Sole Source Justification for Simplified Acquisitions below the SAT Pursuant to FAR Subpart 13.5

Date: November 26, 2024

Pursuant to the requirements under the authority for commercial items at Federal Acquisition Regulation (FAR) Subpart 13.501 and consistent with the content requirements of FAR 6.303-2.

1. Agency and Contracting Activity. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”

The Consumer Financial Protection Bureau (CFPB), intends to award a sole source contract to Userlytics.

2. Nature and/or description of the action being approved.

The CFPB intends to award a sole source contract to:

Userlytics Corp.

Utilizing commercial procedures without seeking competition for the remote user testing platform provided by Userlytics. This action is being taken pursuant to FAR 13.501.

Userlytics is the only company that provides the type of data required to support the agency needs.

3. Description of Supplies/Services.

The Bureau needs feedback and insights from the public as a vital part of developing digital tools, outreach methods, and products to ensure that we are investing in ideas and solutions that match the needs of our target audience(s) and are usable. Conducting this research and usability testing on all Bureau products is required by Bureau Leadership including the Chief Technology Officer and Director to ensure that Bureau resources are being invested wisely.

The Design & Development team (D&D) uses a SaaS remote user testing/research platform to fulfill this need.

The terms of the Userlytics Enterprise 50,000 subscription would include the following:

• Userlytics Enterprise Plan with 50,000 Panel Credits and 50,000 BYOU Credits.

• Unlimited number of Admin, Creator & Viewer Members;

• Unlimited concurrent testing;

• Access to Userlytics’ Help, FAQ and Resources for training and support;

• Dedicated Account Manager, account set-up and SSO implementation support;

• QA of every unmoderated & moderated session with Userlytics’ participants;

• Participant recruitment & incentives for Userlytics’ participants;

• Standard Enterprise Account features & capabilities

8. Description of market research.

Based on numerous attempts to seek a product or product(s) that could meet the Bureau’s needs, the Government was unsuccessful (refer to item #6 above). As a result, the Government intends to enter into a sole source contract with Userlytics Corp.

9. Any other facts supporting the justification.

10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required.

The Bureau will continue to monitor the marketplace for other potential providers in the future to encourage and promote competition, if possible.

12. The CFPB intends to post the requirement pursuant to FAR 13.501(a)(1)(iii) and 6.305(a).
