SOLE SOURCE JUSTIFICATION FOR
ACQUISITIONS WITHIN THE SIMPLIFIED ACQUISITION THRESHOLD ($250K) UP TO FAR 13.5
THRESHOLD ($7 MIL)
1. In accordance with Federal Acquisition Regulation 13.106-1(b)(1) – actions up to $250k or
13.501(a) – actions up to $7million, I hereby determine that the Drydocking and Hull Repair listed on MAPR61525000755 is available from only one source, and competition is precluded for the reasons indicated below. There are no substitutes available.
2. This acquisition is restricted to the following source:

3. The Drydocking and Hull Repair is estimated to cost $ and is required to be performed by October 15, 2025
The Maritime Administration intends to solicit Industrial Support to drydock the vessel and perform steel repairs to the hull in the dirty oil tank.
4. Because of the urgency of this requirement, only one source will be solicited. The drydocking and hull repair must be performed by October 15, 2025. This office became aware of the requirement on 8-17-2025. If the required performance date is not met, the vessel will be in failure of the regulatory bodies requirements.
5. Check and fill in all that are applicable:
The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. Other information to support a sole-source buy:
Urgent and Compelling due to breach of hull and USCG requiring repair.
1.Why are you recommending a sole source with BBD? I contacted Bayonne Drydock and Repair and GMD Shipyard to price the steel repairs to the hull in the dirty oil tank.
BDD is the only shipyard that can complete the work within the required time frame.
2.Was BDD the only one to provide you with a quote? Yes, BDD was the only contractor to provide a quote. The other contractor did not provide a quote as of today, 4 September 2025.
3.Among those companies, was BDD the only one available to do the work immediately? Yes, BDD is the only company capable and willing to do this work in the New York City Area, where the ship is home berthed. Also, towing the vessels to another port on the East Coast has been eliminated as a possibility by the regulatory bodies due to their concerns about the vessels being out on the open ocean.
