1.0 - GENERAL INFORMATION

This is a COMBINED SYNOPSIS / SOLICITATION for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The National Park Service contemplates award of a firm fixed price contract as a result of this combined synopsis/solicitation to the vendor. This announcement constitutes the only solicitation issued as Request for Quotation (RFQ) 140P4223Q0078. A WRITTEN SOLICITATION WILL NOT BE ISSUED. FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular (FAC) 2023-04 and are available in full text through Internet access at http:// www.acquisition.gov/far/.

This acquisition is in support of Colonial National Historical Park (COLO).

This is a 100% Total Small Business Set Aside. The North American Industry Classification System (NAICS) code is 238210. The small business size standard is $19.0M.

1.3 AWARD SELECTION PROCESS

Per FAR Part 13.106-2(b) evaluation will be conducting by comparative evaluation of offerors. This solicitation is not stating nor required to state the relative importance assigned to each evaluation factor and/or sub factor (FAR 13.106-1(a)(2)).

The following factors shall be evaluated:

Price: Quotes shall be ordered from lowest to highest, by “Total Evaluated Price.” The Total Evaluated Price will be evaluated by adding the total price for all options to the total price for the basic mailto:eric_hubbell@nps.gov requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). Prices must be determined “Fair and Reasonable” in order to be considered for award.

Technical: Technical is the factual documentation of the firm’s ability to meet the specifications. To be considered for award, quotes must be determined “Technically Acceptable.” To be considered Technically Acceptable, the quote must meet all of the following Technical Subfactors:

Technical Subfactor 1, Key Personnel: Provide resumes, certifications, and other relevant documentation demonstrating minimum qualifications, meeting the qualification requirements of Contractor personnel described in the attached Statement of Work as referenced in 5.0 - List of Attachments.

For this Subfactor to be considered “Technically Acceptable,” the quote must provide resumes (not to exceed two (2) pages), certifications, and relevant documentation demonstrating the Contractor can provide personnel fully qualified to perform the work specified in the Statement of Work.

Technical Subfactor 2: Prior experience: Prior experience is the factual documentation or narrative of a firm’s experience, qualifications, and capability, along with providing three (3) examples of their firm’s most recent projects within the past five years of similar size and scope.

For this Subfactor to be considered “Technically Acceptable,” the quote must provide at least three (3) examples of projects that have taken place within the past 5 years and are relevant to the work contemplated in the Statement of Work. The Contractor shall provide contact information for each project (not to exceed five (5) pages). To be considered relevant, projects submitted must be similar in scope, magnitude, and complexity to the work contemplated in the Statement of Work.

Basis for Award: Award shall be made to the firm whose quote is determined to be the “best value.”

The lowest contractor’s proposal whose price is considered Fair and Reasonable and is determined to be “Technically Acceptable” shall be considered as the best value quote.

2.0 - INSTRUCTIONS TO OFFERORS

Quotes must be in accordance with and in the order detailed in this section. Failure to submit quotes according to the instructions provided within the solicitation may result in the respondent’s quote not being considered for award.

All interested parties shall be registered in the System for Award Management or SAM at time an offer or quotation is submitted.

The offerors shall submit a quote to the contracting specialist by email to Name@nps.gov.

(d) Comptroller General Examination of Record. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. (2) While not required, the Contractor may include in its subcontracts for commercial products and commercial services a minimal number of additional clauses necessary to satisfy its contractual obligations.

FAR 52.217-8 OPTION TO EXTEND SERVICES NOV 1999

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within three (3) days.

FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT MAR 2000

(a) The Government may extend the term of this contract by written notice to the Contractor within three hundred (300) days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least one (1) day before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed twelve (13) months.

DIAR 1452.201-70 AUTHORITIES AND DELEGATIONS SEP 2011

[Note to Contracting Officer; This clause only applies when a COR will be designated.]

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award.

The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.

Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.

The Contractor need not proceed with direction that it considers to have been issued without proper authority.
