Justification and Approval
For Other than Full and Open Competition
1. Requiring Agency and Contracting Activity:
Requiring Agency: General Services Administration
Customer and Stakeholder Engagement (CASE)
Contracting Activity: General Services Administration, Region 5
2. Description of Action. The purpose of this requirement is to procure a new, firm-fixed priced, contract for market profile subscription services. The requiring agency engages in Federal, Military/Defense, State, and Local Government customer market research and analysis. This research and analysis assists all the components of GSA in determining customer buying patterns and spending trends. In addition to the many
Federal customers and programs, this research and analysis aids GSA in support State and Local initiatives including cooperative purchasing, disaster recovery purchasing and law enforcement programs. Specifically, the purpose of this procurement is to provide and maintain on the Contractor’s website commercial subscription services that provide current and accurate customer data and information on federal executive, legislative and independent agencies and organizations, including the Department of Defense and all branches of the armed forces which includes their command structure and/or associated offices, each of the 50 states, and the top 100 counties and 100 cities
(based on their budgets) within the United States.
3. Description of Supplies or Services. The requirement is to provide commercial subscription services on the Contractor’s website that include, but are not limited to, customer profiles, key contacts, opportunities, issues, initiatives, budgets, customer and industry events, market analysis and the ability to create mail lists. The mail lists shall be compliant with current USPS requirement to facilitate GSA direct communications with the customer. The Government requires enhancements and additional features to the subscription services that address the many product and service markets of GSA and its customer base. The Government also requires unlimited access to the subscription services for all GSA employees who have been issued licenses/user ids.
The requirement also includes providing training using best standard commercial practices and it shall consist of how to effectively use the provided subscription

GSA’s licensed employees are using the subscription services is required.
The estimated lifecycle amount is for a base year and two, 1-year option periods. A breakout of the lifecycle amount is as follows:

4. Authority Cited.
10 U.S.C.2304(c)(1) as implemented by FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
The procedures in FAR 13.5 are being used in accordance with 41 U.S.C. 1901.
5. Reason for Authority Cited.
Deltek, Inc. has been determined to be the only source that can fulfill the government’s requirements. Market research was conducted to determine the availability of potential sources to satisfy this requirement. A sources sought was issued July 17, 2023 through
July 27, 2023 on www.sam.gov requesting potential sources provide detailed responses on their ability to deliver/perform the required capabilities. No responses were received in response to the sources sought request.
6. Efforts to Obtain Competition. CASE has taken all necessary and reasonable actions to prepare for a competitive solicitation of the required Market Profile
Subscription Services, however, no capable responses to the Government’s posted sources sought make this the most prudent procurement strategy for continuation of the required services. The research and analysis provide through this contract is essential to the support of Federal, Military/Defense, State, and Local Government customers.
Disruption of service to the commercial subscription services will severely hamper contract execution for CASE. The loss of this support capability will severely impact the execution of website commercial subscription services that provide current and accurate customer data information on federal executive, legislative, and independent agencies and organizations, including the Department of Defense and all branches of the armed
R5 FAS J&A FAR Part 6 - 02/27/2019 forces, which includes their command structure and/or associated office, each of the 50 states, and the top 100 counties and 100 cities within the United States. Poor execution of these programs will be costly to the taxpayer and detrimental to maintaining subscription services for all GSA employees.
7. Actions to Increase Competition. The Government will regularly review the marketplace to determine if alternate sources can fulfill the government’s requirements.
8. Market Survey. The government conducted additional market research in an effort to fully compete this requirement. A sources sought was released on July 17, 2023 and closed on July 27, 2023. No responses were received in responses to the sources sought. It has been determined that only Deltek could provide the required services.

To date, no other sources have written to express an interest.
A combined synopsis/solicitation will be posted on www.SAM.gov with a redacted copy of this Justification. Any proposals received in response to the combined synopsis/solicitation will be considered.
