I. DESCRIPTION

THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL SERVICES. This acquisition is prepared in accordance with FAR Part 12 and is being conducted using Simplified Acquisition Procedures under FAR Part 13. This announcement constitutes the only solicitation. Quotations are being requested and a separate written solicitation will not be issued.

Solicitation number 140P5426Q0032 is issued as a Request for Quote (RFQ) for hazardous tree, palm, mangrove, and woody vegetation pruning/trimming services at Biscayne National Park (BISC), Convoy Point, Homestead, Florida.

This acquisition is set aside for small business concerns. This solicitation incorporates provisions and clauses by reference. The full text of provisions and clauses may be accessed electronically at www.acquisition.gov.

This requirement is a 100% total small business set-aside. The associated NAICS code is 561730 - Landscaping Services. The small business size standard is $9.5 million. The Product Service Code (PSC) is R499 - Support - Professional: Other.

GENERAL INFORMATION:

This solicitation is a Request for Quote (RFQ) issued using Standard Form (SF) 18. Award will be made using the policies and procedures of FAR Part 12, Acquisition of Commercial Products and Commercial Services, in conjunction with FAR Part 13, Simplified Acquisition Procedures. All references to “proposal” in this solicitation shall be understood to mean “quotation.”

Quotations shall be evaluated in an impartial manner.

Contract Type The award resulting from this solicitation will be a firm-fixed-price commercial services purchase order/award.

COMPLIANCE WITH RECENT EXECUTIVE ORDERS 14148/14208

The quoted Firm-Fixed-Price shall include all costs necessary to perform the complete requirement in accordance with the Statement of Work, including all nine mapped work areas, mobilization, travel, labor, supervision, equipment, insurance, safety controls, debris removal and disposal, and incidentals. The vegetation-composition percentages in the SOW are planning estimates provided for pricing consistency and are not guaranteed quantities. Pricing shall remain firm for the entire 30-calendar-day performance period.

IV. DESCRIPTION OF REQUIREMENT(S)

Independently, and not as an agent of the Government, the Contractor shall furnish all supervision, labor, equipment, tools, materials, transportation, and incidentals necessary to perform hazardous tree, palm, mangrove, and woody vegetation pruning/trimming at Biscayne National Park - Convoy Point within the nine mapped work areas identified in Attachment 1 - Statement of Work and Appendix A.

The requirement includes, but is not limited to, crown thinning, crown raising/clearance pruning, deadwood removal, correction of prior stub cuts, selective removal of crossing or rubbing branches, palm pruning to the specified profile, building/sign/light/dock clearances, selective vista pruning, and Area 5 shoreline vegetation pruning to improve water and ocean views. No complete tree removals, clearing, grubbing, or stump removal are included in the base requirement. The Contractor shall provide required ISA Certified Arborist coverage, comply with applicable ANSI arboricultural and safety standards, protect visitors and park resources, comply with mangrove and environmental requirements, and remove all Contractor-generated debris from Government property each workday.

Please see Attachment 1 - Statement of Work, including the Convoy Point Work Area Map and Legend (Areas 1-9), for complete performance requirements and the estimated vegetation composition provided as a common basis for firm-fixed-price quotations.

V. DELIVERY INFORMATION/TERMS / PERIOD OF

PERFORMANCE

The period of performance shall be complete within thirty (30) calendar days after award, unless otherwise modified in writing by the Contracting Officer. Work shall be performed in accordance with the schedule, normal work hours, and requirements in Attachment 1 - Statement of Work.

Place of Performance: Biscayne National Park - Convoy Point, 9700 SW 328th Street (Sir Lancelot Jones Way), Homestead, Florida 33033, including the nine mapped work areas identified in the Statement of Work.

52.209-11 Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law (Feb 2016) (DEVIATION May 2026)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

Failure to submit quotes according to the instructions provided within the solicitation may result in the respondent's quote not being considered for award.

All interested parties shall be registered in the System for Award Management or SAM at time an offer or quotation is submitted.

pruning methods and standards; equipment and rigging/aerial-work approach; safety, work-zone and visitor/traffic protection; mangrove/environmental compliance; debris removal; and quality control.

Factor 2 - Relevant Experience and Past Performance: Provide three (3) relevant references for similar arboricultural, tree/palm pruning, or vegetation-management services performed within the past five (5) years.

For each reference provide customer/organization, contract number if applicable, contract value, period of performance, brief description, and point of contact name, telephone number, and email address.

Subcontractor Information (if applicable): identify company name, work to be performed, estimated percentage, and relevant arboricultural qualifications/experience. ☐

TO SUBMIT A QUOTE

1. Checklist for Quote Submittal. Submit the completed checklist included in this solicitation as the first page of the quote package.

2. SF-18 and Amendments. Submit a completed and signed SF-18 and acknowledge all amendments, if applicable.

3. Price Schedule. Submit the completed price schedule. The price schedule shall not be altered. Alternate quotes will not be accepted. Offerors shall provide their best pricing as submitted.

