About this file

This document is a Sole-Source Determination and Justification for the Oregon Department of Fish and Wildlife (ODFW) Lookingglass Fish Hatchery to purchase 18 Marisource - Mar-Stack 8 tray salmon incubators. The hatchery is seeking to replace its existing incubators, which were originally purchased in the 1980s and have reached the end of their useful life. The Marisource incubators are the only product that meet the hatchery's requirements for functionality, compatibility with existing equipment, and continued efficient operation of the facility. The total estimated cost for the incubator purchase is $40,449.93.

The justification provided cites the lack of available alternative products that can meet the hatchery's specific needs, as well as the importance of maintaining consistency with the current incubation system at the endangered species hatchery. The sole-source determination is approved by the ODFW Contract Services Department, allowing the hatchery to proceed with the incubator purchase from the sole-source supplier, Marisource.

SOLE-SOURCE DETERMINATION & JUSTIFICATION

FOR SUPPLIES AND SERVICES

To: Contract Services

From: Lookingglass Fish Hatchery - Christian Hargrove Date: 03/14/2022

Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275 for:

Description of Goods or Services:

Describe Goods or Services you wish to purchase. Give sufficient details: make, model, manufacturer, part number, quantity, etc.

We are wanting to purchase 18 Marisource – Mar-Stack 8 tray salmon incubators Item Number 108334

Reason for Need:

Describe the background or environment leading to need. Describe what it is that you need:

functionality, outcome, results, unique qualities, expertise, etc.

The incubators these will be replacing were purchased in the early 1980’s and the product was discontinued in late 1980’s when the company, Heath, dissolved. After 25 plus years of life at Bonneville fish hatchery these incubators were transferred to Lookingglass fish hatchery (LGH) where they have been used and repaired for 15 plus years. As the Heath incubators have reached end of life, we have replaced them with Marisource incubators, which is a similar system. These Marisource incubators will match up with similar Marisource incubators we use in our current stacks. They also will match our current incubation style and be compatible for space and use of our system without the addition of pumps to raise the water level.

Single of Multiple Purchases:

Specify if this justification is for a single purchase or multiple purchases.

This is for a single purchase of the incubators next fiscal year after hatching we are hoping to permanently install the incubation stacks.

Estimated Cost:

Total estimated dollar value of the purchase or contract.

$40,449.93

Research Leading to Determination:

Describe the Market Research that was conducted that supports the sole source purchase of the requested product or service.

Market Research should include the following:

ODFW conducted further research online and investigated other sources and suppliers, but none could supply the incubation system that fits. Internet search proved the Marisource Incubation system for incubating fish eggs is the only one available that meets LGH’s needs. Other types of incubation have been tried at

Lookingglass Hatchery such as Reddzone incubators, and Moist Air Incubators, and neither were successful at

LGH. Heath was a company who previously made the incubation system like Marisource incubation systems.

Heath has gone out of business and parts are no longer available.

Source of the information - Internet search, trade journals, other governmental agencies, professional organizations, catalogs/industrial periodicals, etc. All of these pertain to the fish egg incubation system at Marisource. Hatchery International, Dec. 2020, an ad for incubators for Salmonids. Aquaculture North America

– no articles in several issues on any type of incubation systems available.

Supporting Documentation - Attach documentation or include information obtained showing comparisons of similar products or services available. No other similar products are available. Online search both in the US and outside of the US was not successful. List mandatory need LGH is an endangered species hatchery, and these incubators are a mandatory need to successfully rear this program. Marisource is the only product or service provider that can meet our minimum requirements.

Compatibility - Describe any compatibility issues or requirements to maintain efficient utilization with existing equipment or continuation of consistent services (ex: research or studies that build on previous results -consistency in study and evaluation methods). LGH currently uses Marisource incubators in the hatchery program. Continuing to use these incubators maintains efficient utilization with existing equipment or continuation of consistent services and needs at the hatchery as well as crew familiarization with equipment.

Analysis of Research / Findings of Fact:

Pursuant to OAR 125-247-0275(2)(a): Compatibility.

Current system is setup and originally designed utilizing Marisource incubation the incubators this will be replacing was not permanently installed we will in the future be permanently installing these incubators and to best utilize head pressure and space of the facility as well as type of incubation we need this Marisource style incubation.

Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data.

Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.

Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project.

Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.

Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies, and Services are available from only one source may include but are not limited to considerations of:

unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.

Through google searches as well as previous incubation purchases shows that Marisource is the only manufacturer of these incubation systems that meet the design and functionality of Lookingglass fish Hatcher
