About this file

This document is a Sole Source Justification Form from the Illinois Department of Agriculture for the procurement of a Gas Chromatograph with a triple quadrupole (GC/MS) system. The request is to replace the agency's existing obsolete GC/MSD instrument, which is used for analyzing pesticide misuse samples and providing evidence for regulatory investigations. The new system must include the GC with specific components and capabilities, such as a Multimode Inlet, Helium Conservation Module, autoinjector, and a Quadrupole MS/MS detector with MassHunter software. The total value of the purchase is $318,351.19, and the agency is justified in pursuing this as a sole source procurement from the manufacturer, Agilent Technologies, due to compatibility requirements, the unique features of the Agilent system, and the agency's long history with the vendor's equipment. The purchase will require ongoing maintenance and support contracts with Agilent, as they are the sole source for factory-authorized service and upgrades. The agency has determined that Agilent is the only economically feasible source that can meet their specialized needs for this highly technical analytical instrument.

Requesting Agency/University Illinois Department of Agriculture

1. Provide a detailed explanation of the need for the supplies or services:

Gas Chromatograph with a triple quadruple (GC/MS) is essential for the determination of pesticides from misuse samples within the Illinois Department of Agriculture's Pesticide laboratory. This complete system will be a replacement of the existing obsolete Gas Chromatograph Mass Selective Detector (GC/MSD), which is used for the analysis of misuse pesticide samples and provides irrefutable evidence for misuse case investigations. This instrument must include the GC system with a Multimode Inlet, LN2 or Air Cooling, Helium Conservation Module, back flushing module, autoinjector that includes: transfer turret, 16-sample turret, mounting post, parking post for GC. 10ul syringe, and solvent bottles, sample tray (150 vial includes three removable), Gas Clean Carrier Gas filter kit, HP-5MS Ultra Inert 15m, 0,25mm, 0,25um column, the latest NIST MS Library Bundle including over 350K EI spectra for over 300K compounds (40K increase) and GC Methods/Retention indices library with 139K compounds, and Quadrupole MS/MS EI Bundle detector includes MS/MS mainframe, High Efficiency EI source, MassHunter SW software, CPU, and monitor. Also, installation and familiarization must be included, along with on site training. And any other items need to be included to ensure the instrument is properly functioning and capable of performing needed work. This instrument must have the capability of detecting part-per-billion concentrations as part of regulatory investigations conducted by the Department pursuant to the Illinois Pesticide Act (415 ILCS 60/1 et seq.) and the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA).

Based on the laboratory's recent experiences, there has been a noticed deterioration in the current instrument's sensitivity causing a lack of confidence with its reportable data. The instrument deterioration could be missing pesticides from real world samples that could have potential human health effects. Additionally, the manufacturer has phased out support for this model. The newer models offer greater sensitivity and increased analytical capabilities that can increase sample through put and decrease instrument downtimes which will provide financial savings and faster sample turnaround.

Also, according to Agilent's website, the company offers trade-in of old instruments for a percentage off on a purchase of a new instrument. This would be beneficial and cost saving in removing an old instrument and receiving a discounted price for the purchase of a new instrument. Most companies charge for the removal of old equipment. Below is a list that shows the discounted prices by Agilent:

2. Provide a list and describe in detail the specifications required to satisfy the need:

A Gas Chromatograph with a triple quadruple (GC/MS) is essential for the determination of pesticides from misuse samples within the Illinois Department of Agriculture's Pesticide laboratory. This complete system will be a replacement of the existing obsolete Gas Chromatograph Mass Selective Detector (GC/MSD), which is used for the analysis of misuse pesticide samples and provides irrefutable evidence for misuse case investigations. 3. Provide detail explaining the justification selected in Section IV to explain why the requested supplies or services are the only ones available that can satisfy the agency or university requirements?