4. Technical Capability/Approach (Factor 1). Submit a concise narrative, maximum five (5) pages, demonstrating understanding of the hazardous tree-work requirement and ability to perform the Statement of Work. Address: proposed staffing and supervision; identification of the proposed ISA Certified Arborist and current certification information; approach and sequence for completing all nine mapped work areas within thirty (30) calendar days; pruning methods consistent with the SOW and applicable ANSI standards; equipment, aerial lift/climbing/rigging approach as applicable; safety and accident-prevention measures; work-zone, pedestrian, traffic, building, dock, and resource protection;

mangrove/environmental and wildlife compliance; daily debris removal/off-site disposal; and quality control.

5. Relevant Experience and Past Performance (Factor 2). Provide three (3) relevant references for arboricultural, tree/palm pruning, or vegetation-management services performed within the past five (5) years that are similar in scope and complexity. For each reference provide: customer name and organization; contract number if applicable; contract value;

period of performance; brief description of services; point of contact name; telephone number; and email address.

Experience involving ISA-supervised pruning, public-use or Government sites, coastal/shoreline vegetation, mangroves, docks/buildings, or other environmentally sensitive locations may be considered particularly relevant.

6. Subcontractor Information (If Applicable). Identify proposed subcontractors, work to be performed, estimated percentage, and relevant arboricultural experience/qualifications. The prime contractor remains fully responsible for contract performance.

7. Solicitation Provisions and Representations. Complete all provisions, representations, certifications, and other solicitation requirements as applicable.

8. Quote Submission Instructions. Submit all required documents via email to noelli_medinamarin@ios.doi.gov by the closing date/time identified in this solicitation. The email subject line must state: "Offer - Solicitation No. 140P5426Q____". Offerors are responsible for ensuring timely receipt.

9. System for Award Management (SAM). Offerors must maintain active SAM registration at the time quotations are due, at award, and throughout contract performance. Offerors must qualify as a small business under NAICS 561730 - Landscaping Services.

(End of addendum) 52.212-2 Evaluation - Commercial Products and Commercial Services (Nov 2021) (DEVIATION Mar 2026) The Government will evaluate quotes and make award to the responsible offeror whose quotation represents the best value to the Government. The Government intends to evaluate quotations and may award without discussions.

The following factors shall be evaluated:

Factor 1 - Technical Capability/Approach The Government will evaluate the offeror's understanding of the hazardous tree-work requirement and the feasibility of its approach to performing the Statement of Work. Evaluation will consider proposed ISA Certified Arborist qualifications; staffing and supervision; ability to complete all nine mapped work areas within the required period; pruning methods and compliance with applicable ANSI standards; equipment and work methods; safety and protection of visitors, facilities, and park resources;

mangrove/environmental compliance; debris removal; and quality control.

Factor 2 - Relevant Experience and Past Performance

The Government will evaluate the offeror's relevant experience and past performance on similar arboricultural, tree/palm pruning, or vegetation-management services performed within the past five (5) years. Offerors shall provide three (3) relevant references. For each reference, provide customer/organization, contract number if applicable, contract value, period of performance, brief description of services, and customer point of contact name, telephone number, and email address. The Government may contact references and may consider other relevant past performance information available to the Government.

Factor 3 - Price The Government will evaluate the total firm-fixed price for completeness and reasonableness. Price may be evaluated using competition, comparison with the Government estimate, market information, or other price analysis techniques as appropriate.

AWARD SELECTION PROCESS

Award will be made in accordance with FAR Part 12 using Simplified Acquisition Procedures under FAR Part 13 to the responsible small business offeror whose quotation conforms to the solicitation and represents the best value to the Government, considering Technical Capability/Approach, Relevant Experience and Past Performance, and Price. The Government may award without discussions. A quotation that fails to meet a material requirement of the solicitation may be determined unacceptable and may not be considered further.

(a) Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. (End of provision) Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (Feb 2021) Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Products and Commercial Services included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

1. Copy of vendor invoice document in PDF format, which shows pricing breakdown for all items being invoiced for and must include the contract number, date(s) of service (if applicable), date of invoice, and the vendor's standard invoice letterhead.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973- 3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

(End of clause) 1452.201-70 Authorities and Delegations (Sep 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment. The COR for this contract will be:

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

(End of clause) 1452.228-70 Liability Insurance - Department of the Interior (Jul 1999)

(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:

$100,000.00 each person $500,000.00 each occurrence $500,000.00 property damage

(b) Each policy shall have a certificate evidencing the insurance coverage. The insurance company shall provide an endorsement to notify the Contracting Officer 30 days prior to the effective date of cancellation or termination of the policy or certificate; or modification of the policy or certificate which may adversely affect the interest of the Government in such insurance. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy number and a brief description of contract services to be performed. The contractor shall furnish the Contracting Officer with a copy of an acceptable insurance certificate prior to beginning the work.

(End of clause) Prohibition of All Terrain Vehicles (ATVs) (Jul 1996) The contractor is prohibited from utilizing All-Terrain Vehicles (ATV)s on National Park Service lands. ATV is defined as: A motorized off-highway vehicle (OHV) traveling on four or more low-pressure tires, having a seat to be straddled by the operator and a handlebar for steering control.

Use of Utility Terrain Vehicles (UTVs) are permitted. UTV (also called a side-by-side) is defined as: A motorized OHV having four or more low pressure tires, designed with side-by-side seats, seatbelts, steering wheel, and optional cab, brush cage, or

ROPS.
