About this file

This document contains a justification for a sole source procurement and notice of intent for a media monitoring license. The Centers for Disease Control and Prevention intends to award a sole source contract to News Exposure, LLC for a media monitoring software license and related services. The license will allow the Injury Center to monitor coverage of priority topics across various media sources to improve focus of messages and dissemination of its work. Interested parties may submit capability statements by February 27, 2024 to be considered for conducting a competitive procurement, though sole source award to the incumbent is contemplated based on past performance meeting requirements. The justification cites News Exposure as the only provider able to deliver the comprehensive monitoring services needed, including radio and broadcast sources, for effective targeting of communications efforts.

D. Justification:

1. The justification for this non-competitive action is: (NOTE: Must select only ONE of the listed justifications for other than full and open competition and fully support the justification in the following paragraphs. Please delete this note prior to submitting the justification.)

☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

☐ Urgency ☒ Exclusive licensing agreements/Proprietary data ☐ Brand name required ☐ Industrial mobilization ☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)

☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”

☐ Urgency ☐ Only One Source ☐ Logical Follow Up ☐ Brand name required

2. Other facts supporting sole source procurement:

a. What can this product/service do that other products/services cannot do?

With limited resources, it is critical that the Injury Center target digital media communications, partnership, and outreach efforts where they will be most effective.

The purpose of this task order is to obtain media monitoring services to track the growing number of priority topic mentions across all media. Monitoring is needed on a variety of topics including child abuse, domestic violence, sexual assault, youth violence, school violence, firearm violence, drug overdose, motor vehicle crashes, suicide, poisoning, traumatic brain injury, falls, fires, marijuana, and may more.

Based on our market research, News Exposure had an almost complete service, whereas the others required a lot of legwork on our end before publishing. The proposal included radio and broadcast as part of their service package. This service will allow us to run special reports on our own and perform searches based on our identified priority topic areas. Unlimited news clips are provided with this service.

This is a follow-on requirement to CDC Contract No. 75D301P11065 for a Media Monitoring License. Vendor is now familiar with program requirements based on past

Rev. 5/14/19 performance of services and has offered a customized media intelligence package to meet ongoing program needs.

b. What other products/services were considered and why did they not meet the need?

For a similar price, other companies only provided clips and no synthesis of information. This would require a lot of work on our end. Other searches were not as comprehensive. For example, we researched Burrelles and their price did not include unlimited clips. Pricing was different for national and state media. Searches were based more on location (national vs. state media) than our priority topics.

3. Program Office efforts to seek potential offerors:

We researched vendors via the Internet for top media companies offering the services needed for our media clips summary. We worked with multiple vendors to obtain quotes and to get a vendor-led demonstration of their services.