Based on the laboratory's recent experiences, there has been a noticed deterioration in the current instrument's sensitivity causing a lack of confidence with its reportable data. The instrument deterioration could be missing pesticides from real world samples that could have potential human health effects. Additionally, the manufacturer has phased out support for this model. The newer models offer greater sensitivity and increased analytical capabilities that can increase sample through put and decrease instrument downtimes which will provide financial savings and faster sample turnaround.he IDA pesticide chemists have many years of working knowledge of Agilent instrumentation which will allow for minimal software and hardware familiarization if transitioning to another Agilent instrument. Becoming somewhat proficient with another vendor's instrument has required a minimum of 3 months in the past. This has shown to create a sample backlog with the lab's small staff. Having another Agilent GC/MS allows for data reprocessing, file sharing, and the transfer of laboratory generated pesticide libraries directly from current existing Agilent GC/MS. This would not be possible with an instrument from another vendor. Another vendor's instrument would require complete redevelopment of libraries and also the redevelopment of the many current instrument methods. This would cause significant downtime which would result in sample backlog.

This new model Agilent GC/MS had two primary new features for money savings which are a helium conservation module and backflushing module. The shortage of helium gas, which is used for mobility of samples within the GC/MS, has skyrocketed its cost. The helium module switches to a cheaper gas during non-run times and can reduce gas costs by as much as 30%. The back flushing module prevents contaminants from entering the instrument's detector. This significantly reduces the downtime required to dismantle the detector for cleaning and additionally can eliminate the high cost of repairs or replacement of a contaminated detector.

Agilent instrumentation has demonstrated longevity that has not been seen with other vendors such as Varian and Finnegan. Agilent instruments are the only ones that have remained operational, with minimal repairs for thirty years or more. Given the fact that federal funding of the magnitude that we are to receive is very rare, it is necessary to purchase an instrument that will meet our needs and be dependable for a minimum of 15-20 years. The purchase of an unreliable instrument that fails in a short period of time or becomes obsolete too quickly is not an option as it would leave the lab with the inability to test pesticide misuse samples or to meet its requirements by our cooperative agreement with the U.S. Environmental Protection Agency (U.S. EPA).

Having another Agilent instrument also allows the interchangeability with current Agilent instruments of common parts and consumables, such as autosampler vials/caps, septa, wash vials, etc. This prevents the need for special purchases in order to maintain inventory.

4. What are the unique features of the supplies or services that are not available in any other product or by any other vendor? Provide specific quantifiable factors/qualifications:

Agilent is the sole source economically feasible for proprietary factory recommended software updates/upgrades, engineering upgrades and maintenance procedures. Agilent is the sole source for factory authorized service from factory-trained and -certified representatives. Only Agilent representatives and Agilent authorized service providers are able to attend factory training, including update trainings, and to receive ongoing service notes in order to remain certified and authorized. Further, only factory-authorized representatives are backed by Agilent’s factory, engineering, and global product support infrastructure. Current, up-to-date factory training records are available on demand from Agilent covering all specific Agilent instrument models listed on a bid or quotation.

5. Has the Agency or University considered alternative supplies or services to satisfy their need? Yes No

5a. If no, why weren't alternatives evaluated?

The current Gas Chromatograph with a triple quadruple (GC/MS) is an Agilent instrument that has been in the lab for 32 plus years proving its quality. If sole source economically feasible would be granted with this instrument, software would already be familiar with lab staff and would not need to be completely trained on new software from another company. All current methods would be easily transferable to the new system and would not need to be redeveloped. All current data would still be viewable on the new system and would not be lost if changed to a new company. This is saving a lot of time and costs within the lab in training and redeveloping new methods.

Also according to Agilent's website, the company offers trade-in of old instruments for a percentage off on a purchase of a new instrument. This would be beneficial in removing an old instrument and receiving a discounted price for the purchase of a new instrument is cost saving. Most companies charge for the removal of old equipment. Agilent is the sole source Economically feasible of genuine component parts and replacement parts. 8. Will this purchase obligate the State to this vendor for future purchases such as maintenance, licensing or continuing need?

Yes No

8a. If yes, please provide details regarding future obligations and/or needs:

The current Gas Chromatograph with a triple quadruple (GC/MS) will require maintenance contract agreements with Agilent each year to keep the instrument and software up to date, provide phone support on proprietary hardware and software, genuine Agilent parts, travel, and labor cost on all necessary repairs. Repairs must be performed by an Agilent qualified service engineer.

Current, up-to-date factory training records are available on demand from Agilent covering all specific Agilent instrument models listed on a bid or quotation.

