deficiencies, and risks involved with each proposal received, and then assign an adjectival rating to each factor and subfactor. Each adjectival rating will be supported by a written discussion of the strengths, weaknesses, or other attributes that substantiates the evaluation rating. It is very important to provide an adequate narrative justification supporting findings. The SSET shall use the forms in Attachment 3.
FACTOR 1 – Technical Approach
The Technical Approach will be evaluated based on the following criteria:
Offeror shall provide a proposal to include a full description with specifications and capabilities of the proposed equipment. Equipment specification and capabilities must address all required specifications in the Statement of Work. Offeror shall also provide warranty information and delivery date for equipment. Brochures may be provided. However, brochures are not substitutes for not fully addressing the technical requirement. Failure to provide all specifications and equipment capabilities may deem the offer unacceptable and possible elimination from further consideration for contract award.
FACTOR 2 - PAST PERFORMANCE EVALUATION
Past performance will be evaluated to determine the Offeror’s performance relevancy for the subject solicitation. Past performance will be evaluated on how well the Offeror, as well as any proposed major subcontractors, performed the contracts/work referenced in the Offeror’s proposal. Past performance will also evaluate overall contract/work performance as it relates to quality, schedule, management, and cost control.
The Government will give consideration to relevant past performance over the past five (5) years. Relevant past performance is considered to be federal, state, and local government or commercial contracts/work performed or being performed that were/are similar in size, scope, and complexity in nature to the current acquisition. The Government shall make the determination as to the relevance of an Offeror’s past performance. Past Performance information shall be gathered from Government references identified by the Offeror.
The Government reserves the right to obtain past performance information from any and all sources including Contractor Performance Assessment Reporting System (CPARS) and sources outside the Government, regardless of whether such information has been referenced or provided by the Offeror. The Government also reserves the right to contact references and points of contact provided by the Offeror and otherwise verify statements and representations made in the Offeror’s proposal. The Government will determine which past performance data is most relevant. Past performance information obtained independently of the Offeror’s proposal may be more relevant than past performance information submitted by the Offeror. It is incumbent upon the Offeror to explain the relevance of the references provided. Offerors are reminded that while the Government may elect to consider data obtained from other sources, the burden of providing thorough and complete past performance source data rests with the Offerors.
In the case of an Offeror, together with any proposed major subcontractors, without a record of relevant past performance or past performance information is not available, a Neutral rating will be assigned to the Past Performance Factor.
FACTOR 3 - COST/PRICE PROPOSAL EVALUATION
The BEP Contract Specialist and Contracting Officer will conduct the evaluation of cost/price proposals. The principal basis for evaluating cost/price for award under this solicitation will be an evaluation of the fair and reasonableness of the Offeror’s proposal price in response to Section B, Supplies or Services and Prices/Costs. Cost/price proposals will be evaluated for completeness, accuracy, and reasonableness and to ensure that the Offerors understand the scope of the work included in the solicitation. Cost/price proposals will not be rated adjectivally or scored. The SSET will not have access to cost information during their evaluation. The Contracting Officer however, in consultation with the SSET may decide to make limited cost information available to corroborate certain information in either an Offeror’s technical or cost proposal. The cost/price evaluators will utilize appropriate price analysis techniques to determine the completeness and reasonableness of the proposals, to include: (1) comparison of competitive proposals, (2) comparison with Independent Government Cost Estimates, and (3) comparison with available market prices for the same or similar services. The cost/price that will be evaluated is the Offeror’s “total proposed cost/price.” As such, the Government will use any combination of the proposal analysis techniques stipulated under FAR Subpart 15.404 or FAR 13.106-3 to aid in the price evaluation process.
M. CONSENUS OF FINDINGS AND RANKINGS
Following completion of the individual technical and cost/price evaluations, the Contracting Officer will convene a “consensus meeting.”
At this meeting the Contracting Officer will identify any areas where outlier ratings exist and will encourage discussion of those areas to ensure that each member fully understands the issues and that members share their insights. In situations where one or more members decide to change their ratings on a certain factor based on this meeting, they will strike through their original rating, add the new rating, and write a brief narrative explanation as to how/why they decided to change their rating. Following completion of the consensus meeting, each member must sign his/her individual evaluation form and submit it to the Contracting Officer.
The SSET will gather the completed individual evaluation form (Attachment 3) for the Contracting Officer and will include each individual rating and supporting narrative statements into the final technical evaluation report. The SSET will generate its final report as follow:
