The PAI and NEO-PI-3 tests are also pre-approved for use on the Special Operations Command network. The period of performance is five years from award date of October 30, 2023. SOLE or LIMITED SOURCES JUSTIFICATION Determination Memorandum for Acquisitions Over $3,500 but not Exceeding the SAT
All solicitations and orders shall be competed unless a justification to limit competition using an exception in FAR Part 8, 13, or 16, as applicable to the acquisition, is approved by the Contracting Officer. When the customer describes an item or service, which limits the availability to one source or a particular brand name, there must be a technical explanation describing why only that specific one will meet the government’s requirement. Statements must be detailed and identify the harm that would come to the government (e.g. lack of capability or safety impact). The customer MUST COMPLETE all questions below, as applicable.

1. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES AND THE INTENDED USE.
2. THE CIRCUMSTANCE THAT REQUIRED LIMITING SOURCES TO A SINGLE MANUFACTURER OR SERVICE PROVIDER. (See FAR 8.405- 6(a)(1)(i) and (b)(1) for exceptions that apply to orders under GSA schedules. See FAR 13.106-1(b)(1)(i) for open market purchase exceptions. See FAR 16.505(b)(2)(i) for exceptions that apply to orders against multiple award contracts.)
3. THE RATIONALE THAT SUPPORTS THE EXCEPTION NOTED ABOVE. (e.g., compatibility with existing equipment, specific performance criteria, proprietary data, only one capable, urgency, logical follow on, satisfy minimum guarantee, etc.).
4. IF APPLICABLE, WHY IS THE PROCUREMENT SO URGENT THAT TIME WILL NOT TO ALLOW FOR ADVERTISING?

Personality testing supplies and associated materials required as part of the mandatory psychological screening for incoming candidates and instructors at NSWCEN. This is a follow on to a previous contract H9224018D0029 and the government does not plan to deviate from previous plan. Action will establish a five year, firm-fixed price, indefinite delivery, indefinite quantity type contract utilizing simplified acquisition procedures.
FAR 13.106-1(b)(1)(i)- one source reasonably available (PAR Inc)
The particular tests we require, which are the PAI and the NEO-OI-3, both sold through PAR Inc, who own the sole distribution rights. NSWCEN has been using the PAI consistently for the last seven years and the NEO-PI-3 for the last eight years. As a result, we have established an extensive database of of both PAI and NEO-PI-3 scores, which can only be used for predictive analytics and program improvements if we remain consistent with the tests we use. Switching to a different, and inferior, test at this point would render all of the data collected over the last eight years useless. Over the years, the desire for psychological testing has increased by NSWCEN as well as WARCOM. The PAI and the NEO-PI-3 are Personality tests with software that has been pre-approved to run on the SOCOM network.

The Government will continue to survey the market to see in new sources of personality testing become available. At such time as re-procurement the cost of integrating a new system into our current system and migrating all the historic data over will be assessed. It will also be reviewed to see if any new systems, if they are to arise, will be able to be approved to run on the SOCOM network.
