(End of Provision)

PROVISION 52.212-2, EVALUATION-COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES applies to this acquisition. The evaluation criteria included in paragraph (a) of the provision are as follows:

EVALUATION CRITERIA

The Government intends to award a single purchase order (PO) from this solicitation using simplified acquisition procedures for Certain Commercial Products and Commercial Services in accordance with FAR subpart 13.5. The Government will make an award, based on best value, to the vendor with the proposed solution that is most advantageous, price and non-price factors considered. When combined, non-price factors are more important than price. As the non-price factors become more equal among vendors, price shall become more of a determining factor. The Government reserves the right not to award a PO and to make an award without discussions based solely upon initial quotes.

Evaluation Factors:

1) Technical Approach: Evaluation of this factor is an evaluation of the vendor's demonstrated resources, capability and methods to meet all requirements. The vendor’s Technical Approach will be evaluated in terms of demonstrated understating of the requirements and demonstrated capability to meet or exceed the requirements. This may include the authority to provide the required items (i.e. authorized dealer/seller/reseller), authority to provide maintenance and repair services, and the capability and method to successfully meet all the requirements including but not limited to item specifications, delivery schedule, installation, warranty, etc. Requirement specifications must be met as established by certificate of analysis for each campus. Vendor proximity to NIST campuses may instill higher confidence.

2) Experience: Evaluation of this factor is an evaluation of the vendor’s experience, in terms of relevancy (similarity in scope, size and complexity), as a means of evaluating the capability of the vendor to successfully meet the requirements of the request for quotation. The vendor must show experience within the past five years delivering liquid nitrogen and being able to respond to technical problems remotely and on-site. Projects submitted for evaluation with a direct correlation to the proposed requirements may instill higher confidence than those with lesser relevance.

3) Past Performance: Evaluation of this factor is a subjective evaluation of how well the vendor performed on contracts/projects and a subjective evaluation of how relevant a recent contract effort is to the RFQ requirement. The Government reserves the right to review and consider any information contained within the Contractor Performance Assessment Reporting System (CPARS) or any other Government system, source, or individual contact any other source of information that may have knowledge or information on a vendor’s relevant past performance history. Projects submitted for evaluation with a direct correlation to the proposed requirements may instill higher confidence than those with lesser relevance. Vendors without any prior past performance will receive a neutral rating for this factor.

4) Price: The price quotation will be evaluated for consistency with the technical approach, current marketplace, and Independent Government Estimate. A price quotation that is found to be either unreasonably high or low in relation to the performance requirements may be indicative of an inherent lack of understanding of the RFQ requirements and may instill lower confidence. A price realism analysis will not be conducted. The price offer will be evaluated for reasonableness.

The option line items will be evaluated for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of any option shall not obligate the Government to exercise such option.

Evaluation Ratings:

The evaluation of each non-price factor (factors 1-3) may be done holistically with a rating scale of "high confidence," "some confidence," and "low confidence," representing the Government’s confidence that the vendor understands the requirement and will be successful in performing the work per factor.

High Confidence
The Government has high confidence that the vendor understands the

requirement, proposes a sound approach, and will be successful in performing the agreement with little or no Government intervention.

Some Confidence
The Government has some confidence that the vendor understands the requirement, proposes a sound approach, and will be successful in

performing the agreement with some Government intervention.

Low Confidence
The Government has low confidence that the vendor understands the requirement, proposes a sound approach or will be successful in performing the agreement even with Government intervention.

Once the Government determines the quoter that is the best-suited (i.e., the apparent successful quoter), the Government reserves the right to communicate with only that quoter to address any remaining issues, if necessary, and finalize a contract with that quoter. These issues may include technical and price. If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the Government, the Government reserves the right to communicate with the next-best-suited quoter based on the original analysis and address any remaining issues. Once the Government has begun communications with the next-best-suited quoter, no further communications with the previous quoter will be entertained until after the purchase order has been awarded. This process shall continue until an agreement is successfully reached and a contract is awarded.
