About this file
This document is a Sole Source Justification for a direct procurement of Emergency Vehicle Technician (EVT) Training Classes from Atlantic Emergency Solutions for the Navy's Naval Facilities Engineering Command (NAVFAC) Mid-Atlantic. The training will cover three weeks of hands-on instruction for Navy mechanics on maintenance and repair of Pierce and Oshkosh fire trucks, including preventative maintenance, air brakes, chassis electrical systems, aerial maintenance, and AC maintenance. The justification cites exclusive licensing agreements and the unique qualifications of Atlantic Emergency Solutions as the only authorized Pierce and Oshkosh dealer within a 50-mile radius of Hampton Roads with EVT-certified instructors, making them the sole source for this specialized training. The training is critical to maintaining fire truck fleet readiness, with potential impacts on base and flight operations if not performed by an authorized dealer with specific OEM training materials and expertise.

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN
ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
The contractor shall provide all equipment, labor, materials, tools, supervision, and transportation necessary to provide the following classroom and hands Emergency Vehicle Technician (EVT) Training Classes for Navy-owned Pierce & Oshkosh Fire Trucks. Training will be conducted at NAVFAC Mid-Atlantic Hampton Roads location.
Training:
Week 1 Preventative Maintenance and Air Brakes Week 2 Chassis Electrical and Command Zone Week 3 Aerial Maintenance, Side Roll Protection/Frontal, AC Maintenance
Period of Performance: Within 30 days or before of the contract being awarded.
Requested Vendor:
Atlantic Emergency Solutions 144 Freedom Blvd. Yorktown, VA 23692 (P) 757-837-2754, https://www.atlanticemergency.com/
III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING:
A. X ONLY ONE RESPONSIBLE SOURCE:
1. RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
2. X EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
NAVFAC Mid-Atlantic’s fire truck fleet consist of Pierce and Oshkosh units. In order to maintain its fire truck fleet per NFPA and DOT standards, NAVFAC is procuring on-hands training services for its government Heavy Equipment Mechanics. It is crucial that the training be provided by an authorized Pierce and Oshkosh Dealership to comply with NFPA standards. This on-hands training not only requires an authorized dealer to perform and set up the training but also requires specific firefighting training materials and components that can only be provided by a Pierce and Oshkosh authorized dealership with access to OEM http://www.atlanticemergency.com/ http://www.atlanticemergency.com/ specific programs and technology. These firefighting training materials and components are brand name and OEM specific, and no substitutions are available.
Market research revealed that all hands-on training for Pierce and Oshkosh units must be routed and facilitated through the closest authorized Pierce and Oshkosh Dealer with training program materials and capabilities. Atlantic Emergency Solutions is the only authorized Pierce and Oshkosh dealer within a 50-mile traveling radius of Hampton Roads, that has the required EVT certified instructors with in-depth knowledge of the Pierce and Oshkosh equipment, and therefore fully qualified to facilitate the necessary on-hands training.
Without the training being provided by the authorized dealer - Atlantic Emergency Solutions, the maintenance and repair of the fire trucks could be jeopardized, and as such, the potential for reduced base and flight operations would be directly affected if firefighting units are not available due to the lack of being properly maintained and repaired.
3. OTHER REASONS. Other reason not identified above. Provide details on mission impact if requirement is not solicited from only one source.
B. BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.
C. UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
1. Date on which the requirement was first identified:
2. Required delivery date/period of performance:
3. Explanation of why delivery/commencement of services by the date mentioned above is required:
IV. CERTIFICATIONS/APPROVALS:
Technical / Requirements Certification: I certify that the facts and representation under my cognizance which are included in this justification are complete and accurate to the best of my knowledge and belief.
Contracting Officer Approval
I certify that this Justification is accurate and complete to the best of my knowledge and belief.
