About this file

This is a Sole Source Justification (SSJ) for a follow-on contract renewal under the Simplified Acquisition Threshold submitted by the Defense Health Agency Contracting Activity (DHACA) Research & Development Contracting Division 1.

The U.S. Army Medical Research Institute of Infectious Diseases (USAMRIID) seeks renewal of a non-personal services contract for comprehensive support of the Freezerworks Summit Server located in Building 1425 at Fort Detrick, Maryland. The requirement encompasses preventive and corrective maintenance, software upgrades, new version releases, and dedicated customer support. This contract supports a curated repository of chemical compounds used to evaluate therapeutic efficacy against high-consequence pathogens and directly supports the Chemical and Biological Defense Program under 50 UFC 1522. The contract follows on from existing contract W81XWH-21-P-0131 and includes a base period from 3 July 2026 to 2 July 2027, with four option periods extending through 2 July 2031, all funded under RDT&E. The justification for sole source procurement is based on RFO 12.102(a), citing that Dataworks Development, Inc. is the sole author and exclusive owner of Freezerworks laboratory database products and all related add-on modules. The company does not utilize resellers, distributorships, or third-party service providers. Market research conducted in December 2025 determined the services meet FAR's definition of commercial services and are commercially available. A Request for Information posted on SAM for 15 days generated no responses from alternative providers or authorized resellers. The justification notes that migrating to a new vendor would be detrimental to the mission, causing significant work disruptions and project delays, with transition costs far exceeding current contract costs.

3. Authority:

☐ Revolutionary FAR Overhaul (RFO) 8.401 & Subpart 538.7104-3(a) –The ordering activity contracting officer must determine in writing that the circumstances of the acquisition deems only one source reasonably capable of providing the products, services, or solutions (e.g., urgency, exclusive licensing agreements, items particular to one manufacturer).

Or

☒ RFO 12.102(a) – For acquisitions valued at or below the simplified acquisition threshold (SAT), document the decision that only one source is available and the basis for the decision.

Or

☐ RFO 16.507-6(b)(1) -- The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

CUI

Source Selection Information - See FAR 2.101 and 3.104

☐ RFO 16.507-6(b)(2) -- Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

☐ RFO 16.507-6(b)(3) -- The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

☐ RFO 16.507-6(b)(4) -- It is necessary to place an order to satisfy a minimum guarantee.

☐ RFO 16.507-7 -- Items Peculiar to One Manufacturer

4. Reason for Authority Cited:

As the sole author and exclusive owner, Dataworks Development, Inc. is the only provider of Freezerworks laboratory database products and all related add-on modules. The software is manufactured and distributed exclusively by Dataworks Development, Inc. Therefore, maintenance and customer support for all Freezerworks products must be purchased directly, as the company does not utilize any resellers, distributorships, or third-party service providers.

Switching to a new server would cost the government more money to purchase the hardware and a maintenance package would still be required making this process inefficient and more costly.

5. Market Research:

Market Research was conducted in December 2025, in accordance with FAR Part 10, and was multifaceted and undertaken to ascertain 1) if the requirement meets the FAR definition of a Commercial Service and 2) if two or more small businesses exist that can meet the Government’s requirement.

Market Research examined whether the required services met the FAR definition of a commercial service, which is services offered and sold competitively in substantial quantities in the commercial marketplace. Market Research determined that the required services do meet this definition and are commercially available; thus, standard commercial terms and conditions will apply.

Market research was conducted to identify significant market changes, such as technological advancements or economic shifts, that could affect pricing or service requirements. On December 11, 2025, further research was performed to determine if other sources could provide the required maintenance, upgrades, and customer support for the Freezerwork Summit Server.

The analysis concluded that no practical alternatives for these services exist at USAMRIID.

Migrating to a new vendor at this time would be detrimental to the mission, causing significant work disruptions and project delays. The effort and expense of a transition would far exceed the current contract's costs, especially since the existing software is already fully configured to meet USAMRIID's operational needs.
