About this file
This document is a Sole Source Determination and Justification for the purchase of two Smith-Root LR-24 Lithium Electrofisher Combos for the Oregon Department of Fish and Wildlife (ODFW) Tillamook and Newport field offices. The request is being made by the North Coast Watershed District Manager to the Contract Services department. The electrofishers are needed by the Private Forest Accord biologists to conduct end of fish determinations, which are critical for protecting and enhancing fish and wildlife habitats throughout the state under the new Private Forest Accord agreement. The total estimated cost for the two electrofisher combos and accessories is $30,540.60. The purchase needs to be completed before June 30th per the biennium funding source. The sole source justification is based on compatibility with existing equipment, effectiveness of the Smith-Root units in the habitat types, and the exclusive authorized representation.
The procurement will be processed as a sole source pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275. This is not a solicitation, but rather a notice of the sole source procurement. The purchase order will be issued to the ODFW Tillamook field office.

SOLE-SOURCE DETERMINATION & JUSTIFICATION
FOR SUPPLIES AND SERVICES
To: Contract Services
From: Chris Knutsen, NCWD District Manager Date: 3/22/2023
Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275 for:
Description of Goods or Services:
Smith-Root LR-24 Quantity Two Lithium Electrofisher Combos
• LR-24 Electrofisher
• Electrode Pole
• Electrode Ring
• Rattail Electrode
• Lithium battery
• Battery Charger
• Electrofishing Class voucher
Reason for Need:
Requesting purchase for a two new electrofishers for the Private Forest Accord biologists located in Tillamook and Newport. End of fish determinations dictate forest management and rules around streams and riparian buffers. Electrofishing is the most reliable and effective way to make end of fish determinations in the majority of streams throughout Oregon. The Private Forest Accord biologists are required to make end of fish determinations. This purchase will allow the Private Forest Accord biologists to obtain and maintain their own electrofisher for field work throughout the season. Correct end of fish determinations are critical for protecting and enhancing fish and wildlife habitats throughout the state and are under new regulation with the Private Forest Accord agreement. ****This purchase needs to be made before June 30th per the biennium funding source
Single of Multiple Purchases:
Two sets of electofishers and accessories
Estimated Cost:
$30,540.60 Research Leading to Determination:
In my research I found two vendors for this type of electrofishing equipment, Smith Root and ETS.
After talking with other biologists around the state who had extensive experience with both brands of electrofishers it was determined that the Smith Root unit would be the best fit and most effective tool for the work that the Private Forest Accord stream biologist will be completing. Also, the North Coast Watershed District offices located in Tillamook and Newport have Smith Root units so the parts are easily interchangeable. Further, field testing of Smith Root and ETS units by the Private Forest Accord biologist in Adair determined that the Smith Root unit would be the best tool for the job based on ease of use, safety features, battery life, and effectiveness in the habitat types it will be used. Sole Source for Smith Root has already been approved this year for the South Willamette Watershed District. Our needs are the same.
<Please explain market research conducted that supports how other vendors in this market cannot provide a product that would be compatible with existing equipment for this research project. Also, please provide a letter from the vendor explaining that they are the sole source for this product.>
Analysis of Research / Findings of Fact:
Pursuant to OAR 125-247-0275(2)(a): Compatibility.