These highly specialized analytical instruments are used to determine the presence of pesticides at part-per-billion concentrations as part of regulatory investigations conducted by the Department pursuant to the Illinois Pesticide Act (ILCS 415 60.1 et seq.) and the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA).

If instruments are not repaired in a timely manner, it is likely that the results of forensic samples collected could pose a potential human health risk. The Department would also not be able to meet requirements of USEPA grant agreements and could lose various federal funds.

9. What will be the financial or other impact to the State if this sole source is not approved and a competitive bid is required?

These highly specialized analytical instruments are used to determine the presence of pesticides at part-per-billion concentrations as part of regulatory investigations conducted by the Department pursuant to the Illinois Pesticide Act (ILCS 415 60.1 et seq.) and the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA).

The IDA pesticide chemists have many years of working knowledge of Agilent instrumentation, which will allow for minimal software and hardware familiarization, if transitioning to another Agilent instrument.

Other vendors also may not provide the excellent quality that we have seen for the past 30 years with the current Agilent instruments that we have. The Pesticide laboratory currently have a GC/MSD and GC/FID that have lasted 30 years that have proven the quality instruments this company provides. Going out to a competitive bid, may receive an instrument that would be needed to be replaced again in a few years due to poor quality, or lead to constant maintenance due to the instrument not functioning correctly.

10. Is there any additional information you would like to add to justify this sole source?

Agilent Technologies, Inc. is the sole equipment manufacturer for all items to be purchased: GC system with a Multimode Inlet, LN2 or Air Cooling, Helium Conservation Module, back flushing module, autoinjector that includes: transfer turret, 16-sample turret, mounting post, parking post for GC. 10ul syringe, and solvent bottles, sample tray (150 vial includes three removable), Gas Clean Carrier Gas filter kit, HP-5MS Ultra Inert 15m, 0,25mm, 0,25um column, the latest NIST MS Library Bundle including over 350K EI spectra for over 300K compounds (40K increase) and GC Methods/Retention indices library with 139K compounds, and Quadrupole MS/MS EI Bundle detector includes MS/MS mainframe, High Efficiency EI source, and MassHunter SW software. Agilent is also the ISO 9001-certified source for factory-authorized service, including installation and familiarization, for all Agilent hardware and software, parts, training, technical support, and at-your-site service and support procedures. Only Agilent service representatives are certified through current and ongoing factory training and hold factory authorization to perform service on Agilent equipment. Agilent does not certify, authorize, or warrant any individuals, third parties, or other equipment manufacturers outside Agilent’s authorized service provider network to provide service or support for any Agilent product. Services performed by providers who are not Agilent factory-authorized could invalidate Agilent’s warranties, and/or lead to irreparable damage, and/or cause safety hazards.

Q1Answer: Gas Chromatograph with a triple quadruple (GC/MS) is essential for the determination of pesticides from misuse samples within the Illinois Department of Agriculture's Pesticide laboratory.

Q2Answer: A Gas Chromatograph with a triple quadruple (GC/MS) is essential for the determination of pesticides from misuse samples within the Illinois Department of Agriculture's Pesticide laboratory. Q3Answer: Based on the laboratory's recent experiences, there has been a noticed deterioration in the current instrument's sensitivity causing a lack of confidence with its reportable data.

Q5aAnswer: The current Gas Chromatograph with a triple quadruple (GC/MS) is an Agilent instrument that has been in the lab for 32 plus years proving its quality.

Q8aAnswer: The current Gas Chromatograph with a triple quadruple (GC/MS) will require maintenance contract agreements with Agilent each year to keep the instrument and software up to date, provide phone support on proprietary hardware and software, genuine Agilent parts, travel, and labor cost on all necessary repairs. Repairs must be performed by an Agilent qualified service engineer.

Agilent is the sole source economically feasible for proprietary factory recommended software updates/upgrades, engineering upgrades and maintenance procedures.

Q9Answer: These highly specialized analytical instruments are used to determine the presence of pesticides at part-per-billion concentrations as part of regulatory investigations conducted by the Department pursuant to the Illinois Pesticide Act (ILCS 415 60.1 et seq.) and the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA).
